The undersigned Bidder proposes and agrees, if this Bid is accepted, to enter into an agreement with The
City of Sunny Isles Beach in the form included in the Contract Documents to perform and furnish all Work
as specified or indicated in the Contract Documents for the Contract Price and within the Contract Time
indicated in this Bid and in accordance with the other terms and conditions of the Contract Documents.
7.1. The Bidder accepts all of the terms and conditions of the Advertisement or Invitation to Bid and
Instructions to Bidder's, including without limitation those dealing with the disposition of Bid Security.
This Bid will remain subject to acceptance for 90 days after the day of Bid opening. The Bidder agrees to
sign and submit the Agreement with the Bonds and other documents required by the Bidding
Requirements within ten days after the date of the City's Notice of Award.

7.2.2. The Bidder has familiarized himself/herself with the nature and extent of the Contract
Documents, Work, site, locality, and all local conditions and Law and Regulations that in
any manner may affect cost, progress, performance, or furnishing of the Work.
7.2.3. The Bidder has studied carefully all reports and drawings of subsurface conditions and
drawings of physical conditions.
7.2.4. The Bidder has obtained and carefully studied (or assumes responsibility for obtaining
and carefully studying) all such examinations, investigations, explorations, tests and
studies (in addition to or to supplement those referred to in (c) above) which pertain to
the subsurface or physical conditions at the site or otherwise may affect the cost,
progress, performance, or furnishing of the Work at the Contract Price, within the

similar information or data are or will be required by Bidder for such purposes.

Facilities. No additional examinations, investigations, explorations, tests, report or similar

Mandatory Pre-Bid Conference Summary Minutes
Monday, December 1, 2008 at 2:00 p.m.
Bid No. 08-10-01, SR AlA/Collins Avenue Streetscape Improvements
City Clerk Jane Hines opened the Pre-Bid Conference. Bill Evans, Assistant Public Works Director,
welcomed everyone and noted that this is a quick turnaround and to get any questions in right away.
He introduced Kathy O'Leary Richards of O'Leary Richards Design Associates, Inc., Landscape
Architecture. She noted that there is a sign-in sheet going around and to be sure to sign it as this is a
mandatory pre-bid conference. Whoever has not picked up plans yet, can pick them up tomorrow
after 12:00 p.m. from the City Clerk's Office.
Deadline for submission of bid documents is Monday, December 8, 2008 at 11:30 a.m. at which
time those sealed bids will be publicly opened. Any additional questions are required to be in
writing and may be submitted up to four (4) days before the bid opening (at the close of business,
Thursday, December 4, 2008), which will be answered and forwarded to all oftoday's participants.

Ms. O'Leary Richards introduced the Project Team: Christopher Cawley, Landscape Architect, with
O'Leary Richards Design, Inc., and Ramon Tesone, Civil Engineer, with Alvarez Engineers, Inc.
She noted that this project is State Road AlA Collins Avenue from 187th Street to the William
Lehman Causeway. It is a streetscape project and includes the installation of new paver sidewalks,
roadway lighting which is going to replace the existing cobra heads, landscape lighting, electrical
work and irrigation. The project is on the west side of Collins A venue in front of the retention areas
between 187th Street and William Lehman Causeway. We are also enhancing the landscape at the
intersection of Sunny Isles Boulevard and Collins A venue in the retention area, as well as in the
medians at that intersection.
This is a unit price bid and the bid award will be based on the bid price, as well as the capacity and
skill ability of the bidder to perform the work. On page 66 of the Bid Documents there is
information regarding Liquidated Damages as well as an Incentive Bonus that the Contractors should
review. There is a one and a half (1~) year warranty date from final acceptance. This is a FOOT
project located within an FOOT right-of-way, and we are in the process of obtaining a permit from
FOOT. These technical specs as well as the FOOT Design Standards, dated January 2008, and
FOOT Standard Specifications dated 2007 as amended by contract documents, shall be treated as
though incorporated herein.

