A Florida corporation that provides unarmed security guard servIces. 9.19 NONE 9.20 NONE 9.21 LITIGATION HISTORY · A 2004 Contract to provide event cleaning services to the City of Miami's Orange Bowl Stadium, Bayfront Park and Coconut Grove Convention Center was awarded to SFM Services, Inc. At that time the Federal Minimum Wage was $5.15 per hour and the SFM's billing rate to the City was $9.90 per hour. · On April 29, 2005, the State of Florida Minimum Wage went into effect and SFM's hourly pay rate was raised accordingly from $5.15 per hour to $6.15 per hour. The City of Miami purchasing department raised SFM's billing rate to the City to $11.13 per hour to accommodate the increase in SFM's hourly pay rate to its staff. · In October 2006, the City of Miami passed an ordinance to pay "living wages" of $11.83 per hour. SFM's staff anticipated this pay rate, and asked Glenn Marcos, City of Miami's Procurement Director about paying living wages, and he indicated that it did not apply to SFM's contract since it pre-dated the living wage ordinance. This question was presented to Mr. Marco's a second time due to pressure from our staff and the same answer was given as before: "no, it does not apply since your contract was executed before the living wage ordinance and living wage ordinance only applies to contracts executed after 10-01-06," · A class action lawsuit ensued against SFM Services, Inc. represented by Jose Rodriguez, Esquire on behalf of our employees and Florida Legal Services, Inc. On advice of my attorney, George McArdle, we joined the City of Miami as a third party defendant. · A subsequent meeting was held in Glenn Marco's office with my attorney present and Glenn admitted to having made the mistake of relying on a copy of the first reading of the living wage ordinance and that on the 2nd reading someone added the words "and to include contract renewals". . As of 4-01-07, SFM paid all employees performing under this contract the living wage. However to this day, the City has refused to adjust our contract accordingly. In light of this fact, I settled the class action lawsuit and paid out of pocket the differential due to the living wage ordinance from 10-01-06 to 3-31-07 which amounted to $85,000.00 plus $12,000 legal fees to Jose Rodriguez. . Unlike the Orange Bowl, Bayfront Park did the right thing and adjusted our billing rate to reflect the living wage in the hourly rate and in the after cleaning which is a flat fee. See attachment "Bl and B2". How can one facility do the right thing and the other facility not, while both are under the same contract? . On September 28th, 2007, The City Manager presented Amendment No.4 to our contract which does address the living wage from that date forward, but does not reimburse SFM for the prior additional amounts paid by SFM due to the application of the living wage ordinance. . I have taken it upon myself to present these facts to each commissioner and request that these monies owed to SFM be paid in an expeditious manner as per our attached demand letter. We are not asking to increase SFM's profit in on any way due to the increased costs (which SFM could not under any circumstance have foreseen). We are merely asking that the direct costs incurred by SFM from the enactment of the living wage ordinance by reimbursed to SFM, while SFM's profit level (on an absolute basis) remains the same. . SFM has suffered economically and is presently suffering a hardship due to honoring my contractual obligations with the City of Miami. Our reputation was harmed by the class action lawsuit. . This matter was brought in front of the City of Miami Commission and they unanimously voted to pay SFM for services rendered and partially pay for legal fees incurred. ". . SFM SAFETY PROGRAM To assist in providing a safe and healthy work environment for employees, clients and students, SFM Services, Inc has established a workplace safety program. This program is a top priority for SFM Services. The Human Resources Department has the responsibility of implementing, administering, monitoring and evaluating the safety program. Its success depends on the alertness and personal commitment of all. When new employees are hired, they watch training videos with all safety procedures. Signed verification forms of them having seen a video before they start working is kept in their file. Several of SFM' s management is also certified in Maintenance of Traffic SFM Services provides information to employees about workplace safety and health issues through regular internal communications channels such as supervisor-employee meetings, bulletin board postings, memos or other written communications. Employees and supervisors receive periodic workplace safety training. The training covers potential safety and health hazards and safe workplace practices and procedures to eliminate or minimize hazards. Each employee is expected to obey safety rules and exercise caution in all work activities. Employees must immediately report any unsafe condition to the appropriate supervisor. Employees who violate safety standards, who cause hazardous or dangerous situations, or who fail to report, or, where appropriate, remedy such situations, may be subject to disciplinary action up to and including termination of employment. SFM has a Safety Committee Organization as a management tool to recommend improvements to our workplace safety program and to identifY corrective measures needed to eliminate or control recognized safety and health hazards. Management will give top priority to and provide the financial resources for the correction of unsafe conditions. SFM Services is committed to providing a safe, efficient and productive work environment for all employees and for that we have a drug free policy, employees may be asked to provide body substances samples (such as urine and lor blood) to determine the illicit or illegal use of drugs and alcohol. SFM Services while performing investigative background checks which will include the following: · Social Security Number Verification . Criminal History Search (7 years) . Employment Verification · Violent Sexual Offender Registry Search · DMV Records (5 years) . Florida HRS Abuse Registry SFM Services' employees shall have employee history file in duplicates. Files shall contain health checks and annual TB Tests as well as all documented training and development to be in compliance with OSHA. SFM Services has zero tolerance for any type of drug abuse. As part of our "Drug Free Program", monthly random drug tests are performed. Documentation is available for inspection.
