Notice is hereby given that the City of Sunny Isles Beach is extending an Invitation
to Bid for the purchase and installation of white aluminum fencing, one manual
gate, one automatic gate and an electronic code - controlled keypad system.
Sealed bids will be received at Sunny Isles Beach City Hall, 17070 Collins
Avenue, Suite 250, Sunny Isles Beach, FL 33160, until 10:00 a.m., Friday, January
24, 2003, at which time they will be publicly opened and read in the Commission
Chambers. The envelope containing the sealed bid must be clearly marked
"SEALED BID"

Bids will not be accepted after 10:00 a.m., local time on January 24, 2003, under
any circumstances.
Specifications, instructions and bid forms are available from the Office of the City
Clerk, 17070 Collins Avenue, Suite 250, Sunny Isles Beach, Florida, or by calling
(305) 947 -0606. There is no charge for the bid package.
No bidder may withdraw his /her bid for a period of sixty (60) days following the
date of opening of these bids. Firms submitting responses may be requested to
make oral presentations as part of the evaluation process.
The City reserves the right to accept or reject any or all bids and may waive any
informality in any or all bids.

INVITATION TO BID NO. 02 -12 -01
FOR THE PURCHASE AND INSTALLATION OF WHITE ALUMINUM FENCING,
ONE MANUAL GATE, ONE AUTOMATIC GATE AND AN ELECTRONIC CODE -
CONTROLLED KEYPAD SYSTEM
Purpose. The purpose of this Invitation to Bid is to seek qualified aluminum fence
vendors /contractors.
1.1 Procedure. Submit ten (10) sets of the complete bid by the closing date and time.
1.2. No reimbursement will be made by the City of Sunny Isles Beach for any costs incurred
in appropriation of the bid or any presentation(s).
1.3. Property of City. All bids and accompanying documentation received from bidders in
response to this Bid shall become the property of the City and will not be returned to the
bidders. In the event of contract award, all documentation and work product produced
as part of the contract shall become the exclusive property of the City. This subsection
is applicable to Requests for Bids and Requests for Letters of Interest documents, which
also become property of the City.
1.4. By submission of a response hereunder, the bidder becomes responsible to comply with
the terms and conditions of the Purchasing Procedures Ordinance of the City as may be
amended from time to time. To the extent of any conflict, the terms of this document
control.
2. Background. The City of Sunny Isles Beach is estimated to have 15,000 residents. The City
of Sunny Isles Beach is located between the Atlantic Ocean and the Intracoastal Waterway on
the East and West and 193`d Street on the North and Haulover Beach Park on the South. Our
City standards stress a high quality of redevelopment with a focus on creating visual corridors
to the ocean, with access to the ocean as well as redevelopment of Sunny Isles Boulevard and
Collins Avenue with a focus on protecting the environment, providing landscaping and
developing aesthetically attractive structures. The City of Sunny Isles Beach has adopted by
Ordinance No. 2000 -105 a Comprehensive Plan emphasizing aesthetic issues and the City is in
the process of developing our land development regulations. The City is constructing a new
Tony Roma's Restaurant and City Hall adjacent to the location of the fence installation. This
project is part of the aesthetic improvements related to the City Hall project.
2.1 The City is seeking bids for fabrication and installation of a white, aluminum picket
fence and gates with an altitude of six feet. Most of the materials for fabrication of this
fence are aluminum materials, with the exception being the stainless steel screws used
to secure the fence's sections to the anchor posts. Everything must be rust proof.

2.2. Alternatives — There are two alternatives on which to bid, with respect to this project, as
shown on the attached plans.
Alternative 1: For the fabrication and installation of 300 lineal feet of white Aluminum
Picket Fence of which 261' are lineal at 6 feet high and 30' long are at 16 inches of
height and two adjacent rolling gates, an electronic code - controlled keypad system and a
personal entry gate, all with specifications given in this bid for this particular job (see
attached sketch).
Alternative 2: For the fabrication and installation of 700 lineal feet of white Aluminum
Picket Fence of which 600' are lineal at 6 feet high and 100' long at 16 inches of height
and two adjacent rolling gates, an electronic code - controlled keypad system and a
personal entry gate, all with specifications given in this bid for this particular job (see
attached sketch).
2.3 A) Scope.
i. Pickets are 1" x 1" aluminum tubes. An aluminum decorative cap is to be
welded on each one of the pickets.
ii. Top and Bottom 2" x 1" punched thru horizontal channels.
iii. Anchor posts are to be 3" x 3" every six lineal feet apart and 2 ' /2' deep into
the concrete footing.
iv. Two adjacent rolling gates will be installed on the Atlantic Boulevard
(west -side) ten feet inside the property line marked by the existing CBS
wall.
V. One of these twelve feet wide rolling gates will control all incoming traffic
by an electronic code - controlled keypad installed on the Atlantic
Boulevard side entrance.
vi. All vehicles exiting the parking lot will trigger a one free exit photocell.
vii. Another six feet high by four feet long personal entry gate will be installed
on the east side of the property and entry will be regulated by another
computerized access control key pad.
viii. In addition, 30" lineal feet of aluminum picket fence 16" high will be
installed on top of the CBS wall or in the case of alternative #2, one
hundred nine lineal feet of the same fence.
ix. Consequently, all electrical work is to be included in this bid as well as the
removal of the chain link fence and the building of two concrete slabs for
the rolling gates.
B) Execution
Examination
a. Verify areas to receive fencing are completed to final grades and
elevations.
b. Ensure property lines and legal boundaries of work are clearly
established.