of documenting design quantities and measurements. The FOOT pay item numbers are referenced in
the Bid Form and on the plans. In lieu of a lump sum unit price for the landscape items which is
standard for FOOT, we are asking for a unit price breakdown. In the Bid Form, the Date Palms are
broken down into three (3) items: 1) Furnish, deliver and unload the Date Palm on site; 2) Unit Price
for Labor to install the Date Palm; and 3) an I8-Month Warranty, and so we would like a unit price
for each of those items to equal one Date Palm.
The Contract time is 180 calendar days and substantial completion is to be completed in 150
calendar days. This is a time sensitive project because we are tied to a grant that is being provided.
by Miami-Dade County and FOOT for landscape work. You will note in the Specifications that we
are asking the Contractor to complete the planting, irrigation and landscape lighting behind the
retention areas on the north and south sides of 189th Street as well as the planting, irrigation and
paver sidewalk work on the east side adjacent to the William Lehman Causeway ramp, which is
away from the streetscape work, prior to the work along the street on the west side of Collins
A venue. The existing cobra head lights are going to have to stay up until we are able to get the new
lights installed at the same time because we cannot go without lighting on State Road AlA. The new
decorative light poles will have a longer lead time than other items.
The insurance requirements are as follows: General Liability, Two Million Dollars ($2,000,000)
Business Automobile Liability, One Million Dollars ($1,000,000), and Workman's Compo A
Payment Bond and Performance Bond are required. Please note that the Technical Specs
incorporated in this document are also supplemented by the FOOT Standard Specifications and the
more stringent as defined by the Consultant shall apply. We have included Technical Specifications
for the landscaping, architectural pavers, landscape lighting, irrigation and the existing tree
relocation which is more stringent than the FOOT specifications. For all the roadway work, lighting
work, etc. refer to the FOOT Standard Specifications.
Ramon Tesone said that we are requesting two (2) additional light poles be delivered to the Miami-
Dade County yard for maintenance purposes. The (2) additional light poles are not to be installed but
the Contractor shall coordinate with Garfield Perry of Miami-Dade County for delivery of these two
(2) additional decorative light poles.
Ms. O'Leary Richards said there are several underground utilities within the right-of-way and are
actually planting Date Palms on top of a fiber optic that is quite deep. We already have utility test
holes that have been performed which are reflected in the Roadway Plans. She wanted them to be
aware that there are utilities and that is one of the reasons why you have to wait to plant the Date
Palms at the end of the Project on the west side because we have the existing street lights and
underground in the same location as the proposed Date Palms. There is going to have to be
coordination.
QUESTIONS AND COMMENTS FROM PROSPECTIVE BIDDERS
1. So we have a variance to plant over the fiber optic, correct?
We have been in contact with Fiber Optic.
(A variance is not needed and we are planting above the fiber optic cable which is
approximately 8' deep).

2. What is the budget for the job? The reason we asked was for the bonding companies, the
nature of contractors is we won't have our prices tight until 2 or 3 days before, we just
wanted a guess.
That number was not supplied in the documents, and so we are not going to supply that
number at this point in time.
3. You mentioned a pay scale by FOOT, is that related to Davis Bacon or is that separate?
No, what they are referring to is the itemization that is set up in the FDOT
Specifications. It has nothing to do with the wage schedule on this Project. It is in the
2009 Basis of Estimates, you can find it on line on FDOT's website.
4. Okay so it is not related to Davis Bacon, because DOT is federal and usually it kicks you out
into that bracket into that applicable fee schedule in order for it to be included as part of the
breakdown, and that becomes a set fee.
No, not that we are aware of but we will look into that. This is a City Project and we
are obtaining Grant monies for landscaping.
5. Are you exercising your option in requiring a DOT Certified Contractor?
We did not address that. A qualified State of~FloridaJ~icensed'General~Contra'Ctor.,Js

6. Who will have final inspection of the streetlights?
Miami-Dade County.
7. Our permits will be pulled with the County, all of our Permits?
Like any regular FDOT project that has lighting, the County has the final word since
they are going to maintain it.
8. So the County has maintenance agreements but it is DOT property?
Yes. In addition, you will have to pull a permit from DERM for minor tree removal.
9. Based on our experience, the lighting permit will be pulled from the Building Department,
and that is also Miami-Dade County because it is City jurisdiction. You get a Building
Department Permit plus the County.
Yes, that is correct, and that is addressed in the Specs.
10. Any requirement for minority participation?
No, that is left open.
11. Will there be a Permit required for the electrical service point for the irrigation?
Yes, from the City's Building Department. For irrigation, we are tied into an existing
meter, therefore, you do not have to pull a Permit through the City of North Miami
Beach for the water, but you will through the City's Building Department.
12. The City will be inspecting the electrical service point as well as the streetlight system, or

