A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, RATIFYING THE PURCHASE
OF A YAMAHA C7 CONCERT GRAND PIANO FROM TONY
SICILIANO'S PIANO MUSIC CENTER FOR PELICAN
COMMUNITY PARK, IN AN AMOUNT NOT TO EXCEED
TWENTY FIVE THOUSAND TWO HUNDRED SEVENTY-FIVE
DOLLARS ($25,275.00), ATTACHED HERETO AS EXHIBIT "A";
AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Pelican Community Park is in need of a piano for City events including
the Piano Concert Series, and the Four Seasons Cultural Series; and
WHEREAS, staff attended a used piano sale at the University of Miami School of Music
providing a limited opportunity to purchase a piano that has been used by the school for one year
at a significantly discounted rate; and
WHEREAS, pursuant to Section 62-12 of the City Code, the City Commission may
authorize the waiver of competitive bidding procedures upon the recommendation of the City
Manager that it is in the City's best interest to do so, to obtain goods and services which cannot
be acquired through the normal purchasing process due to insufficient time, the nature of the
goods or services, or other factors. Purchases authorized by waiver process shall be acquired
after conducting a good faith review of available sources and negotiation as to price, delivery and
terms; and
WHEREAS, the City desires to purchase a Yamaha C7 Concert Grand Piano for Pelican
Community Park from Tony Siciliano's Piano Music Center, in an amount of Twenty-Five
Thousand Dollars ($25,000.00), and a delivery charge of Two Hundred Seventy-Five Dollars
($275.00), for a total amount not to exceed Twenty-Five Thousand Two Hundred Seventy-Five
Dollars ($25,275.00), attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Ratifying the Purchase. The City Commission hereby ratifies the purchase of the
Yamaha C7 Concert Grand Piano from Tony Siciliano's Piano Music Center for Pelican
Community Park, in a total amount not to exceed Twenty-Five Thousand Two Hundred Seventy-
Five Dollars ($25,275.00) including delivery, as outlined in Exhibit "A", attached hereto.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.

ADDITIONAL TERMS
The terms of this contract are contained on both sides of this agreement.
Seller sells to Buyer the merchandise described on the reverse side. Until Buyer pays for
such merchandise in full: (1) Seller retains a security interest in such merchandise; (2)
Buyer shall not sell, remove or encumber such merchandise; (3) Buyer shall be
responsible for all loss or damage to such merchandise; (4) Buyer shall insure such
merchandise against loss by fire, theft, or Act of God. Upon Buyer's default in payments, or
in the above promises, Seller may, at its choice, declare the unpaid balance due, and also
may (at its choice) take back the merchandise.
Buyer agrees to hold seller harmless for any liability caused by delays in shipments. Buyer
agrees to inspect all product upon delivery and note any damage from transit on delivery
receipt. Floor models and used items are sold "finish as is." All further claim is waived.
WARRANTY: The warranty by, Seller on all merchandise sold is as follows (unless
specifically written elsewhere): New Acoustic Pianos ...:..- The Manufacturer's Warranty with
30 days free service. New Keyboards, New Digital Pianos - The Manufacturer's 1 year.
parts with 90 days free service, Used/Electronics ~ 30 days parts with 30 days free
service. items sold "AS-IS" have no warranty.
PRICE GUARANTEE: Within 3 months from the date of purchase, if you find the same new
acoustic piano purchased from us (described on the reverse side) advertised for less by an
authorized dealer, then we will refund the difference (must include all benefits).
TRADE-INS: Items that are traded-in by Buyer to. Seller as part of the payment of the .
purchase price are Warranted by Buyer to be owned by Buyer and are free of all liens.
Seller relies on this Warranty, and has told Buyer this.
ENTIRE AGREEMENT: All the terms of this agreement are contained in this document. All .
prior discussions, negotiations and agreements are contained in this agreement. This
agreement may not be changed verbally, only in writing.
SUCCESSORS: This agreement can be sold, transferred or assigned by Seller to anyone,
who are bound by the provisions of this agreement. If the Buyer owes money to Seller on
merchandise purchased by this agreement, then the agreement can NOT be transferred by
Buyer UNLESS Seller consents in writing.
RESTOCKING FEE: A restocking fee of 25% of your purchase price will be deducted for all
cancellations.

Purchase of a Concert Piano
RECOMMENDATION:
It is recommended that the City Commission ratify the purchase of one Yamaha C7
Concert Grand Piano from Piano Music Center in an amount not to exceed Tweny Five
Thousand, Two Hundred, Seventy Five Dollars ($25,275.00).
REASONS:
The City desires to provide culturally rich entertainment offerings to the residents and
visitors of Sunny Isles Beach through its Four Seasons Cultural Series, Sunny Serenades,
and Piano Concert Series. These events are frequent and therefore it makes good business
sense to purchase a piano over continuous rentals.
The University of Miami School of Music annually hosts a slightly used piano sale. This
provided a limited opportunity to purchase a piano that has been used by the school for
one year at a significantly discounted rate. The piano selected for the City is a Yamaha
C7 Concert Grand Piano. It is in exceptionally good condition and carries a suggested
retail price of $69,770.00. It was carefully inspected by a trusted piano tuner and deemed
to be in excellent performance condition.
ADDITIONAL INFORMA nON:
This piano will replace the baby grand piano that was donated to the City by Christine
Lee's Restaurant when they moved out of the City. That piano was damaged and deemed
not worth repair at the time of donation.
FUNDING SOURCE:
Budgeted positions remain unfilled during this fiscal year. As a result, funds were re-
appropriated for the purchase of the piano.
