HomeMy WebLinkAboutReso 2007-1137 RESOLUTION NO. 2007--D3-7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ADOPTING AND EST ABLISHING NON-AD VALOREM SPECIAL ASSESSMENTS ON PROPERTY ON ATLANTIC ISLE BENEFITED BY THE CONSTRUCTION OF SANITARY SEWER IMPROVEMENTS AND ASSOCIATED ROAD RESTORATION; INCORPORATING RECITALS; DESCRIBING THE SANITARY SEWER IMPROVEMENTS AND ROAD RESTORATION; ESTIMATING THE COSTS OF IMPROVEMENTS AND THE PORTION OF SUCH COSTS TO BE INCLUDED IN THE SPECIAL ASSESSMENTS; DESIGNATING THE BENEFITED AREA AND LANDS TO BE ASSESSED; PROVIDING FOR COLLECTION OF THE SPECIAL ASSESSMENTS; PROVIDING THAT, UPON ADOPTION, SUCH SPECIAL ASSESSMENTS SHALL BE A LIEN UPON THE PROPERTY ASSESSED; PROVIDING FOR THE EFFECT OF ADOPTION OF THE FINAL ASSESSMENT ROLL; DIRECTING THE CITY CLERK TO RECORD THE ASSESSMENTS IN THE IMPROVEMENT LIEN BOOK; PROVIDING FOR ADJUSTMENT OF ASSESSSMENTS, IF NEEDED, UPON COMPLETION OF THE IMPROVEMENTS; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission (the "Commission") of the City of Sunny Isles Beach, Florida (the "City") has considered the advisability of certain improvements to benefit property on Atlantic Isle and the funding of such improvements; and WHEREAS, on June 21, 2007 at a regularly scheduled meeting, the Commission adopted Resolution No. 2007-1115 containing a declaration of the City's intent to adopt and impose special assessments to fund a portion of the cost of constructing sanitary sewer facilities and associated road restoration on Atlantic Isle, and adopted Resolution No. 2007-1116 providing for notice by publication and by mail and setting July 24, 2007 as the date for the equalization hearing on the proposed assessments; and WHEREAS, pursuant to the provisions of Chapter 170, Florida Statutes, and Resolution Nos. 2007-1115 and 2007-1116, the preliminary assessment roll, assessment plat and plans and specifications for the sanitary sewer improvements and associated road restoration have been available for inspection by the public in the office of the City Clerk; and Page 1 of 14 WHEREAS, pursuant to the provisions of Chapter 170, Florida Statutes, and Resolution Nos. 2007-1115 and 2007-1116, Resolution No. 2007-1115 has been published, and notice of the proposed assessments and the equalization public hearing has been provided by mail and by publication; and WHEREAS, at a public hearing on July 24, 2007, and the Commission heard and considered comments and objections of all interested persons; and WHEREAS, the City Commission has determined that imposition of special assessments to fund a portion of the cost of providing sanitary sewer improvements and associated road restoration to benefit and serve properties located on Atlantic Isle is reasonable and appropriate and in the interest of the public health, safety and welfare; and WHEREAS, the City Commission has determined that the assessments adopted pursuant to this Resolution are based upon special benefit to each assessed property and that the total assessment imposed on each parcel is reasonable, appropriate and does not exceed the special benefit to be provided by the sanitary sewer improvements and associated road restoration; and NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The recitals contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Description of Improvements on Atlantic Isle. The City Commission (the "Commission") of the City of Sunny Isles Beach, Florida (the "City") has determined that construction of certain capital improvements benefiting property on Atlantic Isle (also known as Atlantic Island) is advisable and in the public interest. The improvements contemplated by the City include sanitary sewer and associated pavement restoration of Atlantic Avenue, water main improvements, drainage improvements, and under grounding of existing utilities. The total estimated cost of these public improvements is over $4,000,000, with $2,018,823.40 of that total estimated for construction of the sanitary sewer improvements and associated pavement restoration. All of these improvements provide substantial and special benefit to properties on Atlantic Isle, but the City is levying non-ad valorem special assessments to fund only $1,009,000, not including interest, of the sanitary sewer improvements and associated road restoration costs. The remaining costs of the public improvements will be funded by the City from other lawfully available revenue or by other entities. Section 3. Estimated Cost of Improvements to be Funded by Special Assessments. The estimated cost of improvements to provide sanitary sewer service to property on Atlantic Isle, including associated road restoration, is $2,018,823.40. Such improvements include, but are not limited to, collection lines, force main, laterals, pump station, associated road restoration and other associated improvements. Of this estimated project Page 2 of 14 cost, $1,009,000, not including interest, is to be funded by special assessments imposed on benefited property as shown in the Final Assessment Roll attached as Exhibit A. Section 4. Benefited Area. The City hereby determines that the levy of non-ad valorem special assessments is needed to fund a portion of the cost of providing necessary sanitary sewer improvements that provide special benefit to property on Atlantic Isle. With the adoption of this Final Assessment Resolution, the City hereby imposes a special assessment on all lots and lands on Atlantic Isle specially benefited by the sanitary sewer improvements through the provision of sewer lateral connections. The sanitary sewer improvements will provide special benefit to all lots and lands on Atlantic Isle capable of being served by the sanitary sewer improvements. Each lateral sewer connection that will provide or is capable of providing sanitary sewer service to the assessed property is the measure of benefit, or Benefit Unit, used to calculate the special assessments for each benefited parcel. The method of calculating the special assessments is detailed in the Atlantic Isle Special Assessment Methodology Report, dated July 16, 2007, which report shall be available from the City Clerk. The special benefit provided by the sanitary sewer improvements is hereby determined to be equivalent to the number of lateral sewer connections constructed for each lot or parcel as shown in the Final Assessment Roll attached as Exhibit A, as may have been adjusted by the Commission based on evidence and testimony provided at the equalization hearing. Section 5. Collection of