Home My WebLink AboutReso 2010-1645 RESOLUTION NO. 2010-MS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA APPROVING AN AGREEMENT TO RET AIN THE SERVICES OF THE LAW FIRMS OF STEARNS WEAVER MILLER WEISSLER ALHADEFF & SITTERS ON, PA., TO REPRESENT THE CITY IN LEGAL MATTERS PERTAINING TO THE NEGOTIATIONS OF A COLLECTIVE BARGAINING AGREEMENT; AUTHORIZING THE CITY ATTORNEY TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Attorney wishes to retain the services of the law firm of Stearns Weaver Miller Weissler Alhadeff & Sitterson, P.A. to provide legal services in connection with the negotiations; and WHEREAS, the law Firm of Stearns Weaver Miller Weissler Alhadeff & Sitterson, P.A. is highly qualified to represent the City as special counsel and have agreed to provide discount rates to the City; and WHEREAS, the City Attorney desires to enter into an agreement to retain the services of Stearns Weaver Miller Weissler Alhadeff & Sitterson, P.A. attached hereto as Exhibit "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of the Agreement. The City Commission hereby approves the retainer agreements for of Stearns Weaver Miller Weissler Alhadeff & Sitterson, P.A. as special Counsel at an hourly rate not to exceed One Hundred Seventy Dollars ($170.00) per hour. Section 2. Authorization of the City Attorney. The City Attorney is hereby authorized to do all things necessary to effectuate this agreement. Section 3. Effective Date. At the initiation of cHch new matter, it is the policy of this firm to expressly agree upon a fee arrangcmcn1 f(j, the work to be undertaken in such matter. In this matter, our fee for legal scrvic(~s will bt~ calculated at the hourly ratc of $170 for attorneys and $125 for legal assistants. We estimate that the overall budget for this project should be $75,000, but the actual expenditures f()T fees and costs will depend on the difficulty and length of the negotiation and ratiiication process. These standard hourly rates arc subject to change from time to time. Invoices will be prepared and sent to you on a monthly basis. [n addition, you will be billed monthly f()[ the costs incurred in connection with our rcpre:~c;itatien, Costs g(:ncrally include serving and filing fees, express delivery services, travel expemes, copying expens{~s, long distance telephone expenses, etc. Costs also include any m~cessary fces for court reporters, appraisers, escrow agents, expert witnesses, accountants, abstractors, surveyors, and other such services. Other than f()r the items indicated, we will not incur mw unusual (:08t Items without first consulting with you. All mvoiccs are due and payable upon receipt. Intcrest will be charged on any past due balances not paid within 30 days at the rate of 12% per annum. REASONS: On August 27, 2010, the Public Employees Relations Commission certified the Dade County Police Benevolent Association ("PBA") as the exclusive bargaining representative for the City of Sunny Isles Beach Police Officers. Consequently, the City intends to engage in collective bargaining negotiations with the PBA. I have determined that the City is in need of hiring additional counsel to represent the City in negotiations with the PBA regarding the collective bargaining process. As such, I have retained the law firm of Stearns Weaver Miller Weissler Alhadeff & Sitterson, P.A. The law firm of Stearns Weaver Miller Weissler Alhadeff & Sitterson, P.A. has agreed to act as co-counsel in connection with certain legal matters related to the collective bargaining process.
