RESOLUTION NO. 2010 - ~
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT FOR ADDITIONAL WORK TO THE
APPROVED AGREEMENT WITH WEST CONSTRUCTION, INC. FOR
PROFESSIONAL DESIGN AND BUILD SERVICES FORA SKATEBOARD
PARK AT TOWN CENTER PARK, IN AN AMOUNT NOT TO EXCEED
ONE HUNDRED NINETY-TWO THOUSAND EIGHT HUNDRED
SEVENTY-EIGHT DOLLARS AND FIFTY-FIVE CENTS ($192,878.55),
ATTACHED HERETO AS EXHIBIT "A", AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has long desired to have a skateboard park for the
enjoyment and safety of our youth; and
WHEREAS, on January 28, 2010 via Resolution No. 2010-1522 the City entered into a
contract with West Construction, Inc. for professional design and build services for the skateboard
park at Town Center Park for an amount not to exceed Two Hundred Fifty Thousand Dollars
($250,000.00); and
WHEREAS, the City now desires to expand the scope of work in the contract to include a
concession stand, canopy covers over the skateboard area and lighting; and
WHEREAS, West Construction, Inc. has expressed its ability and desire to provide these
services and provided the City with a proposal for these services in an amount not to exceed One
Hundred Ninety-Two Thousand Eight Hundred Seventy-Eight Dollars and Fifty-Five Cents
($192,878.55); and
WHEREAS, the City wishes to approve Change Order No.1 to the Agreement with West
Construction, Inc., to provide these services for additional improvements to the skateboard park in an
amount not to exceed One Hundred Ninety-Two Thousand Eight Hundred Seventy-Eight Dollars and
Fifty-Five Cents ($192,878.55), attached hereto as Exhibit "A", bringing the total contract amount
not to exceed Four Hundred Forty-Two Thousand Eight Hundred Seventy-Eight Dollars and Fifty-
Five Cents ($442,878.55).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Change Order No. 1 to the Agreement. Change Order No. 1 to the
Agreement with West Construction, Inc., to add One Hundred Ninety-Two Thousand Eight Hundred
Seventy-Eight Dollars and Fifty-Five Cents ($192,878.55), to the skateboard park project for a total
contract amount not to exceed Four Hundred Forty-Two Thousand Eight Hundred Seventy-Eight
Dollars and Fifty-Five Cents ($442,878.55), for the construction of the skateboard park project
attached hereto as Exhibit "A", be and same, is hereby approved.

Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution will become effective upon adoption.

Skateboard Park Contract Amendment
RECOMMENDA TION:
It is recommended that the City Commission approve the attached resolution awarding
the proposed skateboard park at Town Center Park.
REASONS:
The City issued and advertised Request for Proposals No. 09-10-01 for the design and
build services for a skateboard park located at Town Center Park. The bid was awarded
to West Construction, Inc. for the design and build of the skateboard park in an amount
not to exceed $250,000.
The City now desires to expand the scope of work under the original contract to include a
concession stand, canopy covers over the skateboard area as well as lighting. The
attached proposal outlines the cost associated for each new item. The entire proposal for
all the additional work is for an amount not to exceed $192,878.55, bringing the new
contract amount to $442,878.55. This resolution will give the City Manager the authority
to enter into an agreement with West Construction for all or any portion of the additional
work to the skateboard park.
FUNDING SOURCE:
Funding for this project comes from account #20-600-5621 and #10-900-5990.