Special Assessments. With adoption of this resolution, the City imposes non-ad valorem special assessments on all benefited property on Atlantic Isle for assessed costs of $1,009,000, not including interest, which is only a portion of the cost of the sanitary sewer improvements. The assessed costs of $1,009,000, not including interest, shall be collected through special assessments imposed by the City for the sanitary sewer improvements. The special assessments shall be payable as shown in Exhibit B to this Resolution, with the initial payment to be billed after completion of the planned sanitary sewer improvements anticipated in late 2007 or in 2008. The assessment may be billed annually by the City directly to each property owner or may be included on the annual property tax bill pursuant to the Uniform Assessment Collection Act upon fulfillment of additional requirements in Section 197.3632, Florida Statutes. Subsequent installments of the special assessment shall be due annually. The special assessment, including interest accrued to date, may be prepaid in full at any time after construction of the improvements. Upon failure of a property owner to pay any annual installment due, or any part thereof, or any annual interest upon deferred payments, the City shall cause to be brought the necessary legal proceedings to enforce payment thereof, with interest and penalties, together with all legal costs incurred, including reasonable attorney's fees, to be assessed as part of the costs, and in the event of default in the payment of any installment of an assessments, or any accrued interest on said assessment, the whole assessment, with the interest and penalties thereon, shall immediately become due and payable and subject to foreclosure. In the foreclosure of any special assessment service of process against unknown or nonresident defendants may be had by publication, as now provided by law in other chancery suits. The foreclosure proceedings shall be prosecuted to a sale and conveyance of the property involved in said proceedings as now provided by law in suits to foreclose mortgages; or, in the alternative, said proceedings may be instituted and Page 3 of 14 prosecuted under chapter 173, Florida Statutes. If the City chooses to collect the special assessment on the annual tax bill pursuant to Section 197.3632, Florida Statutes, collection may be as provided for the collection of unpaid taxes or any other authorized method. Section 6. Lien Upon Property. Upon adoption of this Final Assessment Resolution and Roll, the total special assessment, including projected interest, attaches to the property included on the Final Assessment Roll, as shown in Exhibit A to this Resolution, and shall constitute, and shall remain until paid, a first lien against the assessed property coequal in rank and dignity with the lien of all state, county, district and municipal taxes and other non-ad valorem assessments. Except as otherwise provided by law, such lien shall be superior in dignity to all other liens, titles and claims, until paid. Section 7. Effect of Adoption of Final Assessment Roll. The Final Assessment Roll for the Atlantic Isle sanitary sewer special assessments, attached hereto as Exhibit A, as approved and confirmed by this Resolution shall be competent and sufficient evidence that the assessment was duly levied, that the assessment was duly made and adopted, and that all other proceedings adequate to the adoption of the assessment roll were duly had, take, and performed as required by Chapter 170, Florida Statutes, and no variance from the directions in Chapter 170, Florida Statutes, shall be held material unless it be clearly shown that the party objecting was materially injured thereby. Any informality or irregularity in the proceedings in connection with the levy of the assessments shown on the Final Assessment Roll shall not affect the validity of the special assessment or the Final Assessment Roll as confirmed by the Commission by adoption of this Resolution. The adoption of this Resolution shall be the final adjudication of the issues presented (including, but not limited to, the determination of special benefit and fair apportionment to the Assessed Property, the method of apportionment and assessment, the rate of assessment, the Assessment Roll and the levy and lien of the Assessments), unless proper steps shall be initiated in a court of competent jurisdiction to secure relief within 20 days from the date of adoption of this Resolution. Section 8. Directive to the City Clerk. Upon adoption of this Resolution, the City Clerk is hereby directed to record the assessments in a special book, to be known as the "Improvement Lien Book," and the record of the lien in this book shall constitute prima facie evidence of its validity. Section 9. Adiustment of Assessments. Upon completion of the sanitary sewer improvement and associated road restoration, the City shall credit to each of the assessments the difference in the assessment as originally made, approved, and confirmed and the proportionate share of the actual cost of the improvement to be paid by special assessments as finally determined upon the completion of the improvement, but in no event shall the final assessments exceed the amount of benefits originally assessed. Section 10. Authorization to City Manager. Upon adoption of this Resolution, the City Manager is hereby authorized to do all things necessary to effectuate the provisions of this Resolution. But they were too late. The prepaid enrollment period ended in January. So thousands of parents who enrolled after that will be sub- ject to a new state l.,w that allows the University o( flor- ida, Florida State and the Uni- versity of South Florida to ~gin charging an escalating tuition premium beginning in fall 2008 that will eventually increase tuition by about $1.000 a year. The law appeared to open a window of opportunity to avoid the increase, and left some parents confused, The law stated that parents enrolled in the program by July I would Dot be subject to the additional charges, Gov, Charlie Crist signed the legis- lation June 27, leading some parents to believe they had three days to sign up and avoid the premium. Virginia Trujillo signed up June 28 on behalf of her 7-month-old son, after read- ing about the new law in a Miami Herald article. An additional 375 parents around Florida aho signed up between June 27 and July I, according to prepaid college plan statistics, That is an increase of 156 from the same period last year.