just the County will inspect the streetlight system?
Both will do it, the County will have the final say-so, but our Building Department City
Electrician will take a look at it as well, and that permit that you pull will enact them to
go out and take a look at it.
13. The permit that we are pulling from Miami-Dade County?
Correct.
J4. Does the City have Electrical Inspectors along the way because the County usually has final
inspection and that is it.
Yes, we will have a rough and final inspection. We will have an inspector assigned to
the project that you can coordinate your efforts with along with our Project
Management Team.
15. In regards to lane closures and MOT, just by the book for DOT Specs or do you have
superseded specs on that?
It would be DOT standards, even though you are free to modify the standard if you see
a better way to keep the traffic flowing.
16. The work in the right-of-way, is there any time restrictions on that?
That is not addressed.
17. Typically it is 9:00 a.m. to 3:00 p.m.
Yes, that is typical.
18. You don't have the FDOT Permit in yet?
No, but they have reviewed it, and we should be getting that permit very shortly.
19. It is their road, right?
That is correct but there are portions of this Project that are outside of their right-of-
way, behind the Retention Area on the south side of 189tb Street. A portion of that is
City property.
20. Does FDOT impose restrictions at the time they issue a permit?
Yes.
21. Will that be available before bid time?
Weare not certain of that.
22. Would you be allowed to work weekends?
It will be on a case-by-case basis, we will see.
23. FOOT closes one lane, the inside lane?
Yes, FDOT will approve that permit but our standard and our requirement here in the
City is if you are going to close a lane, you will have to hire an off-duty Police Officer
which needs to be incorporated into your MOT. There will be a pre-job meeting, a pre-

lane closure meeting held here at the City, we will go over what your request is, and
that permit will be approved based on availability of an Officer, what is going on at the
City, what Public Works staff availability is to have people staffed there, etc., so we will
take all of those into account before we will say you can close it on a weekend, close it
Monday through Friday, etc.
24. Are there requirements to hire off-duty Police Officers?
Yes, that is a City requirement.
25. During week days at all times, correct?
Yes.
26. Can you disclose the hourly rate for off-duty Police Officers?
There is a form from the Police Department that discloses that rate. We will provide
that to you.
27. Is it exclusively Sunny Isles Beach Police Officers?
No, it is up to the Sunny Isles Beach Police Department. If they don't have Police
Officers available, than they will go to outside jurisdictions and ask for their help.
Ms. O'Leary Richards noted that the City of Sunny Isles Beach puts a lot of money into
their landscape and we are going to expect top-notch quality on your landscape
material and. workmanship.
28. You mentioned that there were some time constraint grant issues that are ahead for funding
part of the project, we can assume that there won't be additional time put into the bid
process. December 8, 2008 is the deadline, right?
There are no plans at this point to extend the bid.
Ramone Tesone noted that we are including about 844 square yards of a base optional,
which is the item for Iimerock is to be constructed under the existing sidewalk, but that
might save the project money if you find out that particular Iimerock is suitable to have
the pavers on top. So you will be required to. rmd out through the AASHTO T99
Density Test, as shown in note 285-704. If it is suitable to place the pavers on top YOll
will not need to replace that Iimerock.
29. Does the contractor or the City pay the proctor fees?
That would be up to the contractor.
30. When will the construction start?
We would like to get started in January 2009.
31. Are the utilities listed in a good description of what we will be up against or might there
always be more, is there any inside you can give us on the degree of difficulty with respect to
conflicts and things like that?
We made it construct-able as far as obtaining all the information available. Hopefully

there is nothing else, but there is always a possibility.
When you submit your bid documents just make sure they are not bound or put in 3-
ring binders, just clip them. Those of you who do not have your sets, they will be

32. Can we get the sign-in sheet along with the Summary Minutes and Off-Duty Police Officers
pay rate scale?
Yes, these documents will be posted on Demand Star.
33. Will you have the bid documents on CD?
No.
34. Is there a Formula as to how you will rate contractor's experience and recommendations with
regards to pricing, or is that just an intuitive thing and you do it in-house?
In-house, and there is an in-depth questionnaire in the bid specs that you have to fIll
out. We take all that into consideration, past work, past performance, etc.

$48.00 per hour
The fee covers the payment to the officers in addition to mandatory cost of
workmen's compensation, contributions to the Florida Retirement System,
Medicare, social security and other administrative fees.
Police Supervisor
$52.00 per hour
3 or more officers require a supervisor or designated supervisor.
The fee covers the payment to the officers in addition to mandatory cost of
workmen's compensation, contributions to the Florida Retirement System,
Medicare, social security and other administrative fees.
Any Extra Duty details that fall on a city observed holiday will be
billed at the rate of $72.00 per hour.

