HomeMy WebLinkAboutOrdinance 2011-358 - -- ORDINANCE NO. 2011- 3~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 256 OF THE CODE OF ORDINANCES OF THE CITY OF SUNNY ISLES BEACH TO AUTHORIZE THE CITY TO HAVE TOWED AND TO IMPOUND VEHICLES UNLA WFULL Y DISPLAYED FOR SALE, HIRE, OR RENTAL; PROVIDING FOR PENALTIES AND ENFORCEMENT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, curbstoning is a term given to the practice of buying and selling vehicles without a vehicle dealer license and established place of business; and WHEREAS, those who engage in curbstoning usually park and display their vehicles for sale in high traffic locations, such as on rights of way, on utility or pipeline easements, in public parking lots, or in gas stations, convenience stores, or supermarket parking lots; and WHEREAS, curbs toning is associated with visual blight and crime, including sales tax fraud; and WHEREAS, the Florida legislature recently passed House Bill 631, effective July 1, 2010, making illegal certain parking and display of vehicles for sale, hire, or rental; and WHEREAS, House Bill 631, codified at Section 316.1951, Florida Statutes, authorizes any law enforcement agency, code enforcement agency, or the Florida Department of Highway Safety and Motor Vehicles to immediately tow and impound any vehicle in violation of Section 316.1951, and to assess the owner of such vehicle a one hundred dollar ($100.00) fine in addition to towing and storage costs assessed by the towing storage operator; and WHEREAS, the City of Sunny Isles Beach cannot begin to assess the fine until it has adopted an ordinance allowing the towing of vehicles parked in violation of Section 316.1951, Florida Statutes. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Page I of5 Section 2. Amendment. Chapter 256-7 of the Code of Ordinances of the City of Sunny Isles Beach ("Parking and no-parking areas") is amended to read as follows: D. ill ill ill Parkin2 for sale of motor vehicles prohibited: penaltv. ill It is unlawful for any person to park a motor vehicle. as defined in Section 320.01. Florida Statutes. upon a public street or highway. a public parking lot. or other public property. or upon private property where the public has the right to travel by motor vehicle. for the principal purpose and intent of displaying the motor vehicle thereon for sale. hire. or rental unless the sale. hire. or rental of the motor vehicle is specifically authorized on such property by the City and the person is in compliance with all City licensing regulations. The provisions of subsection (1) above do not prohibit a person from parking his or her own motor vehicle or his or her other personal property on any private real property which the person owns or leases or on private real property which the person does not own or lease. but for which he or she obtains the permission of the owner. or on the public street immediately adiacent thereto. for the principal purpose and intent of sale. hire or rental. Subsection (1) above does not prohibit a licensed motor vehicle dealer from displaying for sale or offering for sale motor vehicles at locations other than the dealer's licensed location if the dealer has been issued a supplemental license for off-premises sales. as provided in Section 320.27(5). Florida Statutes. and has complied with the requirements in subsection (1) above. A vehicle displayed for sale by a licensed dealer at any location other than the dealer's licensed location is subiect to immediate removal without warning. A law enforcement officer. compliance officer. code enforcement officer or supervisor of the police department of the City may issue a citation and cause to be immediately removed at the owner's expense any motor vehicle found in violation of subsection (1) above. except as provided in subsections (2) and (3) above. or in violation of subsections (5). (6). (7) or (8) below. and the owner shall be assessed a penalty by the City as provided in Section 318.18(21). Florida Statutes. A motor vehicle removed under this section shall not be released from an impound or towing and storage facility before a release form prescribed by the Florida Department of Highway Safety and Motor Vehicles has been completed verifying that the fine has been paid to the City. However. the owner may pay towing and storage charges to the towing and storage facility pursuant to Section 713.78. Florida Statutes before payment of the fine or before the release form has been completed. Page 2 of 5 ill It is unlawful to offer a vehicle for sale if the vehicle identification number has been destroyed, removed, covered, altered, or defaced, as described in Section 319.33(1)(d), Florida Statutes. A vehicle found in violation of this subsection is subject to immediate removal without warning. @ It is unlawful to knowingly attach to any motor vehicle a registration that was not assigned or lawfully transferred to the vehicle pursuant to Section 320.261. Florida Statutes. A vehicle found in violation of this subsection is subject to immediate removal without warning. ill It is unlawful to display or offer for sale a vehicle that does not have a valid registration as provided in Section 320.02, Florida Statutes. A vehicle found in violation of this subsection is subject to immediate removal without warning. This subsection does not apply to vehicles and recreational vehicles being offered for sale through motor vehicle auctions as defined in Section 320.27(1)(c)4, Florida Statutes. lID. A vehicle is subject to immediate removal without warning if it bears a telephone number that has been displayed on three or more vehicles offered for sale within a 12-month period. i2l Any other provision of the law to the contrary notwithstanding, a violation of subsections (1), (5), (6), (7), or (8) above shall subject the owner of such motor vehicle to towing fees reasonably necessitated by removal and storage of the motor vehicle and a fine as required by Section 318.18, Florida Statutes. f.lQ} A law enforcement officer, compliance officer, code enforcement officer or supervisor of the police department of the City may, in their sole discretion, affix a warning notice to the vehicle providing the vehicle's owner with twenty four (24) hours notice to correct the violation, unless: ill the same vehicle owner has received another warning notice within a twelve (12) month period: ill the parked vehicle endangers public safety or constitutes a hazard: ill the vehicle reasonabl y appears to be stolen: or .lilt other extraordinary conditions exist, in which case the vehicle may be immediately towed without warning. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Page 3 of 5 Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. REASONS: The sale of used vehicles on public property by unlicensed dealers has become a problem in the State of Florida. To remedy this problem, the State Legislature recently passed a law which prohibits parking motor vehicles on public streets or highways by unlicensed parties for the purpose of displaying the motor vehicle for sale. It is important to note that the new law excludes persons displaying their own vehicles for sale on their own property and motor vehicle dealers with off-premises sale license. The new law requires local government to adopt an Ordinance in order to enforce the law locally. By adopting this Ordinance, the City will have the ability to impose fines and tow vehicles that are parked in public areas for the purpose of displaying the vehicles for sale. A TT ACHMENTS: .
