A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING
RESOLUTION NO. 15-Z-150 TO EXTEND THE TIME PERIOD
TO OBTAIN A BUILDING PERMIT BY TDR TOWERS MASTER
ASSOCIATION, INC. (THE "APPLICANT") FOR THE PROJECT
ENTITLED "TRUMP TOWERS I, II & III PARKING
EXTENSION" LOCATED AT 15811, 15901, AND 16001 COLLINS
AVENUE, IN ACCORDANCE WITH SECTION 265-11 (L) OF
THE CITY CODE; AUTHORIZING THE CITY MANAGER AND
THE CITY ATTORNEY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Applicant has requested an extension of time to pull a building permit in
accordance with Resolution No. 15-Z-150, adopted on February 19, 2015; and
WHEREAS, the Applicant's zoning approval is set to expire on February 19, 2017 and
the Applicant has stated good grounds for the extension request; and
WHEREAS, the City Commission wishes to approve the request for extension and
extends the zoning approval issued under Resolution No. 15-Z-150 to February 19, 2018.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA,AS FOLLOWS:
Section 1. Approval of Extension Request. Pursuant to Section 265-11(L) of the City Code,
the City Commission hereby approves the request for extension submitted by the Applicant, TDR
Towers Master Association, Inc. and extends the zoning approval issued under Resolution No.
15-Z-150 to February 19, 2018.
Section 2. Authority of the City Manager and City Attorney. The City Commission provides
the City Manager and City Attorney with the authority to do all things necessary to effectuate this
Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

Request for Extension of Resolution No. 15-Z-150
Parking Expansion Project (the "Project")
Dear Ms. Hasbun:
The undersigned law firm represents the interests of TDR Towers Master Association,
Inc. (hereinafter"Association"). This letter shall serve as the Association's request for extension
of time for an additional twelve (12) months to comply with the terms and conditions of
Resolution 15-Z-150 that was passed and adopted as of February 19, 2015 and issued
February 23, 2015. Pursuant to City of Sunny Isles Ordinance 265-11 N(3)we are requesting an
extension of time prior to the expiration of the twenty-four (24) month time period that was
provided. Please note that the Association has not applied for any permits due to the fact that it
has been in the process of evaluating the necessary construction financing for this anticipated
multi-million dollar project. Furthermore, the Association has been working diligently in
educating the unit owners on the project and obtaining study reports to ensure structural
soundness of the proposed additional parking levels before applying for any permits.
In summary, the Project consists of three existing condominium buildings with three
residential towers sharing a parking pedestal built on approximately 7.9 acres along Collins
Avenue. There are a total of 813 residential units within the property and it currently provides
1,050 parking spaces which are being serviced by full time valet personnel. The Project
proposes a design change and building modification for the construction of two (2) parking
decks above the existing parking decks, between the towers, in order to increase the total
parking count and parking garage square footage. The proposed Project design will increase
the total parking count to approximately 1,390 parking spaces (340 new spaces). The total
square footage of the Project is anticipated to be approximately 83,316 square feet. As you
may be aware, the garage as originally constructed, fail to provide enough parking spaces for
the residents, guests and invitees who reside and visit the property. Unfortunately, the
Association inherited an insufficient number of parking spaces from the Developer and was not
a party to or involved with the original project design and site approvals. During the construction

of the towers, the Developer entered into a buy down with the City and in exchange for a
contribution to Off-Street Parking the Developer was approved for the reduction of 20% (244) of
the required parking spaces. The loss of the previously mentioned parking spaces has had a
direct impact on the Association's ability to accommodate and meet parking needs.
Currently, the parking demand and need on the property is so great that the Association
has had to expend funds to rent additional parking spaces thereby requiring valet staff to cross
Collins Avenue for the retrieval of vehicles. The hardship, lack of parking spaces, which the
Association is currently experiencing, is not an economic hardship, but rather a logistic and
planning hardship as the current parking garage has poor use of existing space and the
Association is unable to accommodate its resident's vehicles. One way in which the Association
intends to logistically address the insufficient number of parking spaces is to install mechanical
parking lifts, as a component of the Project, which will provide additional parking spaces without
the need for a large amount of additional square footage.
The Association seeks the approval of this extension to prevent the Association and its
residents from a continuing undue hardship. The variances have already been approved which
will make the Association's goal of additional parking spaces possible. The variances will allow
the Association to increase the number of parking spaces available to its residents and will
improve the community by providing aesthetically pleasing landscaping along the Association's
portion of Collins Avenue and the beach. The Association believes that this Project and the
approved variances will enhance property values for its residents and the surrounding
community and will not negatively impact public safety or the general welfare.
The Association is hopeful that the City will find the foregoing request for extension to be
in the best interests of the residents of the Association and the surrounding community. On

RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
The TDR Towers Master Association, Inc. (Applicant) is requesting an
extension of time to pull a building permit in accordance with Resolution
No. 15-Z-150, adopted on February 19th, 2015. The Applicant's zoning
approval is set to expire on February 19th, 2017 and the Applicant has
stated good grounds for the extension request. The request is for one
additional year from the original zoning approval expiration date.
