HomeMy WebLinkAboutOrdinance 2011-362 ORDINANCE NO. 2011-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-47(E) OF THE CODE OF ORDINANCES OF THE CITY OF SUNNY ISLES BEACH REGARDING CLEAR SIGHT TRIANGLES FOR DRIVEWAYS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City seeks to provide safety for their residents and visitors by amending the driveway standard specifications; and WHEREAS, the City Commission wishes to amend its code to improve and clarify requirements for the clear sight triangles regarding driveways and street intersections. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section I. Amendment. Section 265-47 (E) of the Code of the City of Sunny Isles Beach is hereby amended to read as follows: ~ 265-47 Driveway standards E. Clear sight triangles. Clear sight triangles. All driveways and street intersections shall provide clear sight triangles in both directions as depicted below in the Safe Sight Distance Triangle Table: (1) Measurement. Clear sight triangles on both sides of all driveways, medians and at all street intersections shall be measured as follo'.vs: (a) Two major streets: 20 feet along the right of way lines from the intersection of two major streets. (b) Major street/local street: 20 feet along the right of way lines from the intersection of a major street with a local street. For a local street, sight triangle lies within public right-of-way. ill The required dimensions for the clear sight triangle should be taken from the crossroad toward each side of the street and a line draw to connecting points in accordance with the attached Diagram A except depth visibility on a minor street is measured from the right-of-way line through street. along centerline if minor street (public or private streets). {g} The clear sight triangle area shall not contain obstructions to cross- visibility at a height of two and one-half (2.5). Fences. walls. bus shelters or hedges or other obstruction including. but not limited to. structures. grass. ground covers. shrubs. vines shall not exceed two and one-half (2.5) feet or more above pavement or finish elevation of property whichever is greater. (n) For the purpose of this section. a local road is a road which contains 50 feet or less of right-of-way. A collector road is a road which contains a minimum of 60 feet of right-of-way. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 5. Effective Date. Vera, Acting City Manager DATE: 3/1712011 RE: Amending Section 265-47(E) Driveway Standards for Clear Site Safety Triangle. RECOMMENDATION: Staff recommends that the City Commission approve the amendment to the clear site safety triangle requirements under the Driveway Standards Section of the Land Development Regulations. REASONS: As part of an ongoing process in reviewing the Land Development Regulation and in order to provide the general public as well as professionals with a code that is easily understood, staff is requesting an amendment to Section 265-47(E) of the Land Development Regulations. The section being amended deals with the clear sight safety triangle in driveways and street intersections. The standards setforth under this section of the Code needed to be improved and further clarified for the use of the general public and professionals.
