HomeMy WebLinkAboutReso 2016-2631 RESOLUTION NO. 2016- 2431 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE AGREEMENT WITH MIAMI CHRISTMAS LIGHTS TO INSTALL HOLIDAY LIGHTS AND DECORATIONS AT HERITAGE PARK AND OTHER RELATED SERVICES, IN`A TOTAL AMOUNT NOT TO EXCEED ONE HUNDRED NINETY- FIVE THOUSAND DOLLARS ($195,000.00) FOR A DURATION • OF THREE (3) YEARS, ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City wishes to employ Miami Christmas Lights, a qualified seasonal decor firm, to install holiday lights and decorations at Heritage Park as well as other services; and WHEREAS, Miami Christmas Lights is qualified, willing and able to provide the desired services on the terms and conditions set forth herein; and WHEREAS, the City desires to enter into an Agreement with Miami Christmas Lights to provide the Services Sixty Thousand Dollars ($60,000.00) for Fiscal Year 2016/2017, Sixty-Five , Thousand Dollars ($65,000.00) for Fiscal Year 2017-2018, and Seventy Thousand Dollars ($70,000.00) for Fiscal Year 2018-2019 bringing the total contract amount not to exceed to One Hundred Ninety-Five Thousand Dollars ($195,000.00); and WHEREAS, the City Commission wishes to approve the Agreement with Miami Christmas Lights to install holiday lights and decorations at Heritage Park as well as other ' services, in a total amount not to exceed One Hundred Ninety-Five Thousand Dollars ($195,000.00), attached hereto as Exhibit"A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratify the Agreement. The City Commission hereby ratifies the Agreement with Miami Christmas Lights to install holiday lights and decorations at Heritage Park as well as other services, in a total amount not to exceed One Hundred Ninety-Five Thousand Dollars ($195,000.00) for a duration of three (3) years, attached hereto as Exhibit "A". Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. C5607-1617-012 THIS CONTRACTUAL AGREEMENT (hereinafter referred to as the "Agreement") is made in duplicate, this 10 day of November, 2016, by and between the CITY OF SUNNY ISLES BEACH, Florida, (hereinafter referred to as "City"), and MIAMI CHRISTMAS LIGHTS, a corporation authorized to do business in the State of Florida (hereinafter referred to as "Contractor") whose Federal I.D. # is - . The City and Contractor hereby agree as follows: RECITALS WHEREAS, Contractor is a qualified seasonal decor firm; and WHEREAS, the City wishes to employ Contractor to install holiday lights and decorations at Heritage Park as well as other tasks ("Services") as more specifically described in Attachment "A," attached hereto and made a part hereof; and WHEREAS, the Contractor is qualified, willing and able to provide the desired Services on the terms and conditions set forth herein; and WHEREAS, the City desires to enter into an Agreement with Contractor to provide the Services in a total contract amount not to exceed One Hundred Ninety Five Thousand Dollars ($195,000.00) for the duration of the term, as more particularly described in attached Attachment NOW THEREFORE, in consideration of the premises and the mutual covenants herein name, the parties agree as follows: 1. RECITALS. The Recitals set forth above are hereby incorporated into this Agreement and made a part of hereof for reference. 2. SERVICES. Contractor shall install, and maintain holiday decorations at Heritage Park by December 2, 2016, for Fiscal Year 2016-2017, November 27, 2017 for Fiscal Year 2017- 2018, and November 26, 2018 for Fiscal Year 2018-2019, and remove the holiday decorations no later than January 31, 2017 for Fiscal Year 2016-2017, January 31, 2018 for Fiscal Year 2017-2018, and January 31, 2019 for Fiscal Year 2018-2019, and perform all other Services, as provided in Attachment "A", which is attached hereto and incorporated herein by reference. The Services shall be performed by Contractor to the full satisfaction of the City. 3. TERM. This Agreement shall commence upon the execution of this Agreement and shall terminate no later than January 31, 2019 ("Term"). The City agrees to pay the Contractor a total amount not to exceed Sixty Thousand Dollars (560,000.00) for Fiscal Year 2016-2017, Sixty Five Thousand Dollars (565,000.00) for Fiscal Year 2017-2018, and Seventy Thousand Dollars ($70,000.00) for Fiscal Year 2018-2019, bringing the total contract amount not to exceed One Hundred Ninety Five Thousand Dollars (5195,000.00) to perform the Services, as more particularly described in Attachment "A". The actual amount paid by the City to Contractor during any Fiscal Year shall be based on invoiced orders made for Fiscal Year 2016-2017, Fiscal Year 2017-2018, and/or Fiscal Year 2018-2019. Prices shall remained fixed for the entirety of the term of this Agreement. Payment to Contractor for all charges and tasks under this Agreement shall be in accordance with this Agreement and the schedule of charges reflected in Attachment "A", which fee shall be disbursed on a monthly basis and under the following conditions: a. Disbursements. There are no