RESOLUTION NO. 09-Z- i ~ 0
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, CHANGING THE
CLASSIFICATION FOR THE HERITAGE PARK LAND AREA
LOCATED AT 19200 COLLINS AVENUE FROM B-1
(NEIGHBORHOOD BUSINESS) TO CF (COMMUNITY
FACILITY); PROVIDING FOR REPEALER; PROVIDING FOR
SEVERABILITY; PROVIDING FORAN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Sunny Isles Beach authorized the
publication of a public hearing as required by the law, that the zoning classification for the
Heritage Park land area located at 19200 Collins A venue (hereinafter referred to as the
"Property") be changed from B-1 (Neighborhood Business) to CF (Community Facility); and
WHEREAS, the purpose of the public hearing is to correct a notice error in a previous
application approved by the City Commission; and

WHEREAS, said public notice was given and publication made as required by law, and
a public hearing thereunder was held on the date of the passage and adoption of this Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
I. INCORPORATION OF RECITALS
All recitals above are incorporated into the body of this Resolution as if same were fully set forth
herein.
II. APPROV AL
That the above described Property be and the same is hereby rezoned and changed from B-1
(Neighborhood Business) to CF (Community Facility):
a. Plans for the Property are on file and may be examined in the Planning
and Zoning Department for "Sunny Isles Beach Heritage Park and
Parking Garage" consisting of 2 (two) sheets.
b. The Property is legally described as "Tract' D' Gallahad Dade PB 92-16"
consisting of 4 (four) acres
III. REPEALER
All Resolutions or parts of resolutions in conflict herewith shall be and hereby are repealed.

IV. SEVERABILITY
If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any
reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall
be deemed a separate, distinct, and independent provision and such holding shall not affect the
validity of the remaining portions of this Resolution.
V. EFFECTIVE DATE
This Resolution shall become effective upon adoption.

RESPONSIBILITIES OF THE APPLICANT
PLEASE READ CAREFULLY BEFORE SIGNING
I hereby acknowledge that I am aware that the Department of Environmental Resources
Management (DERM) and the Miami-Dade County Fire Department (l\tIDFD) will review and
comment on all development applications. These comments sometimes include requirements for
an additional public hearing before DERM Environmental Quality Control Board, (EQCB) the
preparation and execution of agreements to run with the land, which are recorded, prior to
obtaining a building permit.
I understand that is my responsibilities as the applicant or applicants representative to promptly
follow through with the compliance of DERM and MDFD requirements or to advise this office
in writing if the application will not go forward and may be considered withdrawn. Contact with
the above-mentioned agencies is advised during the hearing process.
Permit requirements: I also understand that the Florida Building Code, DERM and MDFD may
contain requirements that affect my ability to obtain a required building permit for my project,
even if the zoning application is approved at public hearing. I am aware that a Building Permit is
required for all construction and that I am responsible for obtaining the required permit, all
required inspections, the Certificate of Use and Occupancy or Certificate of Completion for any
and all structures and additions whether proposed or existing without permits. Additionally I am
aware a Certificate of Use and Occupancy must be obtained for the use of the property, if
approved at a Zoning Hearing and that failure to obtain the required permits and/or Certificates
of Completion, Use and Occupancy will result in the initiation of enforcement action against the
occupant and owner. I further understand that submittal of Zoning Hearing application will not
necessary forestall enforcement action against the property.

for Tony Villegas, the man
charged with the 2008
slaying of Rothstein's for.

Thursday, but the rebellion
against him continued to
fester, witb a longtime
party fundraiser calling for
his resignation.
The 25-2 vote came at
the party's quarterly exec-
utive board meeting in Tal-
lahassee, considered
friendly Nrffor Greer. He
has spent months deflect-
ing criticism of lavish
spending, hardball political
tactics and favoritism in
statewide primaries for
governor and U.5. Senate.

Zone Classification Change for Heritage Park
RECOMMENDATION
It is recommended that the City Commission approve the attached resolution providing for a zone
r' classification change for Heritage Park.

REASONS
The City Commission approved an application on March 19, 2009 under Resolution No. 09-Z-118,
in which the City requested a district boundary change for the property described in this application.
It has been brought to our attention that under that application there was an error in providing
individual notice within the 300 feet radius. The purpose of this application is to correct the
individual notice error with respect to the initial application.
The City Comprehensive Master Plan classifies the subject property as ROS (Recreational Open
Space). The zoning classification on the property is B-1 (Neighborhood Business). The
Department is requesting to change the zoning district to CF (Community Facility) which will better
describe the future use of the facility. The boundary change is necessary to comply with the City
Comprehensive Master Plan.
ADDITIONAL INFORMATION
Before the zone change of the property in question, the property could have yielded the following
development rights:
