HomeMy WebLinkAboutReso 2011-1759 RESOLUTION NO. 2011- JJ.S1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AWARDING RFP NO. 11-08-01 TO BROWN & BROWN I PREFERRED GOVERNMENT INSURANCE TRUST (PGIT) AS THE CITY'S PROVIDER FOR THE COMMERCIAL PACKAGE POLICY (PROPERTY, LIABILITY, AND AUTO), WORKERS' COMPENSATION, AND MISCELLANEOUS INSURANCE COVERAGES FOR THE PERIOD OF OCTOBER 1,2011 THROUGH SEPTEMBER 30, 2012, IN THE AMOUNT OF SIX HUNDRED THIRTY-EIGHT THOUSAND SIX HUNDRED TWENTY-THREE DOLLARS ($638,623.00), AS OUTLINED IN EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO ENTER INTO AGREEMENTS WITH THE PROVIDER, PROVIDED SAID AGREEMENTS ARE APPROVED AS TO FORM AND LEGAL SUFFICIENCY BY THE CITY ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is in need of various insurance coverage to protect it from liabilities, catastrophes, and other issues that may arise; and WHEREAS, the City issued RFP No. 11-08-01 Property Casualty Comprehensive Insurance, which yielded two responses: one from Brown & Brown/Preferred Governmental Insurance Trust (PGIT) and one from Florida League of Cities (FMIT); and WHEREAS, the proposals were referred to Siver Insurance Consultants, our independent insurance consultants, for an in-depth analysis, and they recommended the proposals from PGIT; and WHEREAS, City staff recommends acceptance of the Brown & Brown/Preferred Governmental Insurance Trust (PGIT) proposal for the Package Policy and Workers Compensation, and miscellaneous insurances as follows: Package Policy & Workers Compensation Crime Policy Activity Accident Hull Coverage Storage Tank Liability Total Amount: $623,195.00 707.00 11,164.00 1,845.00 1,712.00 $638,623.00 WHEREAS, the City of Sunny Isles Beach wishes to select Preferred Government Insurance Trust (PGIT) as the City's provider for the Package Policy and Workers Compensation, and miscellaneous insurances, being the most competitive proposal. Incorporation of Recitals. The recitals set forth in this resolution are incorporated herein by reference as if fully set forth herein. Section 2. Award of Bid and Approval of Agreement. The City Commission hereby awards Bid No. 11-08-01 to and enters into an Agreement with Brown & Brown/Preferred Government Insurance Trust (PGIT) as the City's provider for the Package Policy and Workers Compensation, and miscellaneous insurances, for a one-year period of October I, 2011 through September 30, 2012, in the total amount of Six Hundred Thirty-Eight Thousand Six Hundred Twenty- Three Dollars ($638,623.00), as outlined in Exhibit "A", attached hereto. Section 3. Authorization of City Manager and City Attorney. The City Manager is hereby authorized to enter into agreements with said insurance provider, provided said agreements are approved as to form and legal sufficiency by the City Attorney. Section 4. Further Authorization of the City Manager. The City Manager IS hereby authorized to do all other things necessary to effectuate this Resolution. Section 5. Effective Date. RECOMMENDATION Based on our discussion with staff regarding the proposed premiums, the coverage differences, and the disruption created by moving from one insurance program to another, we recommend that the City accept the following proposals provided in response to the Request for Proposals No. 11-08-01. The amount proposed for the renewal of the glass policy by Brown and Brown Insurance is $11,874. DISCUSSION AND COMMENTS PACKAGE COVERAGE PGIT Renewal Coverage We have recommended that the City renew their package coverages, including workers' compensation, with the Preferred Governmental Insurance Trust (POIT) through Brown and Brown Insurance (Brown & Brown) for a premium of $623, 195, which is about 3Yz% higher than the expiring premium of $601,629, a difference of $21,566. That premium difference is almost entirely due to the cost of workers' compensation coverage this year, which increased nearly 37% (from $99,708 to $136,429) due to a . higher workers compensation experience modification of 1.09 (from .86) and an increase in workers' compensation premium rates published by the National Council on Compensation Insurance (NCCI). Fortunately, a slight decrease in the cost of property and automobile liability coverages offset a portion of that higher workers' compensation premIUm. The renewal coverage is offered on basically the same terms and conditions as the expiring policy. The total property values have increased from $26,400,840 to $35,713,210 and inland marine values are now $3,364,156 (compared to $3,168,056 last year). FMIT Renewal Proposal The Florida League of Cities (Florida League) and Florida Municipal Insurance Trust (FMIT) offered a competitive proposal for basically the same package coverages as POIT for an estimated cost of $553,650. Although that proposal appears to be significantly lower than PGIT, in order to compare the proposals, it is necessary to include an additional premium cost for "prior acts" coverage, which the League advises us is $31,610, which brings the total of the FMIT quote to $585,260. FMIT also proposed an option which removes the liability deductibles for general liability, public officials, law