Home My WebLink AboutReso 2010-1608 - RESOLUTION NO. 2010 - --1 ~ Q <2 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE APPROVAL OF CHANGE ORDER NO. 4 TO AGREEMENT WITH COAST AL CONSTRUCTION COMPANY FOR PROFESSIONAL CONSTRUCTION SERVICES FOR THE HERITAGE PARK AND PARKING GARAGE PROJECT, TO BEGIN CONSTRUCTION ON THE P ARK PORTION OF HERITAGE PARK, IN AN AMOUNT NOT TO EXCEED ONE MILLION FOUR HUNDRED FIFTY -FOUR THOUSAND FOUR HUNDRED SEVENTY-NINE DOLLARS ($1,454,479.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach issued Request for Qualifications No. 09- 03-01 for Professional Construction Services for the Heritage Park and Parking Garage; and WHEREAS, on June 18, 2009 via Resolution No. 2009-1434, the City Commission awarded Request for Qualifications No. 09-03-01, and entered into an agreement with Coastal Construction Company, to provide construction services for Heritage Park and Parking Garage, in an amount not to exceed Nine Million Two Hundred Fifty Thousand Dollars ($9,250,000.00); and WHEREAS, the City bifurcated the agreement to allow the contractor to commence construction on the parking garage portion of the project, and entered into a contract for the construction of the parking garage at Heritage Park for an amount not to exceed Six Million Six Hundred Thousand Forty Dollars ($6,600,040.00); and WHEREAS, the City amended the plan to change the fayade to add a decorative screening to the parking garage, add masonry and to address additional comments from the Fire Department, and on January 28, 2010 via Resolution No. 2010-1520 the City Commission approved Change Order No. 1 to the Agreement with Coastal Construction Company to provide these services for the construction of the Heritage Park and Parking Garage Project, in an amount not to exceed Nine Hundred Three Thousand Four Hundred Twenty-Seven Dollars ($903,427.00), bringing the total contract amount not to exceed to Seven Million Five Hundred Three Thousand Four Hundred Sixty-Seven Dollars ($7,503,467.00) for the parking garage, unless amended by prior approval of the City; and WHEREAS, Change Order No. 2 to the Agreement with Coastal Construction Company for the construction of the Heritage Park and Parking Garage Project, decreased the amount of the Agreement by Eighty-One Thousand Four Hundred Five Dollars and Twelve Cents ($81,405.12), bringing the total contract amount not to exceed to Seven Million Four Hundred Twenty-Two Thousand Sixty-One Dollars and Eighty-Eight Cents ($7,422,061.88) for the parking garage, unless amended by prior approval of the City; and WHEREAS, the City is now paying for materials used in the construction of the project, totaling Eight Hundred Fourteen Thousand Six Hundred Forty-Seven Dollars ($814,647,00), directly to the Subcontractor; and WHEREAS, Change Order No. 3 to the Agreement with Coastal Construction Company for the construction of the Heritage Park and Parking Garage Project, decreased the amount of the Agreement by Eight Hundred Fourteen Thousand Six Hundred Forty-Seven Dollars ($814,647.00), attached hereto as Exhibit "A", bringing the total contract amount not to exceed to Six Million Six Hundred Seven Thousand Four Hundred Fourteen Dollars and Eighty-Eight Cents ($6,607,414.88) for the parking garage, unless amended by prior approval of the City; and WHEREAS, the City is now ready to begin construction on the Park portion of Heritage Park and are asking for additional work to be performed including demolition of the Public Works building and Park site, additional sitework, concrete work, and electrical work in an amount not to exceed One Million Four Hundred Fifty-Four Thousand Four Hundred Seventy-Nine Dollars ($1,454,479.00); and WHEREAS, Change Order No.4 to the Agreement with Coastal Construction Company for the construction of the Heritage Park and Parking Garage Project, increases the amount of the Agreement by One Million Four Hundred Fifty-Four Thousand Four Hundred Seventy-Nine Dollars ($1,454,479.00), attached hereto as Exhibit "A", bringing the total contract amount not to exceed to Eight Million Sixty-One Thousand Eight Hundred Ninety- Three Dollars and Eighty-Eight Cents ($8,061,893.88) for the parking garage and park, unless amended by prior approval of the City; and WHEREAS, the overall contract amount approved under Resolution No. 2009-1434 for the construction of the park and parking garage for Heritage Park remains the same, in an amount not to exceed Nine Million Two Hundred Fifty Thousand Dollars ($9,250,000.00). NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratify the Approval of Change Order No.4 to Agreement. Change Order No. 4 to Agreement with Coastal Construction Company, increasing the amount of the contract by One Million Four Hundred Fifty-Four Thousand Four Hundred Seventy-Nine Dollars ($1,454,479.00) for the Heritage Parking Garage Project, to the amount not to exceed Eight Million Sixty-One Thousand Eight Hundred Ninety-Three Dollars and Eighty-Eight Cents ($8,061,893.88) for the parking garage and park, attached hereto as Exhibit "A", be and the same, is hereby approved. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. RECOMMENDATION: The staff recommends approval of this resolution to allow work to begin on the park portion of Heritage Park. REASONS: HISTORY: The garage portion of Heritage Park is nearing completion. After many iterations of the park design, the Commission authorized a layout plan and technical design began. The original design in our opinion woefully under accounted for drainage, and so we have been waiting for the revised plans. That has now been accomplished and we are ready to start construction. A point that has been raised several times is the original commitment made by staff to create a parking garage and basic park for a total of $9,250,000. We continue to abide by that commitment and the $1,454,479 being requested is the balance of that amount less the cost of the garage. We have prepared a presentation for the Commission which will show the costs of the additional improvements we would like to make to the park, and as originally projected, to create the true gem this park can be, we will request that further improvements totaling $1,900,000 be ultimately approved. Again, this current request is only for the original total of$9,250,000 for the items that wilI be displayed at the Commission Meeting.
