ORDINANCE NO. 2010 - 3S.1
AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AMENDING CHAPTER 156 OF THE SUNNY ISLES
BEACH CODE ENTITLED "FEES, MISCELLANEOUS"; ADOPTING
A REVISED FEE SCHEDULE FOR THE BUILDING DEPARTMENT,
A TT ACHED AS EXHIBIT "A"; PROVIDING THE CITY MANAGER
WITH THE AUTHORITY TO REVIEW ANNUALLY ALL
BUILDING DEPARTMENT FEES; PROVIDING FOR REPEALER;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by Section 156-1 of the Code of the City of Sunny Isles Beach, the City
Commission adopted a fee schedule for the Building Department; and
WHEREAS, the City Manager has the authority to review all Building Department
fees to determine if an adjustment to the fee schedule should be recommended to the City
Commission; and
WHEREAS, based on in-depth review of the fee schedule, City Manager is
recommending an adjustment to the fee schedule as reflected in Exhibit "A", amending
Chapter 156 of the Sunny Isles Beach Code,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Adoption of Revised Fee Schedule. The revised building fee schedule,
attached hereto as Exhibit "A" is hereby adopted for the City of Sunny Isles Beach.
Section 2. Authoritv of City Manager. The City Manager and/or his designee are hereby
directed to annually review the Building Department Fee Schedule to determine if an
adjustment to the fee schedule should be recommended to the City Commission.
Section 3. Effective Date. This Ordinance shall become effective ten (10) days after
adoption upon second reading.

A. GENERAL INFORMATION ON SPECIAL FEES,

1. DOUBLE FEES

Any person who commences building, structural,
electrical, gas, mechanical or plumbing system work
before obtaining the building official's approval by
means of a City-issued permit shall be subject to a
penalty of 100 percent (100%) of the usual permit
fee in addition to the required permit fees. When
work (for which a permit is required) is commenced
prior to obtaining a permit, the homeowner will be
required to pay the specified fee twice (double
permit fee) to the Building Department before it will
issue the permit plus penalty fee. The payment of
the required fee shall not relieve the applicant from
being subject to any other penalties therein (code
enforcement fines may apply). The double fee
requirements shall be applicable to all divisions of
the Building Department as noted herein.

If a permit applicant is found doing work without a
permit as stated above in A-DOl a second time, the
permit applicant shall be required to pay twice the
double fees plus the following amount.
If a permit applicant is found doing work without a
permit as stated above in A-DOl a third time and any
other time thereafter, the permit applicant shall be
required to pay twice the double permit fee plus the
following amount.
2. RE-INSPECTION FEES
Upon receipt of a permit, the permit holder shall be
entitled to one (1) initial inspection for each
mandatory inspection. All work shall be inspected
and if any deficiency is found it shall be noted by the
inspector for correction by the contractor. When the

work described on the permit is partially completed,
an inspection shall be performed on those portions
of the work completed, provided that compliance
with the Florida Building Code may be determined
with respect to those portions. If an inspection is
required to assure compliance with the Florida
Building Code once the initial inspection and one (1)
follow-up inspection have been done, the permit
holder shall pay a fee for each additional inspection.
All such re-inspection fees shall be paid prior to any
re-inspection taking place and the final inspection
being conducted. Payment should be in person at
the City of Sunny Isles Beach Building Department.

(a) LOST PLANS: When a field copy (job copy) is
lost, a recertification fee shall be paid to the Building
Department (before the office copy is sent out for
duplication). The recertification fee shall cover the
following services from the Building Department:
review and approval by all applicable trades, and
stamp indicating the Building Official's certification.
Such fee shall be based on thirty percent (300/0) of
the oriainal buildina Dermit fee.

4. REFUNDS, TIME LIMITATIONS, AND
CANCELLATIONS

The fees charged pursuant to this schedule, provided
the same are for a permit required by Section 101.1.1
105.1 of the Florida Building Code, may be refunded by
the Building Official with the following exceptions:
(a) No refunds shall be made on requests involving:
(1) permits fees of $100.00 $125.00 or less;
or
(2) permits revoked by the City Manager or
the Building Official under authority granted by
the Florida Building Code, or permits cancelled by
Court Order, or conditional permits; or
(3) permits which have expired; or
(4) permits under which work has
commenced as evidenced by recorded inspection
having been made by the Building Department;
or
(5) no refunds shall be made on a permit
when a change of contractor is requested.
(b) A full refund less $100.00 $125.00 or 50% of the
permit fee, whichever is greater, rounded to the
nearest dollar, shall be granted to a permit
holder who requests a refund provided that:
(1) The Building Department receives an
original and hardcopy written request from the
permit holder prior to the permit expiration date;

(2) The permit holder submits with such
request [JS noted in item no. A 009(b)(1)] the
Applicant's validated copy of such permit; and
(3) That no work has commenced under such
permit as supported by any recorded inspection
and/or field inspection.
(c) Applications having a change of contractor or
qualifier shall pay a fee of $85.00 $100.00 to
cover the cost of transferring the data from the
original permit to the second permit. When an
original permit has expired under section 105.4
of Florida Building Code the original permit fee
shall be paid.
(d) A fee of $100.00 shall be paid by the permit
holder who submits a written request for a
permit extension as authorized under the Florida
Building Code Section 301.3(b). 105.3.2
(e) Where a permit has become null and void
pursuant to section 101.5.1 105.4.1 Florida
Building Code, a credit of fifty percent (50%) of
the original permit fee shall be applied to any re-
application fee for permit covering the same
project and involving the same plans, provided
that the complete re-application is made within
six (6) months of the expiration date of the
original permit, and provided that no refund had
been made as provided in this Section.

5. SPECIAL PROJECTS:

A fee equal to actual staff time and related costs shall
be assessed for special projects requiring research by
the Building Department in order to answer questions
proposed by developers, attorney's, realtors, or
municipalities, and others, in connection with the use,
re-subdivision, and development of properties, or
determination if any violations exist on the property
through a review of departmental records. Such
special fee will only be levied for requests outside the
scope of normal departmental work.

Amendment to Chapter 156 - Building Department's Fee Schedule
RECOMMENDA TION:
It is recommended that the City Commission approves the attached Ordinance proposing
a revision to Chapter 156 of the City of Sunny Isles Code of Ordinances - Building
Department Fee Schedule.
REASONS:
Following the City Commission's recommendation and as directed by Chapter 156-2 of
the Charter and Code of the City of Sunny Isles Beach, the Building Department has
reviewed its Fee Schedule. We have compared our current fees with those of other
municipalities within our County and abutting municipalities, and we have made some
proposed adjustments as detailed in the attached proposed fee schedule. (See Exhibit A)
Among the most relevant proposed adjustments to our fee schedule, we have increased
our re-inspection fee from $65.00 to $75.00. We have increased our minimum fee for lost
set of plans from $90.00 to $100.00. We have increased our Change of Contractor Fee
from $85.00 to $100.00. We have increased our Structural Plans examiner review fee
from $115.00 to $125.00. We have increased the minimum permit fees for all trades,
from $100.00 to $125.00. We have decreased our residential elevator fee from $360.00 to
$300.00. The fees for boilers and pressure vessels fees have been increased. We have
amended section 6 within the "General Information on Special Fees, Refunds, Extensions
and Cancellations" section, to reflect the DBPRJDCA Surcharge changes as adopted in
the Florida Statutes. Lastly, we have incorporated sections I and J where condominium
associations have the option of pre-paying the cost of permits, on an annual basis, for
certain work done in the common elements and inside condominium units, as set forth in
the proposed fee schedule. (See Exhibit A, Sections I and J)
