A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, DENYING A ZONING
REQUEST BY SUNNY ISLES DAY CARE CORP. D/B/A SUNNY
ISLES DAY CARE FOR SITE PLAN APPROVAL AND VARIANCE
TO INCREASE THE NUMBER OF CHILDREN FOR CHILD-CARE
CENTERS; PROVIDING FOR AN EFFECTIVE DATE.
I. RECIT ALS
WHEREAS, on July 21, 2011, the City Commission of the City of Sunny Isles Beach
conducted a public hearing on the site plan application (Z2011-03) submitted by Sunny Isles Day
Care Corp. d/b/a Sunny Isles Day Care (the "Applicant") requesting the following:
1. Conditional use site plan approval for a daycare center in the RMF-2 Zoning District.
2. Variance of Section 265-44(D)(2) of the City Code to permit a child care center with a
maximum of forty children where six children are permitted.

WHEREAS, the public hearing was advertised and held as required by law and all
interested parties concerned in the matter were heard, and upon due and proper consideration
given to the matter and to the Development Review Report submitted by the City's Planning and
Zoning Department; and
WHEREAS, the City Commission gave full and complete consideration of the record at
the public hearing, consisting of the recommendation of staff, the documents on file with the
City and the testimony of all interested parties.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
II. INCORPORATION OF RECITALS.
All recitals are incorporated into the body of this Resolution as if same were fully set forth
herein.

III. DENIAL OF REQUEST.
The City Commission of the City of Sunny Isles Beach hereby denies the zoning request, and as
reasons therefore makes the following findings of fact:
(1) The Applicant has not proven entitlement to a variance under City Code by failing to satisfy
the requirements for a variance, which include, but not limited to the demonstration of hardship.
(2) The proposed childcare use with a maximum of forty (40) children is not appropriate at the
subject location.
IV. EFFECTIVE DATE.
(1) This Resolution shall become effective upon adoption.

III. History
The Winston Towers Shopping Plaza provides multiple business uses for residents. The business uses are
retail and other services and were established through the recorded Declaration of Covenant dated
December 18, 1979 restricting the type of business uses, parking, and servicing only Winston Towers
Complex. In addition, on 1996 Miami-Dade County approved a hearing for a Synagogue to be
established within the shopping plaza, that use currently exists. No previous public hearing application
has been received for this particular site since the incorporation of the City of Sunny Isles Beach.

IV. Applicant's Request
1. The Applicant is requesting a conditional use site plan approval for a Daycare center in
the RMF-2 Zoning District.
2. The Applicant is requesting a variance of section 265-44 (D)(2) of the City Code to permit
a Child Care Center with a maximum of 40 children where 6 children are permitted.
Plans are on file and may be examined in the Planning and Zoning Department for Sunny Isles
Daycare Corp (Pgs. 1 & 2), dated May 31and June 10,2011.

IV.' Zoning General Standards of Review For Variance
In granting a variance, the City Commission must consider the following factors pursuant to
Section 265-15 of the City Code.
(1) Special conditions and circumstances exist which are peculiar to the land, structure, or
building involved and which are not applicable to other lands, structures or buildings in the
same zoning district;
(2) The special conditions and circumstances do not result from the actions of the petitioner;
(3) Literal interpretation of the provisions of these LDRs deprives the applicant of rights
commonly enjoyed by other properties in the same zoning district under the terms of this
chapter and works unnecessary and undue hardship on the applicant;
(4) The alleged hardship is not economic and has not been deliberately created to establish a use
or structure, which is not otherwise consistent with the LDRs.
(5) Granting of the variance requested conveys the same treatment to the individual owner as to
the owner of other lands, buildings or structures in the same zoning district;
(6) The variance, if granted, is the minimum variance that makes possible the reasonable use of
the land, building or structure; and
(7) The grant of the variance is in harmony with the general intent and purpose of these LDRs, is
not injurious to the neighborhood, or otherwise detrimental to the public safety and welfare
and will not substantially diminish or impair property values within the vicinity.
V. Staff Analysis
Winston Towers Shopping Plaza is located in a residential zone providing business services for
the immediate area. The shopping plaza is an active business hub with retail, medical and
professional offices, and a synagogue. The Applicant wishes to establish a Child Day-Care
Center in one of the units within the plaza. However, as a consequence of the zoning classification
for the site, the Applicant is required to apply for a variance due to the number of children
requested for the da ycare center.

The Applicant is seeking to provide a service based on economic conditions and as such, the
Applicant does not satisfy all of the requirements to grant a variance pursuant to the Zoning
General Standards of Review as stated below:
(1) A special condition on the property relates to the existing Declaration of Covenant, which
restricts the type of business uses permitted in the residential zoning district in which the
building is located on. The current businesses on the shopping plaza have been operating and
are providing services to the entire community,
(2) The Applicant did not have control over the special condition placed on the site, when the
Declaration of Covenant was establish in 1979.
(3) There is no unnecessary or undue hardship on the Applicant due to the provisions set in the
LDRs for this particular zoning district.
(4) The Applicant needs to demonstrate an alleged hardship that is not economic. It is clear to
staff that the requested variance is based on economics without demonstrated hardship.
(5) The requested variance is not creating the same treatment to other land, building or structure
in the same zoning district. If the variance is granted, it is not intended to create a precedent
for this zoning district.
(6) The granting of the variance is not the minimum variance possible for the Applicant to obtain
a reasonable use of the land/building.
(7) The request is within an established location, and the Applicant has taken measures to provide
landscaping buffers and sufficient setbacks to preserve the possibility of any visual impact of
the outdoor play area. However, the Applicant needs to demonstrate to staff the imapct that
the proposed daycare will have to the overall shopping plaza as well as to adjoining properties.