reimbursable expenses associated with this contract. b. Payment Schedule. Invoices received from the Contractor pursuant to this Agreement will be reviewed by the initiating City Department. If Services have been rendered in conformity with the Agreement, the invoice will be sent to the Finance Department for payment. Invoices must reference the contract number assigned hereto. Invoices will be paid in accordance with the State of Florida Prompt Payment Act. c. Availability of Funds. The City's performance and obligation to pay under this Agreement is contingent upon an annual appropriation for its purpose by the City Commission. d. Final Invoice. In order for both parties herein to close their books and records, the Contractor will clearly state "final invoice" on the Contractor's final/last billing to the City. This certifies that all services have been properly performed and all charges and costs have been invoiced to the City. Since this account will thereupon be closed, any other additional charges, if not properly included on this final invoice, are waived by the Contractor. Contractor shall make no other charges to the City for supplies, labor, taxes, licenses, permits, overhead or any other expenses or costs unless any such expense or cost is incurred by Contractor with the prior written approval of the City. If the City disputes any charges on the invoices, it may make payment of the uncontested amounts and withhold payment on the contested amounts until they are resolved by agreement with Contractor. Contractor shall not pledge the City's credit or make it a guarantor of payment or surety for any contract, debt, obligation, judgment, lien, or any form of indebtedness. The Contractor further warrants and represents that it has no obligation or indebtedness that would impair its ability to fulfill the terms of this Agreement. 5. LIQUIDATED DAMAGES. Time is of the essence in this Agreement. Notwithstanding any other Section in this Agreement, in the event the Contractor fails to install the holiday lights and decorations at Heritage Park by December 2, 2016, for Fiscal Year 2016- 2017,November 27, 2017 for Fiscal Year 2017-2018, and/or November 26, 2018 for Fiscal Year SIB C5607-1617-012—Miami Christmas Lights Page 2 of 10 City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 (305)947-0606 phone(305)949-3113 Fax 2018-2019, and in the absence of any extended calendar days extension granted by the City Manager or his designee, the Contractor shall be required to return the 50% deposit paid by the City as liquidated damages to the City, such amount being the actual cash value agreed upon as the loss to City resulting from Contractor's delay in not having the holiday lights and decorations at Heritage Park by the designated dates. The deposit amounts paid for each Fiscal Year will be 50% of the total amount owed to the Contractor as invoiced for Fiscal Year 2016-2017, Fiscal Year 2017-2018, and/or Fiscal Year 2018-2019. Additionally, in such an event, the Contractor shall be required to indemnify the City for all costs incurred by the City to re-procure and hire a third party to complete the Services described in this Agreement, and Contractor shall assume complete financial responsibility for any costs the City may incur as a result of the Contractor's failure to install the holiday lights and decorations at Heritage Park by the designated dates. 6. INDEPENDENT CONTRACTOR RELATIONSHIP. The Contractor is an independent contractor and shall be treated as such for all purposes. Nothing contained in this Agreement or any action of the parties shall be construed to constitute or to render the Contractor an employee, partner, agent, shareholder, officer or in any other capacity other than as an independent Contractor other than those obligations which have been or shall have been undertaken by the City. Contractor shall be responsible for any and all of its own expenses in performing its duties as contemplated under this Agreement. The City shall not be responsible for any expense incurred by the Contractor. The City shall have no duty to withhold any Federal income taxes or pay Social Security services and that such obligations shall be that of the Contractor, other than those set forth in this Agreement. Contractor shall furnish its own transportation, office and other supplies as it determines necessary in carrying out its duties under this Agreement. 