enforcement liability, automobile liability and workers compensation for an additional premium of $16,484, which brings their proposed premium, with prior acts coverage, to $601,744. Although still lower than the POIT proposal by $21,451, the FMIT proposal includes some coverage differences, we will address below. SIVER INSURANCE CONSULT ANTS Ms. Priscilla Walker September 7, 2011 Page 3 Proposal Differences Proposed "Prior Acts" Coverage Because the expiring coverage for Public Officials & Employment Practices Liability with PGIT is provided on a "claims made" basis and the FMIT proposal is provided on an "occurrence" form, it is necessary to add prior acts coverage to the occurrence proposal, so future claims that arise from circumstances which occurred prior to the change, but were not known and therefore not reported on the old policy, will be covered. Although not included in their original proposal, at our request, FMIT provided a quote to add three years prior acts coverage. We are not entirely comfortable with only three years prior acts and, in general, have reservations about moving "claims made" coverage unless there is an overwhelming reason to do so. Property Coverage Both FMIT and PGIT have proposed their property coverage on a "blanket" and agreed amount basis. FMIT's proposal requires an appraisal of the City's property to keep that coverage on a "blanket basis." Jim McGinn of the Florida League of Cities states: "The FMIT policy with be written with blanket/agreed value effective 10/1/2011. . . . The FMIT will pay for a full property appraisal. The City would select and pay the Appraiser they want to use. I have a list of 3 appraisers that do a good job jf needed. Then the City makes any changes to the schedule necessary as a result of the appraisal, submit the entire bill to me and I will set up for reimbursement." I do not know when the City last performed an appraisal of their property, but if it has been some time, an appraisal could result in a significant change in the City's property values, which could result in a return premium, or what is more likely an additional premium charge, when the property schedule is revised and values adjusted. While it is certainly beneficial to bring the property schedule up to date, and we recommend the City have a property appraisal, if they have not done so recently, we mention this only because the revised schedule can result in a significant additional premium that the City may not be expecting, based on the FMIT property proposal. Currently, the Blanket property limit proposed by the FMIT is $36,246,450 compared to a PGIT blanket limit of $35,713,210. That difference is due to the fact that FMIT includes Computer Equipment and other property as building or contents which PGIT insures in their inland marine coverage section. The property deductible is $5,000 per occurrence except for named windstorms which is 5% of the property at a damaged location. FMIT's minimum named windstorm deductible is $25,000 compared to PGIT's minimum deductible of $20,000. SIVER INSURANCE CONSULTANTS Ms. Priscilla Walker September 7, 2011 Page 4 Crime Coverage Both the PGIT and FMIT proposals include coverage for Employee Dishonesty, Forgery, Theft and Computer Fraud in their proposal. The following compares the limits and deductibles in those proposals. We suggest that regardless of whether the City accepts the PGIT or FMIT proposal, higher limits for all the crime coverage, especially Employee Dishonesty, should be considered, Covera!!e PGIT FMIT Employee Dishonesty Limit: $250,000 I Deductible: $5,000 Limit: $1,000,000 I Deductible: $1,000 Forgery or Alteration Limit: $250,000 I Deductible: $5,000 Limit $250,000 I Deductible: $5,000 Computer Fraud Limit: $250,000 I Deductible: $1,000 Limit: $250,000 I Deductible: $1,000 Theft Inside & Outside Limit: $250,000 I Deductible: $1,000 Limit: $250,000 I Deductible: $5,000 Liability Coverages Both FMIT and PGIT proposed continuation of the City's liability limits of $5,000,000 with a $2,500 deductible for General Liability, Public Officials, Employment Practices Liability, Police Professional Liability and a $5,000 deductible for Automobile Liability. As we have already mentioned, FMIT has also included an option for no deductible. The expiring coverage for Public Officials & Employment Practices Liability with PGIT is provided on a "claims made" basis. As FMIT's Public Officials and Employment Practices Liability is proposed on an Occurrence form, they have included a quote for a three years prior acts coverage with their proposal which is intended to help close the gap between the claims made and occurrence coverage. Still, any time coverage is changed from a claims-made to an occurrence policy or even from one claims-made policy to another claims-made policy, there is a potential risk of creating a coverage gap from future claims that arise from circumstances which occurred prior to the change, but were not known and therefore not reported on the old policy. ADDITIONAL POLICIES PROPOSED Public Official Bonds Brown & Brown has provided a proposal for the continuation of the City Manager Position Bond with a $1,000,000 limit for $707 premium. The Florida League also provided a proposal for that same coverage but for a higher premium at $3,191, In addition, the Florida League provided proposals for a Finance Director Bond with options for a $500,000 limit for $1,437 and a $1,000,000 limit for $2,807; however we do not see that coverage was requested in the RFP. Brown and Brown did not provide a quote for a Finance Director Bond. SIVER INSURANCE CONSULTANTS Ms. Priscilla Walker September 7,2011 Page 5 Sponsored Activity Accident Policy Brown & Brown has proposed continuation of the City's Sponsored Activity Accident Policy with Mutual of Omaha Insurance for the same premium as the expiring policy, $11,164 and we recommend the policy be renewed. Since Brown & Brown did not address any policy changes in their proposal, we suggest that they be asked to confirm how the proposed renewal policy may be different from the expiring policy. The Florida League of Cities did not provide a proposal for this coverage. Hull Coverage We have recommended that the City renew the Hull policy for "The Grey Pearl" currently provided by RLI Insurance Co. through Brown & Brown Insurance. Storage Tank Coverage Brown & Brown has proposed continuation of the Storage Tank policy effective January I, 2012 with Illinois Union Insurance for the same premium as the expiring policy, $1,712 and we recommend the policy be renewed. However, since the Brown & Brown proposal is not clear on the subject, we suggest that they be asked to confirm how the proposed renewal policy may be different from the expiring policy. The Florida League of Cities did not provide a proposal for this coverage. Glass Coverage. We have not recommended that the City continue the glass policy currently provided by USPlate Glass Insurance for a renewal premium of $11,874, although we can certainly understand if the City chooses to do so. Although coverage for structural glass is already included in the City's property coverage, subject to a 5% named storm deductible, we understand this policy was originally purchased for the convenience of having a low deductible ($100) and ready supply of replacement glass in the event of a major storm. Now that the premium has increased to $11,874 (from $8,764) we suggest that the City may wish to reconsider whether this coverage is still worth the convenience. Statutory Police Death Coverage The Florida League of Cities has included a proposal for a policy to cover the statutory benefits the City is required to pay for the death of a law enforcement officer while engaged in the course of his duties. The premium proposed is $1,868. We assume the City maintains a policy for this coverage and we do not know whether the City is considering proposals for this coverage at this time. We do not see that it was a coverage requested in the RFP and Brown and Brown did not provide a quote for that coverage. We are now pleased to provide the enclosed response to the above captioned RFP. In addition to the enclosed proposal, I believe it is important to highlight some of the following unique enhanced insurance coverages in our proposal that are not generally included in other programs: 1. PGIT's Property insurance program provides full replacement value limits for the perils of windstonn and hurricane on a "blanket" fonnat without the inclusion of a potentially onerous coinsurance penalty condition. This extraordinary feature virtually eliminates the possibility of an underinsured or co-insured property insurance claim. 2. $5,000,000 Excess Flood Insurance is provided over and above the primary flood insurance provided by the National Flood Insurance Program. 3. A $2,500 payment is offered for legal fees ands assistance for reporting potential employee tennination is also included as well as a $100,000 coverage limit for the defense of Non- Monetary claims, such as ethics hearings and recall petitions. REASONS: The City needs various insurance coverages to protect it from liabilities, catastrophes, and other issues that may arise. As such, the City issued RFP No. 11-08-01 Property Casualty Comprehensive Insurance. The RFP yielded two responses: one from Brown & Brown/Preferred Governmental Insurance Trust (PGIT) and one from Florida League of Cities (FMIT). FMIT's named windstorm deductible is $25,000. 2. PGIT's Public Officials Liability policy response is based on a "claims made form". FMIT's policy is based on an "occurrence form". Siver contacted FMIT in this regard and they advised there would be a Thirty-One Thousand Six Hundred Ten Dollar ($31,610) increase to amend their proposal to a "claims made form". The amendment is necessary to cover the gap created when moving from a "claims made" form to an "occurrence" form. 3. FMIT submitted an alternate proposal with zero deductible at an additional cost of Sixteen Thousand Four Hundred Eighty-Two Dollars. PGIT has confirmed an alternate proposal with a zero deductible at no additional cost. The zero deductible does not apply to workers compensation items. Considering all of the requested adjustments, the revised package and workers compensation policies are as follows: Brown and Brown, Inc.
