HomeMy WebLinkAboutOrdinance 2010-353 ORDINANCE NO. 2010-353 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 10-1 OF CHAPTER 10 OF THE CITY CODE RELATING TO BUDGET PROCEDURES; REQUIRING APPROVAL BY THE CITY COMMISISON FOR CURRENT YEAR PROPOSED OPERATING MILLAGE RA TE FOR TRIM NOTICE PURPOSES; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida law requires the City Commission to adopt a balance budget each year; and WHEREAS, Florida law further requires the City Commission to establish a proposed millage rate; and WHERAS, the City Commission wishes to approve by resolution the proposed millage rate recommended by the City Manager for TRIM notice purposes. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 10.1 of the City of Sunny Isles Beach Code of Ordinances is hereby amended to read as follows: S lO-l Amendments to Budget. A. Minor amendments. Transfers between line items or department accounts within departmental budget or decreases in line items or department accounts not amounting to more than 20% of the total budget of each department may be made by the City Manager by written statement describing the transfers and the reasons therefore. A copy of such statement shall be field with The City Clerk and delivered to the Mayor and each of the City Commissioners. A copy shall also be posted at a conspicuous place in City Hall. The transfers shall become effective l4 days after posting unless the Mayor or any member of the City Commission notifies the City Manager that he/she wishes the transfer to be placed upon the Agenda of the next City Commission meeting for consideration by the entire City Commission. All other budgetary transfers shall be approved by ordinance resolution of the City Commission; provided, however, up to 1 % of the contingency reserve fund may be transferred to any departmental budget by approval of a duly enacted resolution. C. TRIM Certification. Prior to the execution of the TRIM notice form commonly called DR -420. the City Manager or Finance Director shall request approval by Resolution the proposed operating millage rate for the fiscal year. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading. PASSED and ADOPTED on first reading the I~ day of~ 2010. RECOMMENDA TION: Staff recommends approval of the attached ordinance which requires the Commisssion's authorization of future proposed millages for the annual Truth In Millage (TRIM) Notices. REASONS: Annually, the City is required to return to the Miami-Dade Property Appraiser's Office a completed DR-420 form within 35 days of July 1st. This form is received by the City from the Property Appraiser's Office on July 1 st and includes the City's certified taxable property values for the prior calendar year and the current calendar year. Using this information, the City determines the proposed millage rate and submits this information on this form to the Property Appraiser's Office. The proposed millage rate is then advertised on the TRIM notices. Since the proposed millage rate is a significant factor in developing the annual budget and the proposed millage rate is used in the TRIM notices that are sent to the City's residents, Commission approval of the proposed millage rate is clearly desired.