IX. Conditions
In the event that the request is granted, the following conditions should apply:
(1) Upon the submittal of an application for building permit, the plans submitted shall meet with the
approval of the Planning and Zoning Administrator and be consistent with the specific site plan
approved by the City Commission. Plans shall include all the required elements of the site plan
pursuant to the City's Land Development Regulations and recommendations. Should compliance
with recommendations result in a change that would not be considered "minor" in accordance with
Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the
City Commission.

(2) That the project shall be developed substantially in accordance with the plans submitted for public
hearing. Plans are on file and may be examined in the Planning and Zoning Department for Sunny
Isles Daycare Corp (Pgs. 1 & 2), dated May 31and June 10,2011.
(3) That the Applicant complies with all conditions and permit requirements of the Department of
Environmental Resource and Management (DERM), the Miami-Dade County Fire Department
(MDFD), Water and Sewer Department, (DCF) Department of Children and families, and (DOH)
Department of Health.
(4) That all signage associated with the location met the requirements of the signing code.
(5) That the applicant obtains a Business License and a Certificate of Use from the City upon
compliance with all terms and conditions. The Business License and Certificate of Use shall be
subject to cancellation upon violation of any conditions.
(6) That the maximum allowable amount of children attending the Child Day-Care shall be 40 and all
under the age of four (4) years old.

We petition for a permit to open a Daycare facility at 17395 N Bay Road, Suite 102 Sunny sles Beach, FL 33160. We
petition for a 40 children capacity four (4) years of age and under. The number of children requested is based on square
footage per child ratio established by Florida Department of Children and Fanulies. Total square feet, of the indoor facility
is 1633sq.ft, and usable indoors fioor space available for indoor play, classroom, and work area is 1,431sq. Tlus number
meets the minimum of 35 square feet of usable indoor fioor space for each child. This usable floor space does not include
badl facilities, toilets, kitchens and storage. Our business operation will be aligned to Florida Department of Children and
Families regulation, as well as Local Ordinances for child-care facilities.
The property has direct access to the back door garden. \Ve petition for permit to fence backyard garden and use it as
outdoor play area, approximate size of dIe backyard is 1,200 sq. fL (which meets the requirement for outdoor playarea-45
sq. ft. per half child ratio for outdoor play area by the Department of Children and Families).
We will provide a safe and healthy envirolllnent under qualified supervision and maintain sufficient indoor floor space for
playing, working and napping.
SUImy Isles Daycare is a business that has become necessary in today's fast-paced world. There are an increasing amount of
families who become dependent on two incomes, which has created the necessity of the Child Care induslry here in SUImy
Isles Beach. hldeed, it has. Today, there is no business or facility in dIe area that provides daycare services to Sunny Isles
residents.
There are several points we want to emphasize in relation to the benefit" of a daycare facility in Sunny Isles Beach. First,
there are many working parents cun:endy forced to take their children to out-of-city daycare facilities or to use babysitting
services; neither of these options benefit the city laX collection. Our local facility and business will contribute to city financial
wellness and positively impact its residents. The city would also benefit from added value to real state property. For many
home buyers and renters it is important to have daycare in their community. Research suggest dIat families whose child care
needs are met locally, are slronger families, have better quality of life and do better financially.

I hereby acknowledge that I am aware that the Department of Environmental Resources
Management (DERM) and the Miami-Dade County Fire Department (MDFD) will review and
comment on all development applications, These comments sometimes include requirements for
an additional public hearing before DERM Environmental Quality Control Board, (EQCB) the
preparation and execution of agreements to run with the land, which are recorded, prior to
obtaining a building permit.
I understand that is my responsibilities as the applicant or applicants representative to promptly
follow through with the compliance of DERM and MDFD requirements or to advise this office
in writing if the application will not go forward and may be considered withdrawn. Contact with
the above-mentioned agencies is advised during the hearing process,
Permit requirements: I also understand that the Florida Building Code, DERM and MDFD may
contain requirements that affect my ability to obtain a required building permit for my project,
even if the zoning application is approved at public hearing, I am aware that a Building Permit is
required for all construction and that I am responsible for obtaining the required permit, all
required inspections, the Certificate of Use and Occupancy or Certificate of Completion for any
and all structures and additions whether proposed or existing without permits, Additionally I am
aware a Certificate of Use and Occupancy must be obtained for the use of the property, if
approved at a Zoning Hearing and that failure to obtain the required permits and/or Certificates
of Completion, Use and Occupancy will result in the initiation of enforcement action against the
occupant and owner, I further understand that submittal of Zoning Hearing application will not
necessary forestall enforcement action against the property,

Conditional Use and a variance for proposed daycare.
RECOMMENDATION:
Staff is presenting the attached resolution for a proposed daycare to the City
Commission for their consideration.
REASONS:
The Applicant is requesting a Conditional Use to permit a daycare in the Residential
Multi-Family District (RMF2). Together with this request the applicant is requesting a
variance to permit 40 children from the ages of 4 ( 6 children permitted).
