Mr. Conner reminded vendors to sign in as this is a mandatory pre-proposal conference, and he noted that the Summary Minutes from today's meeting along with the sign-in sheet will be posted on www.demandstar.com Deadline for submission of bid documents is Tuesday, August 12,2008 at 10:00 a.m. at which time they will be publicly opened. Any additional questions are required to be in writing and may be submitted up to seven (7) business days before the bid opening (Friday, August 1,2008). They will be answered and posted on www.demandstar.com You may email themtoRickConneratrconner@sifl.net The City's Consultant, Valarie Hoffman of Solid Resources, Inc. presented an overview of the project. The Security Bonding Requirement that needs to be supplied with your submittal is 5%. The general liability insurance is $5 Million, and automobile liability is $1 Million. This work is for the clearing, removal, and disposal of debris that is within the jurisdiction of Sunny Isles Beach. The regular contract is for vegetative, C&D, and what is placed at the curb side on public rights-of-way. Additional/Alternate Tasks: There are other tasks listed that will be issued on an as-needed basis for hazardous waste removal. There are additional tasks for clearing Federal aid roads: 1) Sunny Isles Boulevard; 2) A 1 A (Collins A venue); and 3) William Lehman Causeway. These roads are under the jurisdiction of the Florida Department of Transportation (FDOT), but should they not be able to clear those in a timely manner, the City will be instructing you to also clear those main roadways into the City in addition to all the other roadways in the City. There is also an alternate task for sand removal should the need arise if there is a wash over of the roads. In the bid section there are some other opportunities for you to bid on some of those should the need anse. All the contract direct costs are laid out here in the proposal for your payroll, subs, materials, equipment, rental, sales taxes, payments, and permits and fees that you may need. The one exclusion is your overhead and profit, bid your unit prices with your overhead and profit built in, they should not be separate line items. Timeframe: If there is inclement weather or any other storm activities that come up that delay your work, the City will work with you on an extension of time because there is a really important time factor here. The proposal limits you to have all the debris removed within the City of Sunny Isles Beach within 30 days, so you want to make sure that you are able to put enough personnel, resources, and equipment on this job early to get everything done within that time frame. The RFP is based on a projection of 40,000 cubic yards for consistency purposes (Hurricane Wilma had about 20,000 yards to be picked up, and it took 30 days, but the resources were not large). There are several places in the proposal that talk about your response time. Prior to a storm event, the contract will be activated as when you should start to mobilize your equipment and your forces and we expect a two-person management team to come by the emergency center 48-hours in advance and then after the weather has cleared, there is a 12-hour time frame that you have to start clearing the roadways, and if you should be tasked with clearing the main arterial roadways, those three (3) roadways specifically need to be 08-07-01 Addendum No.1 Prebid l\linutes.doc Page 2 of 7 done within 24 hours after the all-clear has been given when the storm has subsided. There are some penalties for not having your forces mobilized in a timely manner, and you have 24 hours to be 50% mobilized, and after 48 hours you need to be 100% mobilized. This is the basis for your proposal and the amount of crews and personnel that you assigned as being necessary to perform this work within 30 days. The goal is to make sure that whoever the contractor is for this project is going to show up in a timely manner, and get the work done very quickly because this community is very concerned about making sure that everything is cleaned up and it can never be too quick. If you do anything faster than these time limitations, that is even better. Disposal Location: In this proposal, the disposal location is listed as the North Dade Facility which is about 16 miles away, and the goal is to have that be your primary disposal facility but if there are any obstacles in disposing the debris directly to that facility then that is something that we will work with the winning contractor if the need should arise. There is no temporary site for debris, storage and reduction on this island, they are too close to the proximity of publicly traveled areas, and condominiums, and residential areas, so there is nothing available on the island for that activity. The only spot available on the island would be, should the need arise to store construction and demolition debris temporarily because there is no reduction involved, is a site just north of the William Lehman Causeway that will be available if there needs to be a residential drop off area or a temporary construction and demolition site, otherwise the clearing is done when you are actually picking up and removing the debris. In the past it has been chipped behind the truck with a chipper trailer and right into the bed and taken as mulch to the disposal facility. Basically, the optimal way if it is not a large event storm is to chip as you go and take that debris to disposal at the North Dade Facility. The City is in a negotiations with the County to look into utilizing one of their temporary storage sites, if they activate one after a disaster, to have an alternate for a place to take debris should something be wrong with the landfills, if you can't get into them, if the lines are three hours long, if there is a lot of debris and the quantities cannot be handled. As of now, the goal is to take it straight from the City either vegetative or mulch, preferably mulch, to a landfill directly. In the