AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
CHAPTER 138 OF THE CODE OF ORDINANCES OF THE
CITY OF SUNNY ISLES BEACH TO REQUIRE
DISCLOSURE BY CONTRACTORS OF THE COST OF
CONSTRUCTION PERMITS REQUIRED FOR
CONSTRUCTION OR RECONSTRUCTION OF
RESIDENTIAL PREMISES; PROVIDING FOR PENALTIES
AND ENFORCEMENT;PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEALER; PROVIDING FOR
INCLUSION IN THE CODE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, The City of Sunny Isles Beach (the "City") requires contractors to apply for
and obtain building permits from the City on behalf of consumers for construction or
reconstruction of residential premises; and
WHEREAS, the City wishes to amend Chapter 138 of the City Code to require that
residential contracts be clearly written and understandable and that contractors disclose and
itemize the cost of all permits necessary to complete a residential construction project; and
WHEREAS, this new consumer protection law shall apply to all work on a residential
premises which requires that a permit be obtained under the City Code; and
WHEREAS, contractors shall be required to pay a penalty in the amount of $500 (five
hundred dollars) for each separate violation, upon written complaint filed by a consumer with the
City's Building Department.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific part by this
Ordinance upon adoption hereof.
Section 2. Amendment. Chapter 138 of the Code or Ordinances of the City of Sunny Isles
Beach is amended to read as follows:

Disclosure of permit fees on initial and final invoices required; penalty.
ill
The initial and final invoices regarding a consumer contract for construction or
reconstruction at a residential premises shall contain a disclosure by the
contractor of the cost of construction permits required to complete the
construction or reconstruction of the residential premises that the contractor will
charge to obtain the required permits from the City of Sunny Isles Beach, which

amount shall not exceed the cost to the contractor to obtain the permits and to
record any necessary documents. If permit fees are not known at the time of
preparation of the initial invoice, the initial invoice shall indicate that permit fees
shall be stated in the final invoice.
ill For purposes of this section, "construction" or "reconstruction" means any work
on a residential premises which will require a permit to be obtained under the
Code of Ordinances of the City of Sunny Isles Beach and Florida Building Code.
ill Upon written complaint filed by a consumer with the City of Sunny Isles Beach
Building Department a contractor found to be in violation of this provision shall
be subiect to a $500.00 (five hundred dollar) penalty for each separate violation
to be enforced pursuant to this section.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of
the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (l0) days after adoption on
second reading.

Ordinance Requiring Contractors to Disclose Fees for all permits
obtained from the City
RECOMMENDA TION:
This amended Ordinance is presented for your consideration.
REASONS:
The City of Sunny Isles Beach requires contractors to apply for and obtain building
permits from the City on behalf of residents for construction or reconstruction of
residential premises. The purpose of this attached amendment to Chapter 13 8 of the City
Code is to require that contracts between the contractors and residents be clearly written
and understandable. Specifically, contractors will be required to disclose and itemize the
cost of all permits necessary to complete the residential construction project.
Please note that the Ordinance shall apply to all work on residential premises which
require that a permit be obtained under the City Code. Upon written complaint by a
resident filed within the City's Building Department, contractors who have violated this
law will be fined $500.00 for each violation.
