Legal Description: A portion of Lot 11 of Second Revised Plat of Bella Vista Subdivision, according to the plat thereof, as recorded in Plat Book 50, at Page 76 of the public records of Dade County Florida. XI. Code Section In analyzing a variance request, Florida Courts have held that a legal hardship will be found to exist only in those cases where the property is virtually unusable or incapable of yielding a reasonable return when used pursuant to the applicable zoning code. The City's Land Development Code provides that a variance shall be granted only where competent and substantial evidence presented in the particular case shows that all of the following are met: Section 265-15 Standards of Review for Variance Requests: (1) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are NOT applicable to other lands, structures or buildings in the same zoning district and deny all reasonable economic return; (2) The special conditions and circumstances do NOT result from the actions of the petitioner; Z2009-04/CH 5 One Netanya Centre (3) Literal interpretation of the provisions of these LDRs deprives the Applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this zoning ordinance and works unnecessary and undue hardship on the Applicant; (4) The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs; (5) Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district; (6) The variance, if granted, is the minimum variance that makes possible the reasonable use of the land, building or structure. (7) The grant of the variance is in harmony with the general intent and purpose of these LDR's, is not injurious to the neighborhood or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. Under Section 265-15 a variance shall be granted only where competent and substantial evidence demonstrates that the Applicant has satisfied all the requirements for the grant of a variance. XII. Planning Analysis The proposed development is consistent with the Town Center Land Use designation of the City's Comprehensive Plan. The Town Center is intended to be a moderate to high intensity design- unified area which will contain a concentration of different urban functions integrated both horizontally and vertically. The project proposes an office and retail use on the property. XIII. Zoning Analysis The subject property is located in the Town Center Sunny Isles Center Sub-District. The intent of the Sunny Isles Center Sub-District setback and height variance requirements is to preserve the existing view corridors for residents to the North and South of such districts and to avoid creating a canyon affect by controlling the height of buildings on either side of East and West bound lanes of Sunny Isles Blvd. This district also encourages office space development and the assembly of small parcels into larger parcels which in turns allows the developer to increase density and intensity. This is the first project in this Center Sub-District since the enactment of the Town Center category and as such, is the first project to request variances specifically pertaining to the Sunny Isles Center Sub-District requirements. The subject property is located west of an existing self- storage 4 stories building, 48 feet in height. The property directly west of the subject property is owned by the Florida Department of Transportation (FDOT) and is used for storm drainage for the immediate area. To the North and South of the property are the East and West right of way lanes of Sunny Isles Boulevard. The Applicant claims that due to the relative narrow width of the property, they cannot design a building that would allow reasonable use of the property without the requested variances. Z2009-04/CH 6 One Netanya Centre Staff acknowledges the requested variances are a result of size of lot. The proposed development has satisfied all the requirements of the Land Development Regulation except for the requested variances. The size of the lot does not allow an optimum design of a parking garage and tower, without the requested variances the parking pedestal only exceeds the permitted lot coverage by 9% or 1,935 sq. ft and the setback for the pedestal and tower is in harmony and do not create a detriment to adjoining properties. The Applicant has made every effort to provide a development compatible to other developments in the area. Additionally, the Applicant is purchasing twenty four (24) parking spaces for $264,000.00 pursuant to the Public Parking Bonus Ordinance 2009- 334. XIV. Conditions Conditions to be completed before below grade or building permits are issued. (1) The Applicant shall submit any and other documentation and payments required by the City to effectuate the transfer of development rights (if applicable) and further procedures being developed to effectuate this program, notwithstanding the fact that such procedures may be formally adopted subsequent to this particular approval, prior to submitting for building permit. (2) Upon the submittal of an application for building permit, the plans submitted shall meet with the approval of the Planning and Zoning Administrator and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor" in accordance with Ordinance 2003-167 adopted March 20, 2003; the Applicant shall be required to obtain another approval of the City Commission. (3) That a plot plan be submitted to the Planning and Zoning Administrator, landscape Architect and Planning Consultant including their in-house experts, for their review. (4) Prior to issuance of a building permit, the Applicant shall provide a signage and marking plan and identify all proposed signs and pavement markings for the site either on the signage plan, or the site plan. PLANNING & ZONING DEPT. Ref: 323 Sunny Isles Blvd., Sunny Isles Beach, FL 33160 Arie Sunny Isles Inc. Letter of Intent for Variances Dear Planning & Zoning Department Staff, & Board Members, This is a letter of intent requesting the following variances for the above project: I. Set Backs: Pedestal to property line: a. Front South: 0'- 0" is provided where 20' - 0" is required. b. Rear North: None required c. East Side: 0' - 0" is provided where 10'- 0" is required. d. West Side: 0' - 0" is provided where 10'- 0" is required. Pedestal to tower: a. Front - South 10'- 0" is provided where 20 ft. is required. b. Rear - North 15'- 0" is provided where 20 ft. is required. c. East- Side 0' - 0" is provided where 20 ft. is required. d. Side- West 0' - 0" is provided where 20 ft. is required. We request the set back variances because this is a tight site which is"sandwiched" between odd conditions: To our East, we have a Storage building and to the West a Water Retention area. Each of these sides will not be adversely affected by the requested variances. Each of these sides has unique affects to the property based on their uses and results in the requested variances. 2. Lot Coverage: 89% is provided where 80% is required. With the set back variance, the lot coverage will increase. Therefore, we also request a lot coverage variance. We believe that we meet the variance criteria In section 265-15 of the Land Development Regulations because: I. Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to the other lands, structures or building in the same zoning district. R= This property is peculiar because this is an undersized lot and is located between a Storage Building, which is a non conforming use, and a retention area. Also, it is on a piece of land fronted by one way traffic going West, one way traffic going East and a future Hi- Rise building on the South. R= The above special conditions are particular to this site and are not a result from actions by the petitioner. 3. Literal interpretation of the provisions of these LDRs deprives the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and works unnecessary and undue hardship on the applicant. R= The provisions of the new LDR's for this zoning district function for a larger property, while this property suffers a hardship in trying to meet the LDR's. 4. The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs. R= There is yet to be a project constructed with the new LDR's. A structure consistent with these new LDR's is not feasible on this site. S. Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district. R= Others in the same zoning district will be in a similar situation with the same size property. 6. The variance, if granted. is the minimum variance that makes possible that reasonable use of the land, building or structure. R= We feel that these variances are the minimum variances possible. 7. The granting of the variance is in hannony with the general intent and purpose of this LDRs, is not injurious to the neighborhood or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. R= Yes, this project will be in harmony with the general intent and purpose of the LDR's and will not be injurious or detrimental and will not diminish property values.
