On behalf of Pi os and Sons Enterprises, Inc., I am pleased to submit this Letter of Intent to the City of
Sunny Isles Beach, Florida in response to the REQUEST FOR PROPOSALS FOR THE REMOVAL,
FABRICATION AND INSTALLATION OF STREET SIGNAGE, RFP NO. 09-06-01, for the fabrication
and installation of signs in accordance with the plans and specifications furnished by the City in the above
captioned Request for Proposal.
Pi os & Sons Enterprises, Inc. is a minority-owned Florida Corporation established in 1989. We provide
General Engineering Contracting Services to public entities, institutions, and private sector clients. We have
over 12 years of current continual successful experience as a sign installation and maintenance contractor in
Dade, Broward, Monroe, and Palm Beach Counties. We have also over 10 years of continual and successful
experience providing Maintenance of Traffic Services for the Florida Department of Transportation District 4 in
Broward, Martin, and St. Lucie Counties.
Pios & Sons Enterprises, Inc. has successfully completed municipal contracts in excess of $20 million.
We not only specialize in sign installation and maintenance, but also in infrastructure construction, underground
utilities, and concrete. We currently hold a license as a general engineering contractor and employ three
Worksite Traffic Supervisors.
We currently have several contracts with the Florida Department of Transportation for the maintenance
and installation of highway signs and Maintenance of Traffic Services. We are also in the final year of a 5 year
city wide decorative street sign replacement program with the Town of Miami Lakes.
Currently we are the contractors for the City of West Palm Beach for traffic sign replacement in the
event of a natural disaster. We have also provided sign installation services for several contractors working

directly with Miami-Dade County and the Florida Department of Transportation. We are also proud to state that
Pios and Sons was the contractor that successfully replaced over 2000 bus stop signs for Broward County
Transit.
Pios & Sons Enterprises, Inc. with Mr. Hector M. Ortiz as president and sole person having financial
interest in the firm had a June 2008 financial statement of revenue of $450,486.00 and a June 2009 statement of
revenue of $1,263,444. Currently Pios and Sons is bonded by an A rated bonding company and qualify for
single bonds of approximately $1 million and an aggregate program of approximately $3 million. We here by
declare that we exceed the minimum insurance requirements and have the financial wherewithal to take on a job
of this scope. We own and operate enough equipment and have the qualified personnel to execute the terms set
forth in the Agreement of the contract.
Pios & Sons Enterprises, Inc. is not only currently a registered contractor with the City of Sunny Isles
Beach but is proud and honored to call The City of Sunny Isles Beach home to its corporate offices. All
applicable documentation including proof of insurances, business tax receipts, and copies of licensure are on
file with the City of Sunny Isles Beach Building Department and can be forwarded to the public works
department upon request. Copies of requested documentation have been provided in this proposal package.
This Letter of Intent binds Pios and Sons, Enterprises to the provisions set forth in the RFP NO. 09-06-
01, and shall remain in effect for a period of no less than 90 days. We also affirm that the prices contained in the
submitted RFP Documents shall also remain in effect for 90 days of the day of submittal. This document also
serves as acknowledgement to the 4 addendums, attached as appendix A, issued by the City of Sunny Isles
Beach, for the above captioned project.

Detailed Cost Proposal
The following price proposal meets the specifications required by the City of Sunny Isles Beach In
section 1.2 and the attached addendums. A sample shop drawing has been provided. All signs conform to the
FDOT Standards and shall be installed using the same specifications outlined by FDOT Design Standards 2008.
Please note that the unit price is for one sign as requested by the City and clarified during the pre-bid
meeting's minutes. Quantities of each sign are to be determined by the City of Sunny Isles and shall be provided
with the notice to proceed. The unit price includes the fabrication of new sign, removal of existing sign,
delivery of old sign to designated area provided by the City, and installation in Right of Way on grass or
concrete. The Unit price also includes warranty against material defects for three years and a warranty against
paint failure for two years.
The unit price for: the fabrication of new sign, removal of existing sign, delivery of old sign to
designated area provided by the City, and installation in Right of Way on grass or concrete: $699.00 EACH.
Attached please find a detailed list of signs currently found west of Collins Avenue from I 741h Street to 193fd

Project TimeJine Synopsis
The project can reasonable be expected to be 95% completed within 65 days of the notice to proceed assuming
no extraordinary weather conditions. The following is a specific task oriented timeline for the removal,
fabrication and installation of the replacement signs for the existing street signs west of Collins A venue from
174111 Street to 193rd Street.

· Fabrication of entire sign assemblies.
· Underground utility locations to be identified to ensure there is no conflict of new sign location.