past Public Works has cleared the Park areas but you may be asked to assist with those should the need arise in the Parks and the facilities debris of surrounding buildings such as this but that is not directly in the scope of this RFP as the primary debris removal location. Conversion Factors: There are conversion factors from cubic yards to tons that are based on the new FEMA Guidelines. Last year in 2007 they revamped their conversion factors to what they think the different types of debris weigh, they classified debris as hard woods and soft woods and in the past the ratio has been 8 to I. That is no longer what FEMA is using, so that will be a standard that the monitoring company will be looking at if you base your debris on cubic yardage and you are paid on a cubic yardage basis, there will be a comparison done with the disposal weight from the disposal tickets to make sure that everything is in line with the load calls the monitoring company will perform out in the field for you, so those rates have changed. In the stump conversion table, there is a line item in the proposal for leaners and hangars for you to bid on per tree and there is also a stump line item per the size of the stump. Make sure that you are aware of anything in the public right-of-way that is in the City's jurisdiction that you remove as a stump, less than 24-inches will be based on a cubic yardage rate which there is a conversion table (it incorrectly says page 45 but it is on page 44), that any stumps that private property owners bring to the curb are eligible on a per cubic yard basis. They are on a conversion chart rate to a cubic yard, so only the stumps that are the responsibility of the City directly will be eligible on the 24-inch and up scale that you are bidding on in this proposal. We are asking that you bid on a cubic yardage basis and a tonnage basis. We are entertaining having everything weighed directly and paying on a ton so we want to see how those work out at the end of the day for the proposals and logistically as well. Public Works Director Rick Conner noted that you do not have to be a member to access the information on www.demandstar.com Assistant Public Works Director Bill Evans has years of experience working for 08-07-01 Addendum No.1 Prebid Minutes.doc Page 3 of 7 FEMA, working with these types of things, and he will be the City's representative. He knows what he is doing. In addition, few people know more about this process than Valerie Hoffman does. We have top notched people so you will have pros to deal with, you will be dealing with people that understand this, and will know how to help you, how to get questions answered, and how to take care of business. Tied to that, this City Commission spent a considerable amount of time talking about this process when we presented the consultants to them to get going, and the discussion was your work, and this Commissioner is adamant that we take care of business, they want whoever is selected to be a top flight firm that does top flight work. Weare expecting nothing but good service, quick service, quality service, and the City will go after anybody that does not provide that. Ms. Hoffman asked if everyone is familiar with the FEMA Grant limitation of 70 hours for time and materials for clearing, as the monitoring firm that is something that will be very closely tracked, because we want to make sure that we don't jeopardize any funding should there be a declaration and there is FEMA funding available. The 70-hours time and material is not individual man hours, it is how many people you can throw on the project for so many hours per day for a total of 70 hours, and so the more people you throw at the project the faster in the beginning for clearing, the better. After 70 hours it has to revert to a cubic yardage or a tonnage basis. QUESTIONS AND COMMENTS FROM PROSPECTIVE BIDDERS 1. Can you clarify, are you planning on cubic yards or tonnage? We don't know yet. 2. You said the pay item will be per ton? There is both in here for you to bid on, a cubic yardage basis and a tonnage basis. It depends on a couple of things since there is no temporary site available. Should there be one available, you would have to have a scale there in order to utilize tonnage but if we are not doing a temporary site, if it is going straight from the City to disposal, it can be based on the tonnage coming out of the disposal tickets, and we will have load tickets and disposal tickets, so it is an option that FEMA has been discussing that with a lot of the local applicants. It has its own set of problems but it also alleviates a whole other set of problems with quantities, certified cubic yardage of trucks, load call discrepancies that come up during the process, so we are going to have to decide which way we want to have the City accept for billing purposes on yardage or tons. 3. The process that the North Dade Site used during Hurricane Wilma was cubic yards. We have seen them do both. They are encouraging applicants to go to tonnage because it does alleviate a lot of problems. Some of the biggest problems that they are finding with Federal funding is the inaccuracies of truck certifications and discrepancies on load calls or no load calls at all. It is very rare that you are going to have all your trucks at 100% full. 4. Something that you may want to take into consideration, we ran the Dade County Site in the last storm and the limitations that they put on us was only one tower. The wait was up to two hours and that was by the yard, if you go by the ton the wait is up to six hours. 5. To my understanding we all have to obtain an Occupational License here if we are awarded the contract as it states in page 7, or Section 3.24 you talk about submitting a local Occupational License. We don't have to go ahead and obtain a license here to submit a bid? A copy must be provided with the RFP, Section 22 - RFP check list lists it as included with the RFP and Section 9.7 asks for the license numbers. 