C) Installation
i. Fence
a. Install fence in accordance with manufacturer's instructions.
ii. Gate Installation
a. Install gates plumb, level and secure for full opening without
interference.
b. Attach hardware by means that will prevent unauthorized removal.
c. Adjust hardware for smooth operation.
iii. Gate Frame
a. Install gateposts in accordance with manufacturer's instructions.
D) Cleaning
i. Clean up debris and unused material, and remove from site.
3. Qualification. Bidder must demonstrate expertise in design in the following areas.
(Describe evidence of qualifications, as the City deems necessary and desirable and provide
references, past experience and years in business.)
4. Bid.
4.1 Each bid submitted must have clearly marked on the face of the envelope the following
information:

4.2 Mail (or deliver) an original bid with authorized original signatures (faxed bids will be
rejected) to:

4.3 All Bids shall be submitted on the Bid Form and shall include all requested
documentation, including photos and detailed specifications of all equipment, Warranty
documents and completed Public Entity Crime Form.
4.4 The bids shall contain two separate sections. The first section should address and be
limited to the contractor's qualifications. The second section should address the specific
work proposed by the contractor.
4.5 The City reserves the right to accept or reject any or all bids received.
4.6 Bids shall be publicly opened at, and no bid received later than, 10:00 a.m., Friday,
January 24, 2003.

4.7 Any additional information can be obtained by calling the City Manager at (305) 947-
0606.
4.8 The City of Sunny Isles Beach is tax exempt (Certificate #23 -00- 477131 -54C).
4.9 Describe work in phases.
4.10 Cancellation of Invitations for Bids or Requests for Bids. An Invitation to Bid may be
cancelled or rejected in whole, or in part, as may be specified in the solicitation, within
the City's sole discretion. The reasons therefore shall be made part of the contract file.
Each solicitation issued by the City shall state that the solicitation may be cancelled and
that any qualifier may be rejected, in whole or in part, within the sole discretion of the
City. Notice of cancellation shall be sent to all businesses solicited. The City shall give
any bidder the opportunity to compete on any re- solicitation or any future procurement
of similar items.
4.11 Correction or Withdrawal of Bids; Cancellation of Awards. In general, bids shall be
unconditionally accepted without alteration or correction, except as authorized in this
Ordinance. However, correction or withdrawal of inadvertently erroneous bids before
or after bid opening, or cancellation of awards or contracts based on such bid mistakes,
may be permitted, where appropriate. Mistakes discovered before bid opening may be
modified, or the bid may be withdrawn by written or telegraphic notice received in the
office designated in the Invitation for Bids prior to time set for bid opening. After bid
opening, no changes in bid prices or other provisions of bids, prejudicial to the interest
of the City, or fair competition, shall be permitted. In lieu of bid correction, a low
bidder alleging a material mistake of fact may be permitted to withdraw its bid if:
(1) The mistake is clearly evident on the face of the bid document but the
intended correct bid is not similarly evident; or
(2) The qualifier submits evidence, which clearly and convincingly
demonstrates that a mistake was made. All decisions to permit the
correction or withdrawal of qualification, or to cancel awards or contracts
based on bid mistakes, shall be supported by a written determination made
by the City.
(3) Notwithstanding the foregoing, the City Commission shall have the
authority to waive certain formalities, or in the alternative, reject any bids.
5. Critical Issues. Describe any particular critical issues relating to timeliness or emphasis on
particular problem areas, etc.
6. Inspection of Facilities. It is the bidder's responsibility to become fully informed as to where
items are to be installed and/or the nature and extent of the work required and its relation to any
other work in the area, including possible interference from other site activities. Failure to
visually inspect the facilities may be cause for disqualification of your bid. After the bid has
been awarded, no additional compensation will be made as a result of differences between
actual labor and materials required to complete the project and the Bidder's estimate prior to bid
award.

