AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
ITS COMPREHENSIVE PLAN TO UPDATE THE CAPITAL
IMPROVEMENTS SCHEDULE PURSUANT TO SECTION
163.3177(3)(b )1., FLORIDA STATUTES (F.S.); PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEALER;
PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Legislature of the State of Florida has mandated that all local
governments must annually update their Comprehensive Plan Capital Improvement element,
including the Five Year Schedule of Capital Improvements; and
WHEREAS, all amendments to the comprehensive plan must be adopted in accordance
with detail procedures which be strictly followed; and
WHEREAS, the City of Sunny Isles Beach, Florida, has carefully prepared and
amendment to its comprehensive plan to update its Capital Improvements Element and Schedule
pursuant to Section 263.3177, Florida Statutes, and
WHEREAS, the City Commission desires to adopt the amendment to the current
comprehensive plan to guide and control the future development of the City, and to preserve,
promote, and protect the public health, safety and welfare.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Update of Policy Updating Policy 1 G of the City Comprehensive Plan Capital
Improvement Element and Five Year Capital Improvement Schedule, see attached "Exhibit A."
Section 2. Incorporation of Recitals. The foregoing facts and recitations contained in the
preamble to this Ordinance are hereby adopted and incorporated by reference as it fully set forth
herein.
Section 3 Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of
the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be

changed to "section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

FIVE YEAR CAPITAL IMPROVEMENT SCHEDULE

Amend Policy 1 G. as follows:
The City of Sunny Isles Beach 200g11 - 201~~ Capital Improvements Plan, and the
Capital Improvements Schedule included therein, contains a the followinq schedule of
projects that the City shall implement in order to maintain its adopted Level of Service
standards or otherwise achieve the goals, objectives and policies and/or ensure the
financial feasibility of the Comprehensive Plan. The 2008 2012 C3pitallmprovements
PI3n is hereby 3dopted as p3rt of the C3pitallmprovements Element.

Amending City Comprehensive Master Plan to update the Five -Year
Capital Improvement Schedule.
RECOMMENDATION:
Staff recommends City Commission approval amending the City Comprehensive Master
Plan updating the Five -Year Capital Improvement Schedule.
REASONS:
Florida Statutes (F.S.), mandates that all local governments annually amend their adopted
Comprehensive Plan to update the Five Year Capital Improvement Schedule in the
Capital Improvements Element. Policy IG in the City's Capital Improvements Element is
as follows: "The City of Sunny Isles Beach 2011 - 2015 Capital Improvements Plan, and
the Capital Improvements Schedule included therein, contains a schedule of projects that
the City shall implement in order to maintain its adopted Level of Service standards or
otherwise achieve the goals, objectives and policies and/or ensure the financial feasibility
of the Comprehensive Plan. Community Affairs, other review agencies, and adjacent
local governments in accordance with State requirements. The effective date of this plan
amendment shall be the date a final order is issued by the Department of Community
Affairs or Administration Council finding the amendment in compliance in accordance