· Installation of new decorative signs.
· Removal and delivery of old sign assemblies to a designated location provided by the city.

Mandatory Pre-RFP Submittal Conference Summary Minutes
Monday, July 6, 2009 at 9:00 a.m.
RFP No. 09-06-01, Removal, Fabrication and Installation of Street Signs
City Clerk Jane Hines opened the Conference, and Assistant City Manager/Services Jorge Vera
welcomed everyone and introduced City Manager Rick Conner. He gave an overview of the project
noting that there are about 217 existing signs and he asked for a unit price for a sign. This is for the
Golden Shores neighborhood which is the area between l85th Street and 192nd Street, and west of
Collins Avenue as well. The font style that we have is highway.
The deadline for submission of Request for Proposals documents is Monday, July 13,2009, at 9:00
a.m., at which time those sealed responses will be publicly opened. Any additional questions are
required to be in writing and may be submitted up to five (5) days before the opening (at the close of
business, Thursday, July 9, 2009), which will be answered and placed on Demand Star. You may

QUESTIONS AND COMMENTS FROM PROSPECTIVE BIDDERS
I. When you say per unit do you mean per the entire unit? How do we know, for instance if
there is a right turn only sign, do you want a separate price for that?
Yes. Give us the unit price for any size of sign.
2. Are we to quote a price for the entire area?
No, give us the unit price per each size sign, such as a stop sign, a turn left only sign,
etc. There are approximately 217 signs.
3. Is the quote to also include installation?
Yes, the complete package including post, sign, and labor.
4. Will the City waive permit fees?
Yes we will waive the City fees. There may be fees that we are not responsible for, if
there are County fees or State fees, we can't waive those.
5. Who did the installation on the existing signs?
Graph-Plex Sign age.
6. What was the price that Graph-Plex did it for?
That would be a public records request. You can contact the City Clerk's Office for
that information.

10. Is a Bid Bond or Performance Bond required?
We have liability insurance required from the company. Assistant City Manager Vera
will speak with the Legal Department. There is not one currently required but there
may be an addendum added to include it.
11. Wouldn't it be easier if you listed the signs and then they put a number next to it?
We could do that but with your expertise of what we are looking for, we don't know
necessarily which signs require what.
12. Do we include the signs at entrances/exits onto commercial properties?
No, not private signs. Only those in the right-of-way.
13. Do we include Evacuation Signs?
\Ve aren't aware that we have any, but include any existing signs.
14. Does the price include removal of existing signs?
Yes, the price includes the removal of the existing sign.
15. Do you want the old signs, and if you do, where should we deliver them?
Yes, deliver them under the William Lehman Causeway bridge.
16. For the criteria under No.7 (page 3), back of signs to have stickers with proposer's name, is
this FDOT styles?
Yes.
17. What is the timeframe?
The Central Island Project is coming to an end, and so we would like to start putting
these signs up by the end of July or the beginning of August, and we need them up
ASAP. You can propose a time in your proposal and that will be taken into account as
well.
18. Do we have to provide shop drawings?
Yes.
19. Will the decision be made solely on price or will you evaluate other factors?
We will evaluate other factors as well. This City tends to focus on quality, we want a
good price, but we don't want to pay any more than we have to. This isn't about

undercutting somebody by a penny and the quality is half as good, we are not going to
go that way, we are going to pay to get what we want to get. We don't necessarily
accept the lowest bid, we accept the lowest responsible and responsive bidder.
We have been posting this project on Demand Star, and if you provide your email
information we will send you em ails to update you on addendums or anything, but also
keep an eye on demandstar.com and if you haven't used it before, if you sign on to the
site, it makes you think that you have to pay to get on, that is only if you want to put
something on, it is free to access our information. We will put today's sign-in sheet,
questions and answers, and addendums on this site. Make sure you sign the sign-in
sheet as this is a mandatory meeting. If you have a business card, please drop it offto
us.
20. Are the current signs 3-feet into the ground?
We are not sure but assume that they would have to be.
21. Is there any breakaway?
There are very few.
22. The vinyl used, is that in the specs, and what is the time frame?
Don't know if it is in the specs but you need to tell us, again, that is the kind of thing we
are interested in, what is your quality.
Time is important, so put that in your proposal, and understand that it will be put in
the contract and you will be accountable for the time limit.
23. Are you going to be doing it block by block?
That is up to you, whatever best suits you, we just want the job accomplished as quickly
as possible. As long as the .job is done, and done with quality, we will work with you.
24. Will we get a copy of the sign-in sheet?
The sign-in sheet, the questions and answers to today's meeting, and any other
questions/answe.'s will be posted on Demand Star.
25. So just to recap, no bid bond, no performance bond required?
We will let you know. A performance bond seems appropriate at this point but we will
check with the Legal Department on that.
26. When we put the post in, anti-spin, twisting requirements by FDOT standards?
Yes, must meet standards with International Building Code and South Florida
Requirements. You will have to meet all the codes, we will waive the fees for the
permits, but you must still acquire the permit. You will still have to go through the
process, you will have to get approval, it is .just that you won't have to pay local fees,
but again, we can't waive State and County fees.