7. Submittals. Include the following in your bid:
7.1 Cover sheet of this Invitation to Bid.
7.2 An informative, narrative report introducing your firm and location of the office that
will be responsible for the project.
7.3 A Statement of Qualifications.
7.4 A resume detailing experience and recommendations from prior jobs, if any.
7.5 Copies of the firm's professional licensures, if applicable.
7.6 Any other forms that are required by the City and sample of similar work performed by
the firm.
7.7 Specification of how the final project will be submitted to the City, i.e., pad, GIF, disk,
etc.
8. Peformance. The bidder, upon award of any contract shall ensure that all items supplied
and /or work performed, comply with federal, state and local laws rules and regulations as well
as the terms of the contract.
9. Process. Bidder, upon award of the contract shall be responsible for management and
organization of all public hearings and meetings with City officials, citizens' and business
groups or other organizations as applicable. Any and all meetings and all costs associated with
responding to this process will be at bidder's expense with no additional cost to the City.
9.1 Responsible, Responsive Bidder. The City reserves the right to award any contract to
any bidder which it deems to offer the best overall service and be the most responsible
responsive bidder thereby the City is not bound to award any contract based solely on
the lowest quoted price and no contract is created until it is signed with the approval of
the City Commission. The City, in its sole and absolute discretion, also reserves the
right to negotiate separately with competing firms as it deems to be in the best interest
of the City and as permitted by law.
9.2 Negotiation. In the event the lowest, most responsive and responsible bidder for a
project exceeds available funds, and the City Commission does not make available
additional funds, the City Manager is authorized, when time or economic considerations
preclude re- solicitation of qualifiers, to negotiate an adjustment of the qualifying price
as long as the scope of work is not changed with the lowest, most responsive and
responsible qualifier, in order to bring the qualification within the amount of available
funds. Final negotiation shall be in written form, as approved by the City Manager and
the City Attorney.
9.3 One Response. If only one responsive bid for commodity or contractual service is
received, in response to an Invitation for Bid an award may be made to the single
Bidder, if the City Manager finds the price submitted is fair and reasonable, and that
other prospective bidders had reasonable opportunity to respond, or there is not

adequate time for re- solicitation. Further, the City Manager reserves the right, if it is in
the best interests of the City, to negotiate with the sole Bidder for the best terms,
conditions and price. The City Manager shall document the reasons that such action is
in the best interest of the City. Otherwise, the qualification may be rejected and:
New bidders solicited;
2. The sole bidder may be rejected.
3. If the City Manager determines in writing that the need for the supply or service
continues, but that the price of the one Bidder is unreasonable and there is not
time for re- solicitation or re- solicitation would likely be futile, the procurement
may then be conducted under Section 6(D) or Section 6(F), of Ordinance 2001-
101, as appropriate.
10. Taxes. The Bidder is responsible for paying any and all taxes associated with the agreement.
11. Termination of Agreement. If the successful bidder fails to perform the conditions of the
agreement as specified and as interpreted by the Manager, the Manager shall provide written
notice of such violation.
11.1 The City reserves the right to terminate the agreement, without cause, with a 30 -day
calendar written notice unless otherwise provided in the contract.
11.2 Termination and cancellation of any agreement will not relieve the bidder for work rest
that was to be completed prior to the termination or cancellation of the agreement.
11.3 If the agreement is terminated for cause, bidder will be removed from the City's vendor
list.
11.4 The City Commission shall have the right to terminate the agreement in the event the
bidder files any petition or proceeding for bankruptcy relief or is adjudicated to be
bankrupt or insolvent or fails to pay just debts as they ordinarily become due.
11.5 The bidder may not terminate this agreement unless otherwise provided in the contract.
12. Insurance Requirements.
12.1 General. The bidder, including service- related bidders, shall purchase and maintain for
the entire life of the Project, including any and all approved time extensions, until its
final acceptance by the City, such insurance as will protect the bidder from claims under
Workers' Compensation, disability benefit laws or other similar employee benefit laws;
from claims for damages because of bodily injury, occupational sickness or disease, or
death of bidder employees; from claims insured by usual or unusual injury liability
coverage; from claims or injury to or destruction of tangible property and from claims
insured by usual Commercial General Liability coverage including broad form
contractual liability coverage for bodily injury and property damage liability. This includes
loss of use resulting therefrom, any or all of which may arise out of the bidder's
operations under the Contract Documents, whether such operations be by the bidder, or

