(l " :t ~ .I) ') ~l l '"' On behalf of Pios and Sons Enterprises, Inc., please accept this Letter of Intent being submitted in response to the REQUEST FOR PROPOSALS FOR PROFESSIONAL DESIGN AND BUILD SERVICES FOR A SKA TEBOARD PARK AT TOWN CENTER PARK to be located in the City of Sunny Isles Beach, Florida. Pios & Sons Enterprises, Inc. is a minority-owned Florida Corporation established in 1989 . We provide General Engineering Contracting Services to public entities, institutions, and private sector clients. We have over 20 years of current continual successful experience as a general engineering contractor, specializing in infrastructure construction, underground utilities, site development, and concrete in Miami-Dade, Broward, Monroe, and Palm Beach Counties. Weare licensed as a General Engineering Contractor. Pios and Sons, in conjunction with SITE Design Group, Inc. providing the Skate Park Planning and Design, will not only build out an economically-feasible, aesthetically pleasing skate park, but one that is also environmentally sensitive to the surrounding neighborhood and nearby residences. SITE Design Group, Inc. is a consulting firm specializing in Community Planning, Design and Development, providing services throughout the United States, Europe, and Asia. Their professionally recognized, award winning skate park designs located throughout the United States and abroad exemplify their unmatched ability to understand the complexities of public and private action sports development, regardless of location. Since the urban "skate plaza" replicates real street terrain, Pios and Sons Enterprises has been providing this style of construction for years at these popular types of "illegal skating venues". However, the concrete finish and attention to detail for the metal work, radii, degrees of ramps, etc. is often overlooked and is not built with skateboarding in mind. SITE Design Group's expertise plays a valuable role during the design phase of the project, in conjunction with our 20+ years of construction experience, to produce a successful collaborative effort to build the proposed skate park in the City of Sunny Isles Beach. This type of skate park construction is not necessarily a complicated concept in theory, however, the intricacies and level of detail warrants the quality of construction that Pios and Sons Enterprises has been providing for over two decades. Pi os and Sons Enterprises, Inc. will deliver a cohesive, focused effort over the course of the project to exceed the expectations of the City of Sunny Isles Beach with respect to the construction of the proposed skate park. Pios and Sons has a wide breadth of construction-related experience. It will be brining to the table the expertise of SITE Design Group that includes the expertise in Landscape Architecture, Planning, Urban Design, Parks & Recreation Planning and Design. We bring to the City of Sunny Isles an experienced and knowledge-based company to complete the proposed project in an economical, environmentally sensitive, and uniquely functional, creative manner. Hector M. Ortiz, president of Pios and Sons Enterprises, Inc. has 100 percent financial interest in the company. As of June 2009, revenues for Pios and Sons were $1,263,444. Currently, Pi os and Sons is bonded by an A-rated bonding company and qualifies for single bonds of approximately $1 million and an aggregate program of approximately $3 million. We hereby declare that we exceed the minimum insurance requirements and have the financial wherewithal to accept a project of the magnitude of the one proposed herein. Pios and Sons has the staff as well as the necessary equipment to complete the proposed project and to execute the terms set forth in the Agreement of the contract. Pios & Sons Enterprises, Inc. is not only currently a registered contractor with the City of Sunny Isles Beach, but is corporate offices are located within the city as well. All applicable documentation including proof of insurances, business tax receipts, and copies of licensure are on file with the City of Sunny Isles Beach Building Department and can be forwarded to the Public Works Department upon request. Copies of requested documentation have been provided in this proposal package. This Letter of Intent binds Pios and Sons Enterprises, Inc. to the provisions set forth in the RFP NO. 09- 11-01, and shall remain in effect for a period of no less than 90 days. We also affirm that the prices contained in the submitted RFP Documents shall remain in effect for 90 days from the day of submittal. An overview of the project was given noting that the Skateboard Park would be in the western end of Town Center Park, and the Skateboard Park area is approximately 220 feet long by less than 70 feet wide in the widest area. Weare looking at the interior area, we want to keep the sidewalk in place and use it from the sidewalk in, and that will help alleviate some of the DERM issues with this natural area surrounding it. In addition to that, we want to connect along the northern end of that property, all the way out to Collins A venue to guide the skateboarders in through the east from Collins Avenue. If you go up to the northern part ofthe City as you come off from the William Lehman Causeway, we have created a wider sidewalk and that is the template that we want to create throughout the City. We want to continue that along the eastern portion of the Park running from the north end all the way to the south end. The redesign ofthe entrance is part of the RFP, at the comer where currently the sign is installed. If you go over there, you will see the corner area, redesign that corner area where it meets at Collins Avenue and 172l1d Street. 2. All of that pertains to the design? Yes. 3. You are staying within the budget that you have, do you also include the footprint that you are saying for the sidewalk? The extension of the sidewalk, yes. 4. And also shall include the secondary entrance you are calling for the Skateboard Park? Regarding the sidewalk that is going around it, he worked with some designs in the City a couple of years ago on this project, and he recalls when you are standing inside the grass area and you look over the sidewalk, it is a few feet higher than the grass area, and so he thinks the ideas they were talking about was to cut that berm down for drainage because there is a drain in this area that is way down but they didn't think they could get everything over there and it would cause drainage issues. The berm area is on the outside ofthe Skateboard Park. The inside from the sidewalk in, is really pretty flat. There is a drain there but there is no actual berm. 6. He understands that the sidewalk is at least a couple of feet higher, and so water would actually drain back in. Did it change? Not any more, maybe the sidewalk settled. 7. There is only a drain way down here, and so they said if we made this all concrete it would become a big bathtub because water wouldn't have a place to run off from. You would need to include drainage in your design. -. ., ,..... .. . 