A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE
CITY MANAGER AND THE CITY ATTORNEY TO NEGOTIATE
A DESIGN/BUILD CONTRACT WITH 4M INVESTORS, LLC. AS
THE PROPOSER TO DESIGN AND BUILD AN UPSCALE
LIFESTYLE CENTER IN GATEWAY PARK CONSISTING OF A
PARK, PARKING GARAGE, AND RESTAURANT(S);
AUTHORIZING THE CITY MANAGER AND THE CITY
ATTORNEY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City desires to have designed and constructed an upscale lifestyle center
consisting of a park, parking garage, and restaurant(s) for Gateway Park on Sunny Isles Boulevard
for the enjoyment of the residents and visitors; and
WHEREAS, on November 18,2010, via Resolution No. 2010-1632, the City Commission
selected 4M Investors, LLC. (RFP 10-10-01) as the proposer to design and build an Upscale
Lifestyle Center consisting of a park, parking garage, aquarium and high end retail shops; and
WHEREAS, on December 16,2010, via Resolution No. 2010-1658, the City Commission
authorized the City Manager and the City Attorney to negotiate agreements with 4M Investors,
LLC. for approval by the City Commission within 60 days; and
WHEREAS, 4M Investors, LLC. has now revised the site plan for Gateway Park, and the
City Commission wishes for the City Manager and the City Attorney to negotiate a new agreement
with 4M Investors, LLC. to design and build Gateway Park and to bring the agreement back to
Commission for approval within 30 to 60 days which is included in a six (6) month period to find a
restaurateur(s) to operate a restaurant(s) within Gateway Park.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and
confirmed as being true and the same are hereby made part of this Resolution.
Section 2. Authorization of the City Manager and City Attorney. The City Manager and City
Attorney are authorized to negotiate a design and build contract with 4M Investors, LLC. for
Gateway Park and to bring it back to the City Commission for approval within 30 to 60 days.
Section 3.
Effective Date. This Resolution is effective upon adoption.
