A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING
THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO
EXPEND UP TO SEVENTY-TWO THOUSAND DOLLARS
($72,000.00) FROM THE FEDERAL FORFEITURE (DOJ)
FUNDS FOR THE PURCHASE OF TWO (2) OUTBOARD
BOAT MOTORS, SURVEILLANCE CAMERASIEQUIPMENT
FOR HERITAGE PARK, MOTORCYCLE TRAILER AND
MISCELLANEOUS COMMUNITY POLICING ITEMS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the
request of the Chief of Police to the governing body of a municipality, federally forfeited funds may
be expended if accompanied by written certification that the request complies with the provisions of
the Comprehensive Crime Control Act of 1984; and
WHEREAS, the Chief of Police has submitted a request for the expenditure of up to
Seventy-Two Thousand Dollars ($72,000.00) in federally forfeited funds in compliance with the
aforementioned.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Federally Forfeited Monies. Based on the attached certification, the
Chief of Police is hereby authorized to spend up to $72,000.00 from the established Department of
Justice (DOJ) federal forfeitures account for the purchase of two (2) outboard boat motors,
surveillance cameras/equipment for Heritage Park, motorcycle trailer and miscellaneous community
policing items.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.
PASSED AND ADOPTED this 21st day of April 2011.

Approval, authorizing the Chief of Police to Expend up to $72,000.00
from the Federal Forfeiture (DOl) Funds for the Purchase of Two (2)
Outboard Boat Motors, Surveillance Cameras & Equipment for Heritage
Park, Motorcycle Trailer and Miscellaneous Community Policing Items
RECOMMENDATION:
It is recommended that the City Commission approve the expenditure of partial forfeiture
funds, previously awarded to the Police Department as the result of investigative
participation in forfeiture and seizure cases. These funds are permissible by law to be
spent for purchases of police equipment and other law enforcement activities. It is
requested that we be permitted to utilize up to $72,000.00 of said funds on deposit for
such purpose.
REASONS:
The Sunny Isles Beach Police Department actively participates in DEA and FBI / HIDT A
(High Intensity Drug Trafficking Area) Initiative Groups that conduct numerous ongoing
proactive investigations. One of the benefits of participating in and providing personnel
into high intensity narcotics investigations is the sharing of confiscated proceeds for the
enhancement of law enforcement and equipment.
ADDITIONAL INFORMATION:
Some of the requested equipment includes: new boat motors for the Sunny Isles Beach
Police Boat, purchase of a motorcycle trailer to transport the police motorcycles for
service or special events, installation of a security camera system at a City park and the
purchase of community policing items.
In order to assure adequate and reliable equipment, it is requested that we be permitted to
utilize up to $72,000.00 of said funds on deposit for the attached listed items.