1. PERFORMANCE BOND
1.1 With the execution and delivery of the Contract, the Bidder shall furnish the following
Surety bonds of the forms contained herein:
a. Performance Bond guaranteeing full and faithful execution of the Work
in an amount equal to 100 percent of the Contract Sum, and including
guaranteed repair and maintenance of all defects due to faulty materials
and workmanship that appear within one year after completion of contract.
1.2 Bonds shall be executed by Surety authorized to do business in the State of
Florida and listed on the latest U.S. Treasury Department list of companies holding
certificates of authority as acceptable sureties on Federal Bonds.
1.3 Bonds executed by an Attorney-in-Fact on behalf of the Surety, shall have affixed
thereto a certified and current copy of Power of Attorney, indicating the monetary
limit of such power.
1.4 Qualifications: As to companies being rated acceptable:
A Performance Bond must be executed by a Surety Company of recognized
standing, authorized to do business in the State of Florida and having been in
business with a record of successful continuous operation for at least (5) years.
In addition to the above - minimum qualifications, the Surety Company must meet
the following additional qualifications.
1. The City will accept a surety bond from a company with a rating of B++ or
better for bonds up to $1 million, provided, however, that if any Surety
Company appears on the watch list that is published quarterly by Intercom
of the Office of the Florida Insurance Commissioner, the City shall review
and either accept or reject the Surety Company based on the financial
information available to the City. A Surety Company that is rejected by
the City may be substituted by the bidder or proposer with a surety
company acceptable to the City, only if the bid amount does not increase.
a. The Surety Company shall have at least the following minimum ratings:

b. All Surety Companies are subject to review and approval by the Owner and
may be rejected without cause. All bonds signed by an Agency must be
accompanied by a certificate of authority to act.
1.5 The Surety Company shall submit verification from the Department of Insurance Office of
the Treasurer stating the surety company's license and certificate of authorization to do business in
the State of Florida.

