HomeMy WebLinkAboutOrdinance 2008-314 ORDINANCE NO. 2008-.3.r:l AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 62-8 OF THE CITY CODE TO PROVIDE ADDITIONAL GROUNDS FOR THE SELECTION OF THE LOWEST RESPONSIBLE AND RESPONSIVE BIDDER; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has the authority to amend its code prOViSIOns pursuant to Section C-4.3 of the City Charter; and WHEREAS, the City Commission wishes to amend Section 62-8 of the City Code to provide additional grounds for the selection of the lowest responsible and responsive bidder. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 62-8 of the City Code is amended to read as follows: ~ 62-8. Award. A. All contracts shall be awarded by the City Manager, as stated above, to the lowest responsible and responsive bidder whose bid best serves the interests of and represents the best value to the City. Price is only a factor in determining the lowest responsible and responsive bidder. For purposes of this section, the term lowest responsible and responsive bidder is not the bidder with the lowest dollars and cents bid. The City Manager or the City Commission may select a bidder whose bid is not the lowest dollars and cents bid if the award is based on the criteria set forth below in this section. In addition to price, there shall be considered the following: (1) The capacity, ability and skill of the provider to perform the contract; (2) Whether the provider can perform the contract within the time specified without delay or interference; (3) The character, integrity, reputation, judgment, experience and efficiency of the provider; Words added underlined. words stflekefl deleted (ed) Page I of 3 (4) Professional licensure required when service of a skilled nature as required by law to perform such services and/or skill; (5) The quality of performance of previous contracts; (6) The previous and existing compliance by the provider with laws and ordinances relating to the contract; (7) The ability of the provider regarding future maintenance and service for the use of the subject of the contract; (8) The City Manager may, by administrative order, establish a set of criteria of a numerical nature that may be utilized in awarding contracts hereunder-;-; rn Whether the provider was declared by a court, administrative hearing officer or tribunal of competent iurisdiction to have breached or failed to perform a contract; QQl The claims history of the provider; .u..u The performance history of the provider on a City contract or other government contract; .c..u2 Any unresolved concern regarding the provider; and .Ql) Any other cause under this Code and Florida law for evaluating the responsibility of the provider. B. The contracts shall be awarded by the City Manager or the City Commission, as the case may be, with reasonable promptness by appropriate written notice to the lowest responsible and responsive bidder whose bid best serves the interests of and represents the best value to the City, in conformity with the criteria set forth in Section 62-8 of the City Code and meets the requirements and criteria set forth in the invitation for bids. C. In the event the lowest, most responsive and responsible bid for a project exceeds available funds, and the City Commission does not make available additional funds, the City Manager is authorized, when time or economic considerations preclude resolicitation of bids, to negotiate an adjustment of the bid price as long as the scope of work is not changed with the lowest,..--fllBSt responsive and responsible bidder, in order to bring the bid within the amount of available funds. Final negotiations shall be in written form as approved by the City Manager. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the section of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. Hines, CMc, City Clerk MEMORANDUM TO: The Honorable City Commission FROM: Hans Ottinot, City Attorne~ DATE: October 16, 2008 RE: Ordinance amending Sections 62-8 of the City Code RECOMMENDATION: It is recommended that the City Commission approve the attached Ordinance amending Section 62-8 of the City Code. REASONS: The purpose of the Ordinance amending Section 62-8 of the City Code is to provide additional grounds for the City Manager to select the lowest responsible and responsive bidder. The following new factors will be added to the selection of the lowest responsible and responsive bidder: 1) whether the provider breached or failed to perform a contract; 2) the claims history of the provider; 3) the performance history of the provider on a City contract or other government contracts; 4) any unresolved claim regarding the provider; and 5) any other cause under this code and Florida law for evaluating the responsibility of the provider.
