HomeMy WebLinkAboutReso 2011-1667 RESOLUTION NO. 2011- I ~(..'7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE INTERIM CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND UP TO TWENTY-THREE THOUSAND SEVEN HUNDRED EIGHTY-FOUR DOLLARS ($23,784.00) FROM THE PARTIAL FEDERAL FORFEITURE (DOJ) FUNDS FOR THE PURCHASE OF ONE POLICE VEHICLE AND ASSOCIATED EQUIPMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the request of the Chief of Police to the governing body of a municipality, federally forfeited funds may be expended if accompanied by written certification that the request complies with the provisions of the Comprehensive Crime Control Act of 1984; and WHEREAS, the Interim Chief of Police has submitted a request for the expenditure of up to Twenty-Three Thousand Seven Hundred Eighty-Four Dollars ($23,784.00) in federally forfeited funds in compliance with the aforementioned. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Interim Chief of Police is hereby authorized to spend up to $23,784.00 from the established Department of Justice (DOJ) federal forfeitures account for the purchase of one Police vehicle and associated equipment. Grandinetti, Police Captain DA TE: 1/20/20 II RE: Approval to Expend Partial Forfeiture (DOJ) Funds for the purchase of one police vehicle and associated equipment, in an amount not to exceed $23,784.00 RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the result of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment, staffing resources and other law enforcement activities. It is requested that we be permitted to utilize up to $23,784.00 of said funds on deposit for such purpose. REASONS: The Sunny Isles Beach Police Department actively participates in an FBI / HIDTA (High Intensity Drug Trafficking Area) Initiative Group that conducts numerous ongoing proactive investigations and has a need for the attached listed equipment. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds for the enhancement of law enforcement. In addition to the budgeted police vehicles being purchased this year, the police department is also in need of an unmarked police vehicle to be utilized by the Investigative Services Division.