7. OWNERSHIP OF DOCUMENTS AND EQUIPMENT. All documents prepared by the Contractor pursuant to this Agreement and related Services to this Agreement are intended and represented for the ownership of the City only. Any other use by Contractor or other parties shall be approved in writing by the City. If requested, Contractor shall deliver the documents to the City within fifteen (15) calendar days. 8. INSURANCE. Contractor shall, at its sole cost and expense, during the period of any work being performed under this Agreement, procure and maintain the following minimum insurance coverage to protect the City and Contractor against all loss, claims, damage and liabilities caused by Contractor, its agents or employees, as indicated below: ❑ Comprehensive General liability insurance, including broad form contractual liability coverage for all operations, including, but not limited to, contractual, products, and completed operations, personal injury and property damage liability with minimum limits of One Million Dollars ($1,000,000) per occurrence. ❑ Worker's Compensation and employer's liability coverage, as required pursuant to Florida law. Insurance required of the Contractor shall be primary to, and not contribute with, any insurance or self-insurance maintained by the City. Such insurance shall not diminish Contractor's indemnification and obligations hereunder. The insurance policy shall be issued by companies authorized to do business under the laws of the State of Florida and acceptable to the City with a minimum A.M. Best rating of A-Excellent. Before any work under this Agreement is performed, and at any time upon request, Contractor shall furnish to the City certificates of insurance evidencing the minimum required coverage and shall be appropriately endorsed for contractual liability, with the City named as additional insured. All policies shall contain a waiver of subrogation endorsement. All policies and certificates shall be in forms and issued by insurance companies acceptable to the City Manager or his designee. All insurance policies and certificates of insurance shall provide that the policies may not be canceled or altered without thirty (30) days prior written notice to the City. The City reserves the right from time to time to change the insurance coverage and limits of liability required to be maintained by Contractor hereunder. Contractor shall also require and ensure that each of its sub-contractors providing services hereunder (if any) procures and maintains, until the completion of the services, insurance of the types and to the limits specified herein. ANY EXCEPTIONS TO THE INSURANCE REQUIREMENTS IN THIS SECTION MUST BE APPROVED IN WRITING BY THE CITY. 9. TERMINATION AND REMEDIES FOR BREACH. A. If, through any cause within reasonable control, the Contractor shall fail to fulfill in a timely manner or otherwise violate any of the covenants, agreements or stipulations material to this Agreement, the City shall have the right to terminate the Services then remaining to be performed. Prior to the exercise of its option to terminate for cause, the City shall notify the Contractor of its violation of the particular terms of the Agreement and grant Contractor ten (10) days to cure such default. If the default remains uncured after ten (10) days the City may terminate this Agreement, and the City shall receive a refund from the Contractor in an amount equal to the actual cost of a third party to cure such failure. If Contractor fails, refuses or is unable to perform any term of this Agreement, City shall pay for services rendered as of the date of termination. (i.) In the event of termination, all finished and unfinished documents, data and other work product prepared by Contractor shall be delivered to the City and the City shall compensate the Contractor for all Services satisfactorily performed prior to the date of termination, as provided in Paragraph 4 herein. Under no circumstances will City be responsible for the remaining unexpired portion of the term(s), regardless of whether termination is with or without cause. The City shall not be responsible for any indirect, special, consequential, or incidental damages. Notwithstanding the foregoing, the Contractor shall not be relieved of liability to the City for damages sustained by it by virtue of a breach of the Agreement by Contractor and the City may reasonably withhold payment to Contractor for the purposes of set-off until such time as the exact amount of damages due the City from the Contractor is determined. B. Termination for Convenience of City. The City may, for its convenience and without cause terminate the Services then remaining to be performed at any time by giving Contractor ten (10) days written notice. The terms of Paragraph 10 A(i) and A(ii) above shall be applicable hereunder. C. Termination for Insolvency. The City also reserves the right to terminate the remaining Services to be performed in the event the Contractor is placed either in voluntary or involuntary bankruptcy or makes any assignment for the benefit of creditors. 10. DEFECTS IN WORKMANSHIP AND INSTALLATION. Contractor warrants that it will promptly correct any defects related to the performance of its Services under this Agreement. The Contractor's obligations shall include, but not be limited to, repairing or replacing the defective workmanship and/or installation of holiday lights and decorations at Heritage Park. In such an event, the City shall provide Contractor with written notice thereof specifying the defect, and Contractor shall have no later than 24 (twenty four) hours to correct the defect. In the event Contractor fails to correct the defect within this 24 hour period after being notified by the City, and in the absence of any extended calendar days extension granted by the City Manager or his designee, then the Contractor shall be required to pay a liquidated damage penalty of$100.00 (One Hundred Dollars) for each calendar day beyond the 24 (twenty four) hours deadline, continuing to the time at which the defects are corrected. Such amount is the actual cash value agreed upon as the loss to City resulting from Contractor's delay. 