08-07-01 l\ddendum No.1 Prebid l\linutes.doc Page 4 of 7 6. In the insurance requirement on page 5, Section 3.9.4, it indicates that you want copies of the certificates of insurance attached to the RFP, is that correct, or is that after award of bid? That would be after the award. 7. Cubic yard vs. tonnage, did you say it can go either way depending on the availability of a scale? The suggestions are to get both prices to see which way that we want to advise the City to use because FEMA is encouraging the tonnage rate to do it by weight instead of by cubic yardage, but most everyone down here has done it by cubic yardage in the past. We don't know that there are enough scales available for temporary site use down here for rental by local applicants to use that, you don't want to wait six (6) hours per truck to go to a scale, so it is going to depend on some logistical issues, and that is one of the things we are trying to work out right now with the County is to have the availability of a temporary site should we need it otherwise it is just going to go straight to the final disposal and if the wait times are going to be bad then we are probably going to do it on a cubic yardage basis. 8. Will the contractor be required to supply the scale? That is not in the proposal, right now we don't have a temporary site. It would be one of the County's and so that would depend on whether the County decides to utilize that method and we are not sure that they are going to go in that direction. It would likely be a function of the disposal facility. 9. Do you have any idea if the contractor can have their own temporary disposal site? That is something that we did not make a provision for, it is something that can be addressed, the temporary site would have to go through a review first. 10. As far as the vehicles, it goes through the Miami-Dade Solid Management requirement to have registration stickers, that would probably be waived? No, especially if you are billing on a cubic yardage basis, you cannot take any debris out of the City and load up a truck until it has gone through a certification process and it will be labeled and placard as the RFP dictates. That is really important, even if for some reason it starts with cubic yardage and it changes to tonnage if the disposal facility facilitates one faster than the other either way we don't want to take a chance with any Federal funding since that has been such a huge issue so everything will be definitely measured very well. 11. What was the major challenge after the last storm? Sunny Isles Beach was fortunate in they didn't have a bid process before the last storm, and they had a landscaping company that has an emergency procurement clause in their contract so they were able to utilize them to just come in on an emergency basis and do this removal work for them and it went fairly smoothly, they might have liked it to be done a little faster because it took a little over a month, and it was about 20,000 yards and they just chipped as they went and that worked pretty well, and now they want to go through the formal bid process and get everything lined up, and hopefully get all the resources out here that they need. In general, the biggest problem in all of South Florida was the lack of education of the local applicants, the cities and the counties. That is changing hopefully, there has been a lot of training going on by FEMA, the State, FDOT, and to educate the applicants on a list of everything they need to do before they even start the debris operation. The paperwork is one of the biggest issues. That is something that will be reviewed in great detail as your paperwork comes in with all of the information because if you are tasked with clearing those Federal aid roads, that has to be 08-07-01 Addendum No.1 Prebid l\linutes.doc Page 5 of 7 segregated by either a separate invoice or separate line items because that is something the City will have to track because they will have to go to two different funding program for the money. So tracking first pass through a community whether it is on a Federal aid road or on a non- Federal aid road is very important so the load tickets in the past have not had enough detail. Load tickets will be very detailed, will be legible at the site where the monitor is looking at them and fully filled out so we won't be having any problems with that. The invoicing needs to clearly reflect exactly what type of roadway, if it is a first pass or second pass, and with all the supporting documentation, all in a line, all at once given to the City so they can make sure they have everything on file and they are not missing any documentation from any vendors. 12. Do you want us to provide the actual load tickets? Solid Resources, Inc. is the monitoring firm, so we have tickets to do that. 13. As far as permitting, Dade County requires that in order to haul any solid waste material, each vehicle would have to be permitted by Dade County? We know that in the past that has not been enforced because there are vendors coming from all over the country and they are utilizing some local resources and some not. We haven't seen a certification process that the trucks have gotten permitted or certified from the County to go to their landfills. 14. Appliances were lumped in with construction C&D, does that include our responsibility? Yes, it should be included in your bid response. You would look at that more as a per unit type of price on the appliances themselves and the Freon would need to be removed. 15. Can we get a little more clarification with your evaluation, is it just price basically? No. This community is interested in quality. We recently passed an Ordinance that even further solidifies our ability to get the right company, not necessarily the cheapest company. We will do extensive background checks, reference checks. What we are going to do is go with the firm that is going to come in here, do the job, do it right, do it according to the standards. Price is only a factor, not the sole determining factor, in selecting the bidder. The City will choose the lowest responsible, responsive bidder, which is not necessarily the lowest dollars and cents bidder. 