any sub contractor, or by anyone directly or indirectly employed by any of them or for
whose acts any of them may be legally liable. The bidder's deductibles /self - insured
retentions shall be disclosed to the City and may be disapproved by the City and may be
reduced or eliminated at the sole discretion of the City. The bidder is responsible for
the amount of any deductible or self - insured retention.
Coverage shall be the following amounts: Workers' Compensation $100,000.00;
Commercial General Liability $1,000,000.00 per occurrence, Combined Single Limits
(CSL); and Business Automobile Liability $500,000.00, per occurrence, CSL.
Such insurance shall not diminish Bidder's indemnification obligations hereunder. The
insurance policy shall be issued by such company, in such forms and with such limits of
liability and deductibles as are acceptable to the City and shall be endorsed to be primary
over any insurance, which the City may maintain. Before any work under this Agreement is
performed, and at any time upon request, Bidder shall furnish to the City certificates of
insurance evidencing the minimum required coverage and appropriately endorsed for
contractual liability with the City named as an additional insured. All policies shall contain
a waiver of subrogation endorsement. All policies and certificates shall be in forms and
issued by insurance companies acceptable to the City's Risk Management Department. All
insurance policies and certificates of insurance shall provide that the policies may not be
canceled or altered without thirty (30) calendar day's prior written notice to the City's Risk
Management Department. The City reserves the right from time to time to change the
insurance coverage and limits of liability required to be maintained by Bidder hereunder.
12.2 Requirements for Certificates of Insurance. Bidder shall provide the City with all
required Certificates of Insurance, which Certificates must be acceptable to the City.
Each Certificate of Insurance shall be provided to the City at least 15 days prior to
coverage renewals requested by the City. The bidder shall furnish complete copies of
bidder's insurance policies, forms and endorsements. If the bidder fails to obtain and
maintain for the life of the contract insurance required herby or to replace any such
expired or cancelled policies, the City may obtain and maintain such insurance with
such company as it deems satisfactory with those amounts expended by the City in
payment of premiums to be deducted by the City from the amounts due the bidder for
work covered by the contract.
13. Hold Harmless.
13.1 The City, its agents, employees and officials, both elected and appointed shall be held
harmless against all claims for bodily injury, sickness, disease, death or personal injury
or damage to property or loss of use resulting therefrom arising out of performance of
the agreement or contract, unless such claims are a result of the City's sole negligence,
as determined by the final arbiter of such claim.
13.2 The City, its agents, employees and official, both elected and appointed shall also be
held harmless against all claims for financial loss with respect to the provision of or
failure to provide professional or other services resulting in professional, malpractice, or
errors and omissions liability arising out of performance of the agreement or contract,
unless such claims are a result of the City's sole negligence, as determined by the final
arbiter of such claim.

14. Payment on Behalf of the City.
14.1 Bidder agrees to pay on behalf of the City, and to pay the cost of the City's legal
defense, as may be selected by the City, for all claims described in the Hold Harmless
paragraph 13 above, up through and including, all appellate levels.
14.2 Such payment on behalf of the City shall be, in addition to any and all other legal
remedies available to the City, and shall not be considered to be the City's exclusive
remedy.
15. Any questions or clarifications concerning this Invitation to Bid shall be submitted in writing
by mail or facsimile to the City manager, 17070 Collins Avenue, Suite 250, Sunny Isles Beach,
Florida 33160. Fax (305) 949 -3113. The bids title /number shall be referenced on all
correspondence. All questions must be received no later than fifteen (15) calendar days prior to
the scheduled bid opening date. All responses to questions /clarifications will be sent to all
prospective bidders in the form of an addendum. NO QUESTIONS WILL BE RECEIVED
AFTER THE DEADLINE.
The City of Sunny Isles Beach reserves the right to accept any bid or bid deemed to be in the
best interest of the City of Sunny Isles Beach, or waive any informality in any bid or bid. The
City of Sunny Isles beach may reject any and all bids or bids.
16. Public Entity Crimes. Section 287.133, Florida Statues, provides that a person or affiliate, as
defined in that Section, who has been placed on the convicted vendor list following the
conviction for a public entity crime may not submit a bid on a contract to provide any goods or
services to a public entity may not submit a bid on a contract with a public entity for any
contract for construction or repair of a public building or a public work, may not submit bids
on leases of real property to a public entity, may not be awarded to perform work as a
contractor, supplier, subcontractor, or consultant under a contract with any public entity, and
may not transact business with any public entity in excess of the threshold of the amount
provided in Section 287.017 for CATEGORY TWO ($25,000) for a period of 36 months from
the date of being placed on the convicted vendor list. Any such person or affiliate convicted of
a public entity crime shall provide written notice of such conviction.
