HomeMy WebLinkAboutOrdinance 2011-368 ORDINANCE NO. 2011-3la6 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 68-2(A) OF THE CITY CODE TO PROVIDE REIMBURSEMENT FOR MILEAGE IN ACCORDANCE WITH RATES ESTABLISHED BY THE INTERNAL REVENUE SERVICE; PROVIDING FOR SEVERABILITY AND REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has the authority to adopt its own rules to regulate the reimbursement of business expenses incurred in the performance of official duties by City officials; and WHEREAS, the City Commission wishes to adopt a policy to provide guidelines and procedures for the reimbursement of expenses incurred as a result of carrying out City business; and WHEREAS, the City wishes to amend the City Code to provide reimbursement for mileage using rates established by the Internal Revenue Service ("IRS"). NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 68 of the City Code is amended to read as follows: Chapter 68-2: Guidelines for the reimbursement of expenses. Upon proper approval of reimbursement request, the City will reimburse all travel-related expenses such as commercial transportation, lodging, meals, tips, registrations, parking fees, communications charges, and other business-related expenses at actual cost. A. Transportation expenses. Reimbursement of transportation-related expenses will be based upon the least expensive mode of transportation available, unless a more expensive mode is necessary due to business-related requirements. In determining the least expensive mode, commercial bus service will be excluded. Reimbursement for mileage will be according to the maximum rate~ established under Florida law by the Internal Revenue Service ("IRS") if personal vehicles are used for business travel or for mileage reimbursement program established by the City Manager or designee. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the section of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. Cohen, City Manager DATE: 9/15/2011 RE: Mileage Reimbursement Rates RECOMMENDATION: To use the IRS mileage reimbursement rate when we reimburse employees for city- related travel. REASONS: The IRS adjusts their rate annually to reflect actual market conditions. At times they have made mid-year adjustments when gas prices have dramatically changed in a short period of time. The State of Florida rate has not changed in several years. Using the IRS rate will ensure that employees are being appropriately compensated for their gas and vehicle wear and tear costs when using their vehicle for city business.
