This Electronic Sealed Bidding Event has a preliminary end date and time of Friday, December 12, 2008 at 10:30 AM EST plus any possible extensions. The undersigned bidder hereby proposes and agrees to furnish The City of Sunny Isles Beach, Medjool Date Palm Trees in accordance with the Specifications. The bidder also agrees to participate in an Electronic Sealed Bidding Event to determine final pricing. Your sealed specification response will be due at The City of Sunny Isles Beach, 18070 Collins Ave, Sunny Isles Beach, FL, 33160 no later than Monday, December 8,2008 by 2:00 PM EST. Specification submittals must indicate any and all exceptions to the specifications, as well as any option packages or prepayment discounts. DO NOT SUBMIT BID PRICING WITH YOUR SPECIFICATIONS PACKAGE. The bidder understands that this proposal is submitted subject to the following: Bids will be evaluated based on each vendor's final pricing submitted during the Electronic Sealed Bidding Event, and the Specification Responses provided. The bid will be awarded to the lowest responsible and responsive bidder. The buyer reserves the right to accept bids on the basis of total evaluated bid or to accept portions of any bid and to award the bid to the bidder who is not necessarily the lowest dollars and cents bid. The Specifications and Information for Bidders form the conditions of the Contract for this proposal. The awarded supplier is obligated to pay a transaction fee to Bid Bridge pursuant to the Terms & Conditions accepted upon placement of initial bid. The fee will be based on the final total purchase price assessed as Three Percent (3%) or Two Thousand Five Hundred Dollars ($2,500.00), whichever is more. The transaction fee is assessed on the final selling price and payment terms are as follows: o Definitive - $2,500 is payable with the issuance of Purchase Order by the Buyer with the remaining balance due upon delivery of the item or service. AWARD OF CONTRACT: REJECTION OF BIDS - The Buyer reserves the right to (i) reject any, any part of, or all bids or proposals to fulfill The Buyer's requirements, (ii) waive informalities and technicalities, (iii) negotiate directly with any party submitting a bid or proposal, or (iv) accept that bid or proposal which The Buyer deems to be in its best interest and represents the best value, whether or not it is the lowest dollars and cents proposal. Groundworks will supply (20) Certified Medjools at 12.5' installed with a 2 year warranty and 2 years of service. Terms: In accordance with the regulations of the City of Sunny Isles Beach payment schedule. Prices are good until June 1st 2009. Please update prices after June 2nd, 2009. The prices contained herein include delivery, labor and installation and are based on normal equipment access (40' crane reach maximum). These prices also include all applicable taxes, a two (2) year limited warranty and ten (10) post installation service visits. See attached copy of limited warranty. CT = CLEAR TRUNK. Clear Trunk is defined as a measurement from the lowest live green frond to ground level.