11. ASSIGNMENTS, TRANSFERS, SUBCONTRACTING. The Contractor shall not subcontract, assign or transfer any work under this Agreement without the express, prior written consent of the City. Should the Contractor subcontract any Services under this Agreement, it shall be done with continued liability for the Contractor. The Contractor shall remain responsible for Services, responsibilities and liabilities of any person or entity acting under Contractor. 12. TIME OF COMPLETION AND WITHHOLDING OF FINAL PAYMENT. The Services to be rendered by the Contractor shall be commenced upon execution of this Agreement and shall be completed no later December 2, 2016, for Fiscal Year 2016-2017; December 1, 2017 for Fiscal Year 2017-2018; and November 30, 2018 for Fiscal Year 2018-2019, and shall be removed no later than January 31, 2017 for Fiscal Year 2016-2017; January 31, 2018 for Fiscal Year 2017-2018; and January 31, 2019 for Fiscal Year 2018-2019, as more particularly described in Attachment "A", attached hereto. A reasonable extension of time shall be granted in the event the work of the Contractor is delayed or prevented by the City or by circumstances beyond the reasonable control of the Contractor including weather conditions or acts of God, which render the performance of the Contractor's duty impracticable. AUTHORITY TO PRACTICE. Contractor hereby represents and warrants that it has and will continue to maintain all licenses and approvals required conducting its business and that it will at all times conduct its business activities in a reputable manner. Proof of such licenses and approvals shall be submitted to the City prior to commencement of work under this Agreement. 14. MODIFICATIONS OF WORK. The City reserves the right to make changes in.the work, including alterations, reductions or additions thereto. Upon receipt of the City's notification of a contemplated change, the Contractor shall (1) if requested by the City, provide an estimate for the increase or decrease in cost due to the contemplated change, (2) notify the City of any estimated change in completion date, and (3) advise the City in writing if the contemplated change shall affect the Contractor's ability to meet the completion dates or schedules of this Agreement. 15. COORDINATION OF SERVICES. The City's representative/liaison during the performance of this Agreement shall be Susan Simpson, telephone number 305/792-1706. Contractor shall not respond to requests for Services under this Agreement unless the request is received directly from Susan Simpson or Christopher J. Russo, City Manager, or his designated personnel. Any requests received from other City departments/divisions shall be referred to the City Manager's Department representative designated above. Services performed without authorization shall be considered unauthorized and shall not be compensated/paid by the City. 16. CONFIDENTIAL INFORMATION. The Contractor shall not, either during the term of this Agreement or any time for a period of ten (10) years subsequent to that date upon which the Contractor shall leave the employment of the City for any reason whatsoever, disclose to any person or entity, other than in the discharge of the duties of the Contractor under this Agreement, any information which the City designates in writing as "confidential." As a violation by the Contractor of the provisions of this Section could cause irreparable injury to the City and there is no adequate remedy at law for such violation, the City shall have the right, in addition to any other remedies available to it at law or in equity, to enjoin the Contractor in a court of equity for violating such provisions. 17. BACKGROUND CHECKS. A criminal background check will be required for any employee of the Contractor performing Services under this Agreement. The Contractor shall be required to perform the criminal background check at their own sole cost and expense through the City. The Contractor shall ensure that only their properly designated employees listed with the City Manager be permitted to perform Services. In the event the designated employees are removed by the Contractor, the Contractor shall immediately notify the City Manager or his designee. Additionally, identification cards will be provided by the City at the Contractor's sole cost and expense. Contractor shall ensure that all designated employees wear the City's provided identification cards while performing Services. All notices and other communications required or