16. Is the City permitted to utilize the Miami-Dade County facilities to dispose of the debris? Just one on the north end, and the question arose at our meeting with the County last week as to whether or not we have an Interlocal agreement with them, and we are going to try to find out a much smaller area relative to the whole community. 17. Does the debris removal services also include condominium facilities? What we are working on is the roadways, the rights-of-way, we are contracting to take care of the rights-of-way. In the RFP it mentions that all the condominiums to the east side of AlA all have contracted private debris removal and garbage haulers and so the City nor the County touches anything of any of the facilities to the east. So, the right-of-way right along that road, but nothing further than that. There are a couple of other islands that have condominiums only, they don't even go there. The City is under agreement with Miami-Dade County, the County actually provides their regular yard and garbage service, year around to the residential communities including the one gated community and the residential community to the north. 08-07-01 Addendum No.1 Prebid l\linutes.doc Page 6 of 7 18. Do the services also include sand removal and restoration? Yes. There is a cost in there, if there is a wash over and sand comes up at the point where it gets to the right-of-way on the east side of AlA and to the west, sand removal would be included ifit would be needed. It is in there for removal and screening, it is all together and it will have to be placed back out. They are included on the unit price schedule, it is the last item at the top of page 44, Section 3.0 Sand Collection and Screening. 19. When you evaluate the bids, will there be a selection committee or will it be in-house staff? It will be in-house with staff and consultants. 20. Will you be posting the sign-in sheet on Demand Star? Yes, and at the end of meeting, please drop off your business cards. To reiterate, it is the lowest responsible responsive bidder which does not necessarily mean the lowest dollar and cents amount. Here are some additional clarifications for the questions that were posed at the pre- bid meeting and from the proposing vendor last Wednesday. From the pre-bid meetinl!lminutes: Questions 3 and 4: According to Miami-Dade County Department of Solid Waste Management, the only companies that are given the option to dispose of debris on a cubic yard basis at their facilities are registered Landscaping companies. They indicated that companies disposing of debris or solid waste at County run facilities that are any classification other than Landscaping companies will only be allowed to dispose of debris on a tonnage basis according to the appropriate fee schedule. This is regardless if the disposal occurs during regular business operations or emergency debris disposal operations. Additional information on the fee schedule and requirements is available at: http://www . miam idade. go v Ids wm/disposal fees .asp Question 13: According to Miami-Dade County Department of Solid Waste Management, all haulers of solid waste working within the County's jurisdiction disposing of at County run facilities are required by County Code Chapter 15 to apply for and be permitted by the County. Any vendor that chooses to not register their company and their vehicles individually does so at their own risk. In an emergency situation the County will be monitoring their disposal facilities for compliance with all regulations and codes. Additional information on the hauler/vehicle registration process is available at: http://www.miamidade.gov/dswm/permitting.asp From the Vendor Questions on Wednesdav: 1) Certificates of Competencies? it is required by the RFP, but appears to only apply to products (material) used in construction. Disaster debris clearance and removal is more closely associated with a service, not products and it appears that Certificates of Competencies are not necessary. Is this accurate? The CERTIFICATE OF COMPETENCY is a certificate issued by the Small Business Administration (SBA) stating that the holder is responsible with respect to all elements of responsibility, including but not limited to capability, competency, capacity, credit, integrity, perseverance, and tenacity for the purpose of receiving and performing a specific Government contract. It would be acceptable for the respondent to adequately demonstrate experience, capacity, credit worthiness and that there are no material legal disputes or criminal convictions, successful past performance, and adequate references if the actual Certificate from the SBA is not available. These issues relate to services and equipment and are totally applicable to this RFP. 2) Local Business Tax (Occupational Business License) ? in one section of the RFP it appears that our Local Occupational Business License along with our registration with the Florida Secretary of State as a corporation fulfills this requirement. Is this accurate? While the "Local Occupational Business License along with our registration with the Florida Secretary of State as a corporation fulfills this requirement", Local, in this instance, shall mean Miami-Dade County and the City of Sunny Isles Beach where applicable. EMERGENCY DEBRIS CLEARING AND REMOVAL OPERATIONS Request for Proposal No. 08-07-01 The Specifications for this Request for Proposal are available from DemandStar by calling (800) 711-1712 or by accessing their website at www.demandstar.com. The RFP Specifications may also be examined at the City of Sunny Isles Beach - Office of the City Clerk. Vendors who obtain the RFP Specifications from sources other than DemandStar or the City of Sunny Isles Beach are cautioned that their RFP response package may be incomplete.
