A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE PURCHASE
AND INST ALLA TION OF A LIGHTNING PREDICTION AND
WARNING SYSTEM FOR HERIT AGE PARK FROM THOR GUARD,
INC., IN AN AMOUNT NOT TO EXCEED SEVENTEEN THOUSAND
NINE HUNDRED TWENTY-FIVE DOLLARS ($17,925.00), AS A SOLE
SOURCE VENDOR; AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach desires to purchase and install a Lightning
Prediction and Warning System in Heritage Park for the safety and welfare of its residents and
visitors; and
WHEREAS, Thor Guard, Inc. was identified by the Administration as a "sole source"
vendor to provide the Lightning Prediction and Warning System, and approved by the City
Commission via Resolution No. 2010-1548 on April 15, 2010, to install the system in Pelican
Community Park, Senator Gwen Margolis Park, Town Center Park, and Samson Oceanfront
Park; and
WHEREAS, the City now wishes to purchase a Lightning Prediction System for Heritage
Park from Thor Guard, Inc., in an amount not to exceed Seventeen Thousand Nine Hundred
Twenty-Five Dollars ($17,925.00), as per the Vendor Agreement attached as Exhibit "A",
waiving the competitive bidding process as sole source pursuant to City Code Section 62-13(F).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Purchase and Installation. The City Commission hereby approves the
purchase and installation by Thor Guard, Inc. of the desired Lightning Prediction and Warning
System for Heritage Park, in an amount not to exceed Seventeen Thousand Nine Hundred
Twenty-Five Dollars ($17,925.00) attached hereto as Exhibit "A".
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this resolution.
Section 3.
Effective Date. This Resolution will become effective upon adoption.
PASSED AND ADOPTED this 15th day of June 2011.

WARRANTY INFORMATION

FIVE YEAR WARRANTY ON SOFTWARE TECHNOLOGY UPGRADES
For a period of five (5) years from date of purchase of all THOR GUARD Lightning Prediction
Systems, the company will automatically upgrade the microprocessor with any new development
in lightning evaluation software. This warranty covers all THOR GUARD models - so the
customer need never worry that existing equipment will become outdated or obsolete. The
Company is committed to providing every customer with the optimum in lightning prediction
technology. THOR GUARD is the only company in lightning warning to make this commitment.
TWO YEAR WARRANTY ON LIGHTNING PREDICTION HARDWARE
THOR GUARD will cover failures due to defects in matcrials or workmanship, which occur
during normal use of its lightning prediction computer for two (2) years fi.om datc of purchase.
The warranty co vcrs parts and factory labor.
OTHER WARRANTY INFORMATION
Two-year warranty on Voice of THOR - Extcrnall-Iorn Equipmcnt.
One-year warranty on Hyperstatic Sensor due to variations in local environmental conditions.
One-year warranty on the 1'G900 Radio System.
One-year warranty all non-manufactured items such as batteries, solar panels, strobe lights and

Thor Guard is a vital safety device and an intcgral eomponcnt of YOllr daily operations. Keeping YOllr
THOR GUARD lightning prediction and warning system operating propcrly is critical. This equipment
needs to be maintained on a regular basis. The primary purpose or this maintenance program is to
perfbl'ln a complete and thorough system analysis four Lo six timcs annually, frequency defined by the
environmcntal conditions in your geographic area. Thc (bllowing service procedures will be perfbl'lncd
as part oflhis servicc agreement.

Please note that the primary purpose of this agreement is to ensure that all aspects of your lightning
prediction and warning system are operating properly on the day of each service call. The customer,
hO\vever, is responsible for daily, routine maintenance of their Thor Guard system in order to guarantee
that it is operating properly on an every-day basis. Neither Thor Guard nor the Service Agent is
responsible for any disruption of service due to normal wear and tear after this maintenance service
agrccment is completed.

In the event the system requires immcdiate attention between maintcnance visits you may contact us for
additional service. These visits will be billed separately at our regular service rales.

Please be advised that we are both the sole manufacturer and the sole provider
of the THOR GUARD Lightning Prediction and Warning Systems. As a matter of fact,
THOR GUARD is the only company that manufactures a lightning prediction system in
the entire world. Our products are manufactured in Sunrise, Florida.
THOR GUARD products are designed and operate through the use of our
proprietary technology. Our Patent and Trademark numbers are 4,095,221 and
2,390,039, respectively. THOR GUARD has not given any other company the right to
manufacture our products
We look forward to the opportunity to furnish and install our systems at your
facility.

RE:
Resolution to approve the purchase and installation of the lightning
prediction and warning system at Heritage Park.
RECOMMENDATION:
Commission approve the purchase and installation of the lightning prediction and
warning system for Heritage Park in an amount not to exceed $17,925.00.
REASONS:
The Heritage Park has a wide variety of amenities including an interactive water feature,
a fountain, a performance stage, two playground areas, and a large open area that can be
utilized by visitors and residents for a number of outdoor activities functions. With all the
possible activities that may take place, it is recommended that an advanced warning
system be installed for the awareness of visitors to the park of the potential for lightning
in the area.
The Thor Guard system is a lightning prediction system which detects atmospheric
conditions likely to produce lightning strikes in a certain area and sounds an auditory
alert, warning those nearby that lightning is imminent. The system proposed includes all
the necessary software and hardware to predict, notify, and provide an "all clear" when it
is safe to return. It also includes a preventative maintenance task to ensure the system
works continuously.
ADDITIONAL INFORMATION:
Staff has conducted a good faith review of available sources and has found that Thor
Guard is the only company that designs and manufactures an interactive package of both
lightning prediction and external warning systems. The system is designed to give a "Red
Alert" warning eight (8) to twenty (20) minutes in advance of a potential strike in the
area which differs from other companies that only offer a lightning detection system
which will only warn after a lightning strike has hit.
