A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA,
AUTHORIZING THE PURCHASE OF FORTY (40)
DECORATIVE LITTER CONTAINERS FROM TOTER
INCORPORATED, PURSUANT TO A NATIONAL I.T.A.
AGREEMENT THROUGH THE CITY OF TUCSON
083008-01, IN A TOTAL AMOUNT NOT TO EXCEED
FIFTEEN THOUSAND ($15,000.00), ATTACHED HERETO
AS EXHIBIT "A"j AUTHORIZING THE CITY MANAGER
TO DO ALL THINGS NECESSARY TO EFFECTUATE
THIS RESOLUTIONj PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission has expressed a desire to replace the current litter
containers along the beach area with containers that are more decorative and conducive to the
City's Streetscape Plan; and
WHEREAS, Toter Incorporated is the sole source vendor of decorative litter container
Model 860SB; and
WHEREAS, Toter has provided a quote for the purchase of forty (40) decorative litter
containers in a total amount not to exceed Fifteen Thousand Dollars ($15,000.00), attached
hereto as Exhibit "A"; and
WHEREAS, the quote from Toter utilizes the same pricing, terms, and conditions as
City of Tucson Agreement 083008-01; and
WHEREAS, the City's procurement codes provides that purchases made under state,
county or other governmental contracts, or competitive bids with other governmental agencies are
exempt from the City's competitive bidding procedures; and
WHEREAS, the City desires to purchase said decorative litter containers from Tolar.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authorization of Purchase. The City Commission hereby authorizes the purchase
of forty (40) decorative litter containers from Toter Incorporated, in a total amount not to exceed
Fifteen Thousand Dollars ($15,000.00), as quoted and attached hereto as Exhibit "A", pursuant to
City of Tucson Agreement 083008-01.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution will become effective upon adoption.

RE:
Purchase decorative liter containers from Toter Incorporated.
RECOMMENDATION:
Staff recommends approval of the attached resolution to purchase decorative liter
containers from Toter Incorporated.
REASONS:
The City has been transitioning the existing trash containers along the beach area to
decorative litter containers. Under a previous resolution the City authorized the purchase
of 25 containers from Toter Incorporated under a national agreement done through the
City of Tucson.
Toter is a sole source vendor of these containers and in order to take advantage of
the national agreement, the City requested a quote from Toter Incorporated for 40
additional decorative litter containers. The quote for the 40 containers comes out to
$13,840 that does not include the shipping. We are asking for an amount not to exceed of
$15,000, which will cover the shipping charges.
ADDITIONAL INFORMATION:
The city's procurement code provides that purchases made under state, county or other
governmental contracts, or competitive bids with other governmental agencies are
exempt from the City's competitive bidding procedures.
