A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO
APPLY FOR, RECEIVE AND ACCEPT A SAFE NEIGHBORHOOD PARKS
(SNP) BOND PROGRAM GRANT WITH MIAMI-DADE COUNTY, FOR
THE 151 SUNNY ISLES BOULEVARD PARK PROJECT, IN THE AMOUNT
OF TWO HUNDRED THOUSAND DOLLARS ($200,000.00); AUTHORIZING
THE CITY MANAGER TO TAKE ANY AND ALL ACTION NECESSARY
WITH RESPECT TO THE OBTAINING AND DISTRIBUTION OF GRANT
MONIES, AS APPROPRIATE, AND TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on July 16, 2009, via Resolution No. 2009-1449, the City Commission
authorized the City Manager to apply for, receive and accept a Safe Neighborhood Parks Bond
Program Grant with Miami-Dade County, for the Bella Vista Bay Park Expansion Project, in the
amount of$200,000.00; and
WHEREAS, the property owners at 488 Sunny Isles Boulevard adjacent to the Bella Vista
Bay Park property have now filed bankruptcy and the City of Sunny Isles Beach now wishes to
substitute that property with the property the City has purchased located at 151 Sunny Isles
Boulevard to be developed into a Park; and
WHEREAS, the citizens of Miami-Dade County have authorized the issuance of general
obligation bonds (the "Bonds") for the purpose of financing capital improvement programs for
certain parks, beaches, natural areas and recreation facilities; and
WHEREAS, to implement and give effect to the bond program, Miami-Dade County,
Florida enacted Ordinance No. 96-115, the Safe Neighborhood Parks Ordinance (the "Ordinance");
and
WHEREAS, it is necessary and desirable to improve the quality of life, to benefit property
values, to promote prevention of juvenile crime by providing positive recreation opportunities, and to
improve the recreation facilities for youth, adult, and senior citizens in this community through the
improvement of our parks and natural areas; and
WHEREAS, in order to foster those important values, the projects more specifically listed
below have been identified for reimbursement pursuant to the terms of the Ordinance; and
WHEREAS, pursuant to the terms of the Ordinance, the passage of this resolution and the
acts contemplated by this resolution are conditions to obtaining a grant; and

WHEREAS, the City of Sunny Isles Beach wishes to make application for the grant monies
for the Projects listed below subject to all terms and conditions of the Ordinance.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authority to Apply For, Receive, Accept, and Expend Funds from a Grant. The City
Manager is hereby authorized to make application for a grant for the Projects and in the amount
listed below, and in connection with such application to execute such grant agreement and other
contracts and documents, to expend Safe Neighborhood Parks bond funds received for the purposes
described in the funding request, to execute any necessary amendments to the grant application and
contracts, and take such other acts as may be necessary to bind the City of Sunny Isles Beach and
accomplish the intent of this resolution. Application shall be made with respect to the following
project (the "Project") in the amount set forth below.

Section 2. Proiects Completion. The City of Sunny Isles Beach shall complete the Projects in
accordance with the terms of the grant agreement, the Ordinance, and the administrative rules
authorized by the Citizens' Oversight Committee (the "Committee") to implement the Ordinance. If
the total cost of a Project exceeds the value allocated in the grant, then the City of Sunny Isles Beach
will provide any supplemental funds required to complete the Project. In the event that supplemental
funds are necessary for completion of a Project, as of the point in time that it is known that
supplemental funds are needed, the City of Sunny Isles Beach will demonstrate that such
supplemental funds have been committed to the Project prior to and as a condition of disbursement
or further disbursement of grant funds. The requirement for the City of Sunny Isles Beach to provide
any supplemental funds required to complete the Project may, at the sole discretion of the
Committee, be modified in whole or in part by a reduction in scope of work consistent with the
Ordinance.
Section 3. Parks are Open and Accessible to the Public. The City of Sunny Isles Beach
recognizes and directs that any beach, park, or other public facility acquired, developed, rehabilitated
or restored with bond funds, including the Projects, shall be open and accessible to the public
without discrimination as to race, color, gender, age, religion, belief, residence, natural origin,
marital status or disability.
Section 4. Commit Funds. To the extent allowed by law, the City of Sunny Isles Beach will
provide all funds which may be required to operate, maintain and provide programming at each park
project upon its completion.
Section 5. Capital Proiect Funding. No substitution in capital project funding by the City of
Sunny Isles Beach shall occur as a result of the grant for which the City of Sunny Isles Beach is

applying.
Section 6.
Effective Date. This Resolution shall become effective upon adoption.

MEMORANDUM

Assigning 151 Sunny Isles Boulevard as the eligible property for the Safe
Neighborhood Grant.
RECOMMENDATION:
Staff is requesting Commission to approve the attached Resolution for the substitution of
488 Sunny Isles Boulevard to 151 Sunny Isles Boulevard to be eligible for the Safe
Neighborhood Grant.
REASONS:
On July 16, 2009, via Resolution No. 2009-1449, the City Commission authorized the
City Manager to apply for, receive and accept a Safe Neighborhood Parks Bond Program
Grant with Miami-Dade County, for the Bella Vista Bay Park Expansion Project, in the
amount of $200,000.00. The qualifying property for this grant is 488 Sunny Isles
Boulevard. Since the property owners of the eligible property have filed bankruptcy, the
City may not have the opportunity to purchase this property by the December 31, 2010
grant deadline.
As such, on May 20, 2010 Commission Meeting, staff respectfully requested the
Commission to authorize the current City-owned property at 151 Sunny Isles Boulevard
to be the qualifying property for the SNP grant to prevent the potential loss of this grant
award. At this meeting, Commission made and approved the motion to change the
qualifying land to 16100 Collins Avenue as this was deemed more suitable for the grant.
Unfortunately, the Safe Neighborhood Program Citizens' Oversight Committee
(SNPCOC) would not accept the change to 16100 Collins Avenue. Currently, the
Miami-Dade Board of County Commissioners is in the process of dissolving the
SNPCOC and transferring the powers and duties of the SNPCOC to the Mayor or his
designee. If Board of County Commission approve this Ordinance, this change may be
effective in October. However, we are not certain if the Mayor or designee wilJ authorize
the change in the qualifying land. As such, we are respectfully requesting for 151 Sunny
Isles Boulevard to also be eligible for the Safe Neighborhood grant in the event that the
Staff is not successful with the 16100 Collins Avenue property.