8 hours prior to the start time of the detail.
There is a 3 hour minimum on all details.
Payment Terms:
For single day details, payments must be paid in advance for the entire detail
term. Payments must be in form of: Personal/Certified / Cashiers Check or
Money Order. All payments should be received at least 5 days in advance unless
other arrangements are agreed upon.

Question from Arazoza Brothers. Corp.:
1. I was reviewing the quantities on the bid schedule versus the plans and found a
difference in quantity for the Phoenix roebelinii (Pygmy Date Palm). The bid
schedule calls for 20 and the plans show a quantity of 35. Will a new bid
schedule be issued orwould you like us to just cross it off and correct it? Thank
you for your time and have a great day.
There are (20) Phoenix roebelinii on the Bid Schedule as well as the plan. We do not
see the discrepancy. We noticed a typo on one of the plan sheets and have added Item
#3 to the Addendum (see pg. 1 of this document).
Questions from Vila and Son:
1. Page L-4 Is it necessary to concrete encase boxes that are in grass area what is
the dimension of concrete collar?
Page L-4, the concrete slab is 5'-0" x 5'-0", per FDOT Standard Index 17500,
sheet 2.
2. Page L-16 Are we using spread foundation as shown on our project / all poles
are in grass covered areas?
Page L-16, all proposed poles have a spread foundation per sheet L-16. The
poles are located in the proposed sidewalk.
3. L-5 Note is requiring to remove existing pole. Do we do anything with concrete
pole base?
Page L-5, the base as well as all salvageable materials are to be delivered to
Miami-Dade County Traffic Signals and Signs Division, per general note 9 in
sheet L-3. Note that Pay Item 715-4-600, Light Pole Complete (Remove), refers
also to the concrete foundation that is to be removed and disposed of properly
for all the existing poles removed.

4. L-17 There is not one line diagram for PNL-B it is not clear what is controlling
lighting contractors and Manual Disconnect is specified as 100A Circuit breaker
and Heavy duty Disconnect. Could we use any of these options for Disconnect?
Page L-17, a diagram for the panel will be provided in a plan revision. For
bidding purposes, the circuit breaker needs to be rated for 100 amps.
Question from ValleyCrest Landscapina Development:
1. RFI clarifying if item # 715-11-119 requires a concrete foundation, I would
appreciate it. The pay item note for this item at states "Includes the fi?cture,
luminaire, lamp, ground spike, mounting, foundation and any other material
necessary for a finalized installation." Although it states "foundation" there is no
detail of any foundation associated with this item. Typically foundation means
concrete, but I haven't seen any concrete detail.
The decorative light specs do not show a concrete foundation, and it is not
needed. Sheet LD-24 shows gravel to be placed around in-ground light fixture.
Install per manufacturer's instructions.
2. Is the company that is presenting a bid required to be verified on the State of
Florida website and to be listed as a Company General Contractor, or can
individual GC's bid on the project?

WEEKLEY ASPHALT PAVING EXPERIENCE
Weekley Asphalt Paving, Inc. (WAP) was established in 1947 by William D. Weekley as a paving
company. In 1957, WAP purchased an asphalt plant and began manufacturing asphalt for sale to other
companies and for its own projects. In 1979, management of WAP was assumed by Mr. Weekley's three
sons, Daniel, Troy and Wayne. Within the next five years, the Weekleys became a complete road
builder adding concrete work and bridge construction to the company resume.
"'!AP has over the last two decades become one of Florida's primer road builders performing private and
commercial work. Our local clients include:
· Florida Department of Transportation
· The City of Miami
· Miami-Dade County
· Broward County
· Palm Beach County
· The City of Boca Raton
. The City of Fort Lauderdale
and almost every other county, municipal, city and government agency in the state. These agencies
comprise approximately $60,000,000 of work awarded to WAP on a yearly basis.
WAP is Florida Department of Transportation (FOOT) certified in bridge construction, grading, drainage,
paving, fencing, guardrail, landscape, roadway signage, etc. and has an FOOT maximum capacity rating
that exceeds $150,000,000 at present. WAP is also a State of Florida General Contractor.
Our management staff is experienced in asphalt paving, road, bridge, drainage and landscape
construction. This expertise results in our clients receiving high quality work delivered on or before
contract time, problem solving skills, identifying associated disciplines that may be required to complete
contracted work and/or address unforeseen conditions, rapid responses to requests for price proposals
and a cooperative partnership work ethic that benefits all.

Mr. Keene has been working for Weekley Asphalt
Paving, Inc. since 1969. Began his career with the
company working as a laborer on the asphalt crew
for 2 years, promoted to foreman where he
supervised a crew for more than 20 years paving