permitted to be given under this Agreement by either party to the other shall be in writing and shall be sent (except as otherwise provided herein) (i) by certified or registered mail, first class postage prepaid, return receipt requested, (ii) by guaranteed overnight delivery by a nationally recognized courier service, or (iii) by facsimile with confirmation receipt (with a copy simultaneously sent by certified or registered mail, first class postage prepaid, return receipt requested or by overnight delivery by traditionally recognized courier service), addressed to such party as follows: If to the City: Christopher J. PUBLIC RECORDS. The Contractor shall be required to comply with the following requirements under Florida's Public Records Law: 1. Contractor shall keep and maintain public records required by the City to perform the service. 2. Upon request from the City, Contractor shall provide the City with a copy of the requested records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided by Chapter 119, Florida Statutes, or as otherwise provided by law. 3. Contractor shall ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law for the duration of the contract term and following completion of the contract if the Contractor does not transfer the records to the City. 4. Contractor shall, upon completion of the contract, transfer, at no cost, to the City all public records in possession of the Contractor or keep and maintain public records required by the City to perform the service. If the Contractor transfers all public records to the City upon completion of the contract, the Contractor shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the Contractor keeps and maintains public records upon completion of the contract, the Contractor shall meet all applicable requirements for retaining public records. GOVERNING LAW, VENUE, AND ATTORNEYS' FEES. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Venue shall be in Miami-Dade County, Florida. If this matter is placed in the hands of an attorney for collection, or in the event suit or action is instituted by the City to enforce any of the terms or conditions of this Agreement, and if the City is the prevailing party, the Contractor shall pay to the City, in such suit or action in both trial court and appellate court, the City's costs together with the City's reasonable attorney's fees for the anticipated cost of collection and judgment enforcement. 21. AUDIT. The Contractor shall make available to the City or its representative all required financial records associated with the Agreement for a period of Three (3) years. 22. NON-DISCRIMINATION. The Contractor agrees to comply with all local and state civil rights ordinances and with Title VI of the Civil Rights Act of 1984 as amended, Title VIII of the Civil Rights Act of 1968 as amended, Title 1 of the Housing and Community Development Act of 1974 as amended, Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, Executive Order 11063, and with Executive Order 11248 as amended by Executive Orders 11375 and 12086. The Contractor will not discriminate against any employee or applicant for employment because of race, color, creed, religion, ancestry, national origin, sex, disability or other handicap, age, marital/familial status, or status with regard to public assistance. The Contractor will take affirmative action to insure that all employment practices are free from such discrimination. Such employment practices include but are not limited to the following: hiring, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, termination, rates of pay or other forms of compensation, and selection for training, including apprenticeship. The Contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the City setting forth the provisions of this non- discrimination clause. The Contractor agrees to comply with any Federal regulations issued pursuant to compliance with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 708), which prohibits discrimination against the handicapped in any Federally assisted program. 23. CONFLICT OF INTEREST. The Contractor further covenants that in the performance of this Agreement, no person having any such interest shall knowingly be employed by the Contractor. The Contractor guarantees that he/she has not offered or given to any member of, delegate to the Congress of the United States, any or part of this contract or to any benefit arising therefrom. 