HomeMy WebLinkAboutOrdinance 2010-350 ORDINANCE NO. 2010-~C) AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 96 OF THE CITY CODE PERTAINING TO ALARM SYSTEMS; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code Enforcement Division of the Community Development Department is assigned the task of coordinating and regulating alarm system registrations for the City of Sunny Isles Beach (the "City"); and WHEREAS, Chapter 96 of the City Code regulates alarm systems in the City and the City wishes to amend certain sections pertaining to false alarm notifications and penalties. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 96 of the City Code is amended to read as follows: ~ 96-17 False Alarm Notifications. A. The owner/user of an alarm or the person in control of an alarm system shall be subject to fees or penalties concerning his/her alarm depending upon the number of false alarm notifications emitted from an alarm system covered by this chapter within the fiscal year. B. Ne-p~enalties shall be assessed for the first t\VO false alarms/alarm malfunctions at the same specific alarm site during a fiscal year as follows: ill Residential premises - no penalty for the first 2 (two) false alarms/alarm malfunctions. ill Commercial premises - no penalty for the first false alarm/alarm malfunction. ~ 96-18 Schedule of fines; penalties; liens. D. No residential or commercial premise alarm owner/user shall cause, allow, or permit the burglar alarm system to give two or more false alarms in any fiscal year. (2) For the fourth third false burglar alarm in the fiscal year, a fine of $1 00 shall be issued. penalties shall be assessed as follows: Uti Residential premise alarm owners/users - $50.00 penalty. Dll Commercial premise alarm owners/users - $150.00 penalty. (3) For the fifth and each additional false burglar alarm in the fiscal year, fourth false burglar alarm in the fiscal year, a fine of $200 shall be issued. penalties shall be assessed as follows: Uti Residential premise alarm owners/users - $100.00 penalty. Dll Commercial premise alarm owners/users - $200.00 penalty. ill For the fifth and each additional false burglar alarm in the fiscal year, penalties shall be assessed as follows: Uti Residential premise alarm owners/users - $200.00 penalty. Dll Commercial premise alarm owners/users - $250.00 penalty. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. This Ordinance shall be effective ten (l0) days after adoption on second reading. Vera 1 Assistant City Manager 1 Service Division DATE: 9/16/2010 RE: Amendment to Chapter 96 "Alarm Systems" RECOMMENDATION: It is recommended that the City Commission approves the attached Ordinance proposing a revision Chapter 96 of the City Code entitled "Alarm Systems" REASONS: A request has been made to staff to review the false alarm ordinance regarding the number of notifications and fees associated with them. It has come to staffs attention that many of the false alarms that are received by the Police Department or Code Enforcement Division are due to improper use of the alarm system, therefore staff is amending the ordinance reducing the number of free alarm calls given as well as the fees associated with them. Staff has compared our current alarm notification and fees with those of other municipalities within our County and abutting municipalities, and we have made some proposed adjustments as detailed in the attached proposed fee schedule. The changes affect only the commercial businesses. They will be permitted to have only one free false alarm and the fees have increased by Fifty Dollars ($50) per occurance. ATTACHMENTS: .
