AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
SECTION 265-68(D) OF THE CODE OF ORDINANCES OF
THE CITY OF SUNNY ISLES BEACH REGARDING
LANDSCAPING REQUIREMENTS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEALER;
PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City wishes to amend its landscape requirements for single family
dwelling to provide more flexibility.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1.
Amendment. Section 265-68 is amended to read as follows:

Minimum landscape requirements for all zoning districts.
CD) Irrigation. All newly landscaped areas shall be provided with a fully
automatic underground irrigation system that provides 100% coverage to all
landscaped areas,;, except on single family dwelling and duplexes. The irrigation
system should be designed to provide only the required water to sustain viable
plant material. The use of a porous, pipe subsurface irrigation system that requires
low water volume and pressure is encouraged when adjacent to vehicular roadway
areas.
Section 2. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 3. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of
the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required.
Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 5. Effective Date. This Ordinance shall be effective ten (l0) days after adoption on
second reading.

Amending Section 265-68 Landscaping Requirements of the Land
Development Regulations
RECOMMENDATION:
Staff recommends that the City Commission approve the amendment to Section 265-68
of the landscaping requirements in the Land Development Regulations.
REASONS:
It was brought to staffs attention that under the landscaping section of the Code,
automatic underground irrigation system was a requirement for all zoning sections. After
reviewing the Code on the amount of landscaping areas in the single family and two-
family dwelling sites, staffs professional opinion is that the requirement to install an
automatic underground irrigation system in the two residential areas is excessive and
creates an unnecessary additional cost to the home owner.