8. The exercise stations that are included in the RFP as well to be removed and reinstalled at another place in the Park, is that correct? The Contractor will take them out, and at that time we will decide if we will keep them in the Park or put them in storage. 11. What would be the directives that you give us, to keep them in the proposals? The Contractor will take them out. Design the Skateboard Park just for a Skateboard Park. 12. Is there a designated staging area where they can stage their equipment because there is very little parking area, and also getting concrete trucks, pumps into that area. Is it considered to be the north entrance, and we can temporarily fence that area in. The concrete trucks will break up those sidewalks. We could give you that corner as shown on the diagram, Come in the north end where you are planning to do a ncw entrance anyway. " . :J 13. Is it possible that we can temporarily fence our equipment in? Yes. You can use that area for storage of equipment and for staging. As far as running across the existing concrete pathway, if you break it, you fix it. Also make sure you are aware that there are electrical panels right in thc middle of the north end ofthe Park. 14. Within the parameters of the design, or the intention of the City to provide the skateboard, in all the circumstances that go on around that activity, it requires most probably the implementation of a first aid station, have you considered that? We would like to see in the area where you are coming from the Park into the skateboard area, a kiosk type of place because it would be controlled access. They would have to sign a waiver, maybe pay a fee, we haven't decided yet how that part of it is going to work, but we do need some type of kiosk there, 16. What about the rest like drinking fountains, emergency pullouts, things like this? We would suggest that you put that in your design. 17. In the RFP documents, there wasn't anything for sealed drawings required by the winning contractor or anything about geotechnical work. Is that going to be required? That would be required, what we are choosing here is the team, and from there on, once we pick the team, we will go forward with the working drawings. 18. Okay, but you will need them sealed by Florida? Yes. (see answer in question 19) 19. The budget for $250,000.00, he has worked on some projects where the assumption is to show us what you can do for $250,000.00, and then they award it to someone else who are "low bid", and so it is not a low bid situation, just show us what you can do for $250,000.00, is that correct? City Manager Rick Conner said what we are asking you to do is to come to us, at this point not with sealed drawings, we are asking you to come to us with a concept that shows how you would address the requests that we have made. This is your chance to show a little creativity and give us a nice product within the parameters that we have asked for. In addition to that, it would be very wise if you could give us a break down of the expected range of costs, we are not saying quotes, we are not asking for dollar amounts specifically, the range of quotes that would accompany the different aspects of the project. We can then look at each of your submissions, and say these people were creative, they gave us exactly what we were looking for in a very unique and positive way, and the comparative prices are in the ballpark. At that point we start to limit the field, make choices, figure out who did those things well, and then we start sitting down and talking about specifics, we will short list and get with you and work through that process. Right now we are looking for your best proposal to show us how you would accomplish the goal, creatively, and approximately what the values would be. That is the first step. 20. If you are referring to that area that is very narrow where the sidewalk already is there, is a fence and a fence, if you need to remove a portion of that temporarily to get equipment in and out without encroaching on the property, that would be considered. 21. Do you have specific skills or skater's skills that we need to assign these elements to, those different ranges, are you targeting kids or adults? We are targeting children and beginners, We wanted it to be kind of all encompassing, the professional skater can go out there and use it for fun, but we want it mostly for teens primarily to have a place to go. No competitions. We believe there is a four-foot maximum height on all elements. 22. In reference to our proposal, I assume that the City would be receptive to provide or to propose at this stage substantial architecture, sustainable materials, recyclable reuse of electricity, collection of water, etc? Yes, that is the creative part that the City Manager was referring to earlier. - . - .. ........ . ~ 't 't ") 'l ~ 't ... 't ~ .. ~ 't 23. That would make it a little more expensive at this stage in our industry, but you realize it is the future for us, and so I believe you would be pretty much embracing that line of work. If you put that in your proposal, it would be given consideration. 24. We had requested if you had as-built drawings for surveys for this property. Right now no, we don't have any as-builts for that property or that area. That may sound strange but this was built by someone else and donated to the City, and we have been trying for some time to track down the drawings and have not been able to obtain them. 25. Are there any special permits from the City that are going to be required like a site plan approval of some sort? Also, when this goes to Building, could we anticipate potentially expedited reviews of some sort since it is a City project? Once we have a site plan and we know what we are doing, we will show it to the City Commission for approval, and yes, we will expedite this project through the Building Department. Remember, we don't have any say regarding DERM, we will try to help you with DERM as much as we can. -... ., ..... , -.. ., -.... . .... . ...... . ) No permits will be waived, but the fees for City perm its will be waived. We can't waive DERM or Fire or anybody else. You will be required to conform to all permit requirements, If you stay within the parameters that we set, you won't have any problems with DERM. Once you start encroaching into that area towards the south where we have the mangroves, that will start bringing up problems. 26. Is there going to be a need for any sort of power sources, lighting? We do plan on keeping the Park open until 9:00 p.m. and so please incorporate lighting in your design. There is some lighting there now but it would not be sufficient for this. Because parts of the requirement placed on the surveyor will be yours, what we would suggest is that you show that as part of your submittal, and again, say this is a segment that we would require and this is our estimated cost.