24. INDEMNIFICATION AND WAIVER OF LIABILITY. The Contractor agrees, to the fullest extent permitted by law, to defend, indemnify and hold harmless the City, its agents, representatives, officers, directors, officials and employees from and against claims, damages, losses and expenses (including but not limited to attorney's fees, arbitration costs, and costs of appellate proceedings) relating to, arising out of or resulting from the Contractor's negligent acts, errors, mistakes or omissions relating to professional services in the performance of this Agreement. The Contractor's duty to defend, hold harmless and indemnify the City, its agents, representatives, officers, directors, officials and employees shall arise in connection with any claim, damage, loss or expense that is attributable to bodily injury; sickness; disease; death; or injury to impairment, or destruction of tangible property including loss of use resulting therefrom, caused by any negligent acts, errors, mistakes or omissions related to professional services in the performance of this Agreement including any person for whose acts, errors, mistakes or omissions the Contractor may be legally liable. The parties agree that One Hundred Dollars ($100.00) represents specific consideration to the Contractor for the indemnification set forth in this Agreement. 25. COMPLIANCE WITH LAW. Contractor shall comply with all laws, regulations and ordinances of any federal, state, or local governmental authority having jurisdiction with respect to this Agreement ("Applicable Laws") and shall obtain and maintain any and all material permits, licenses, approvals and consents necessary for the lawful conduct of the activities contemplated under this Agreement. 26. CONFLICTING PROVISIONS. The terms and conditions in this Agreement supersede any other conflicting provisions that are contained in any other document, including but not limited to Attachment "A", attached herein and incorporated herein by reference. If there is a conflict or inconsistency between any term, statement, requirement, or provision of Attachment "A", any document or events referred to herein, or any document incorporated herein by reference, and a term, statement, requirement or provision of this Agreement, the terms and conditions in this Agreement shall supersede and take priority over any other conflicting provisions that are contained in any other document, including but not limited to the Contractor's proposal contained in Attachment "A". 27. MISCELLANEOUS. A. In the event any provision of this Agreement is found to be void and unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall nevertheless be binding upon the parties with the same effect as though the void or unenforceable provisions had been severed and deleted. Being one of only 7 platinum LEAD certified buildings in the world upon completion, 600 Brickell had a vision to create an environmental "Rockefeller Center" display for the community here in Miami. Miami Christmas Lights listened to the needs of the client and created a unique display that included the custom _ manufacturing of a 40 foot wreath, the - largest wreath in the southeastern U.S., which is hung over 12 stories high on the face of the building. Miami Christmas lights also created a custom "Heart of the Holidays" program that worked with local elementary through high school students to develop handmade recycled ornaments that reflected the themes of the local • charity partners. The Continuum had worked with numerous other vendors over the past several years and each time was disappointed with their performance. Finally, they contacted Miami Christmas Lights who listened to their needs, design and installed a custom program that exceeded their expectations. Miami Christmas Lights installed over 100,000 commercial grade injection mold 5MM LED lights on the property on over 125 trees. Miami Christmas Lights was able to exceed the Continuum South Beach's expectations through its proactive maintenance programs which monitored the lights twice a week to catch any maintenance issues before the Continuum did. We also sealed each connection with proprietary salt and water repellant grease to minimize GFI tripping and keep the holiday display illuminated continuously. The project included the entire perimeter of the mall as well as the actual buildings. To make the project even more difficult, power was not installed anywhere on the property before the conception began. SIB Miami Christmas Lights was excited at this extreme and unique challenge! REASONS: The City of Sunny Isles Beach wishes to create a spectacular, festive atmosphere for the holiday's in the park for all to enjoy. To create a unique attraction for our residents and visitors, a custom piece was designed and created specifically for the City. This custom piece will be assembled, removed, stored and reassembled for 3 consecutive years under this agreement without a price increase. This three year agreement in the total amount of $195,000 includes the 3 year commitment for the custom piece as well as lighting of the park. The total for year one is $60,000.00, years two and three are dependent upon the level of lighting selected and is expected to be no greater than up to $65,000 in year two and up to $70,000 in year three to be billed based on the City's specific order. ADDITIONAL INFORMATION: This item is a piggyback from the City of Fort Lauderdale agreement 321 which was formally bid. Due to the custom piece and the requirement for an early commitment, this purchase was approved by the City Manager and is before you for ratification.