I. The Contractor and the Surety, jointly and severally, bind themselves, their
heirs, executors, administmtors, successors and assigns to the Owner for the
performance of the Construction Contract, which is incorporated herein by
ref eren ce.
2. If the Contractor performs the Construction Contract, the Surety and the
Contractor shall have no obligation under this Bond, except to participate in
conferences as provided in Subparagmph 3.1.
3. If there is no Owner Default, the Surety's obligation under this Bond shall
arise after:
3.1. The Owner has notified the Contractor and the Surety at its address
described in Pamgraph 10 below, that the Owner is considering
declaring a Contmctor Default and has requested and attempted to
arrange a conference with the Contmctor and the Surety to be held
not later than fifteen days after receipt of such notice to discuss
methods of performing the Construction Contract. If the Owner,
the Contractor and the Surety agree, the Contractor shall be
allowed a reasonable time to perform the Construction Contract,
but such an agreement shall not waive the Owner's right, if any,
subsequently to declare a Contmctor Default: and
3.2. The Owner has declared a Contractor Default and formally
terminated the Contmctor's right to oomplete the oontract Such
Contractor Default shall not be declared earlier than twenty days
after the Contractor and the Surety have received notice as
provided in Subpamgmph 3.1: and
3.3. The Owner has agreed to pay the Balance of the Contract Price to
the Surety in accordance with the terms of the Construction
Contract or to a contractor selected to perform the Construction
Contract in accordance with the terms of the contract with the
Owner.
4. When the Owner has satisfied the conditions of Paragraph 3, the Surety
shall promptly and at the Surety's expense take one of the following actions:
4.1. Arrange for the Contractor, with oonsent of the Owner, to perform
and oomplete the Construction Contract: or
4.2. Undertake to perform and complete the Construction Contmct
itself, through its agents or through independent contractors: or
4.3. Obtain bids or negotiated proposals from qualified
contractors acceptable to the Owner for a contract for
performance and completion of the Construction Contract,
arrange for a contract to be prepared for execution by the Owner
and the oontractor selected with the Owner's concurrence, to be
secured with performance and payment bonds executed by a
qualified surety equivalent to the bonds issued on the
Construction Contract, and pay to the Owner the amount of
damages as described in Paragraph 6 in excess of the Bal,mce of the
Contract Price incurred by the Owner resulting from the Contractor's
default: or
4.4. Waive its right to perform and complete, arrange for completion,
or obtain a new contractor and with reasonable promptness under
the circumstances:
I. After investigation, determine the amount for which it may
be liable to the Owner and, as soon as practicable after the
amount is determined, lender payment therefor to the Owner:
or
2. Deny liability in whole or in part and notify the Owner citing
reasons therefor.
5. If the Surety does not proceed as provided in Paragmph 4 with reasonable
promptness, the Surety shall be deemed to be in default on this Bond fifteen days
after receipt of an additional written notice from the Owner to the Surety
demanding that the Surety perform its obligations under this Bond, and the
Owner shall be entitled to enforce any remedy available to the Owner. If the
Surety proceeds as provided in Subparagraph 4.4, and the Owner refuses the
payment tendered or the Surety has denied liability, in whole or in part, without
further notice the Owner shall be entitled to enforce any remedy available to the
Owner.
6. After the Owner has terminated the Contractor's right to complete the
Construction Contract, and if the Surety elects to act under Subparagraph 4.1,
4.2, or 43 above, then the responsibilities of the Surety to the Owner shall not be
greater than those of the Contractor under the Construction Contract, and the
responsibilities of the Owner to the Surety shall not be greater than those of the
Owner under the Construction Contract. To the limit of the amount of this Bond,
but subject to commitment by the Owner of the Balance of the Contract Price to
mitigation of costs and damages on the Construction Contract, the Surety is
obligated without duplication for:
6.1. The responsibilities of the Contractor for correction of defective
wOlk and completion of the Construction Contract:
6.2. Additional legal, design professional and delay costs resulting
from the Contractor's Default, and resulting from the actions or
failure to act of the Surety under Paragraph 4: and
6.3. Liquidated damages, or if no liquidated damages are specified in
the Construction Contract, actual damages caused by delayed
performance or non-performance of the Contractor.
7. The Surety shall not be liable to the Owner or othen; for obligations of the
Contractor that are unrelated to the Construction Contract, and the Balance of the
Contract Price shall not be reduced or set off on account of any such unrelated
obligations. No right of action shall accrue on this Bond to any person or entity
other than the Owner or its heirs, executors, administrators, or successors.
8. The Surety hereby waives notice of any change, including changes of time,
to the Construction Contract or to related subcontracts, purchase orders and other
obligations.
9. Any proceeding, legal or equitable, under this Bond may be instituted in
any court of competent jurisdiction in the location in which the work or part of
the work is located and shall be instituted within two years after Contractor
Default or within two years after the Contractor ceased working or within two
years after the Surety refuses or fails to perform its obligations under this Bond,
whichever occurs first. If the provisions of limitation available to sureties as a
defense in the jurisdiction of the suit shall be applicable.
10. Notice to the Surety, the Owner or the Contractor shall be mailed or
delivered to the address shown on the signature page.
11. When this Bond has been furnished to comply with a statutory or otller
legal requirement in the location where the construction was to be performed,
any provision in this Bond conflicting with said statutory or legal requirement
shall be deemed deleted herefrom and provisions conforming to such statutory or
other legal requirement shall be deemed incorporated herein. The intent is that
this Bond shall be oonstrued as a statutory bond and not as a common law bond.
12. Definitions.
12.1. Balance of the Contract Price: The total amount payable by the
Owner to the Contmctor under the Construction Contract after all
proper adjustments have been made, including allowance to the
Contractor of any amounts received or to be received by the Owner
in settlement of insurance or otller claims for damages to which the
Contractor is entitled, reduced by all valid and proper payments
made to or on behalf of the Contractor under the Construction
Contract.
12.2. Construction Contract: The agreement between the Owner and the
Contractor identified on the signature page, including all Contract
Documents and changes thereto.
12.3. Contractor Default: Failure of the Contractor, which has neither
been remedied nor waived, to perform or otherwise to comply with
the terms of the Construction Contract.
12.4. Owner Default: Failure of the Owner, which has neither been
remedied nor waived, to pay the Contractor as required by the
Construction Contract or to perform and complete or comply with
the other terms thereof.

To All Bidders:
Bidders for the above-referenced project shall take note of the following changes,
additions, deletions, clarifications, etc. to the Plans and Specifications, which in
accordance with the Contract Documents shall become a part of and have precedence
over anything shown or described otherwise.
1. The aluminum tubing shall be 1.5 inches and not 1 inch as per section 1.2 (4).
2. There is a 3 inch angle at the base of the sign (underground) to prevent twisting.
3. Poles are embedded 3 feet deep in the ground.
