A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, RESCINDING
RESOLUTION NO. 2011-1777 ADOPTED ON SEPTEMBER
15, 2011; AUTHORIZING THE CHIEF OF POLICE, IN
ACCORDANCE WITH THE COMPREHENSIVE CRIME
CONTROL ACT OF 1984 TO EXPEND UP TO ONE
HUNDRED FIFTEEN THOUSAND NINE HUNDRED
EIGHTY-FOUR DOLLARS AND FORTY-NINE CENTS
($115,984.49) FROM THE FEDERAL FORFEITURE (DOJ)
FUNDS FOR THE PURCHASE OF MISCELLANEOUS LAW
ENFORCEMENT EQUIPMENT AND TECHNOLOGY;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the
request of the Chief of Police to the governing body of a municipality, federally forfeited funds may
be expended if accompanied by written certification that the request complies with the provisions of
the Comprehensive Crime Control Act of 1984; and
WHEREAS, on September 15, 2011 via Resolution No. 2011-1777 the City Commission
authorized the Chief of Police to expend up to One Hundred Thirteen Thousand Eight Hundred
Fourteen Dollars and Ninety-Nine Cents ($113,814.99) for the purchase of miscellaneous law
enforcement equipment and technology, including a purchase of laptop computers from L.A.
Computer based on them providing the most responsive bid, after which time the L.A. Computer
Company notified the City that it was unable to honor the price it provided the City;. and
WHEREAS, the Chief of Police has now submitted an amended request to cover the
amended amount of the purchase oflaptop computers from Apple Enterprise, for the expenditure of
up to One Hundred Fifteen Thousand Nine Hundred Eighty-Four Dollars and Forty-Nine Cents
($115,984.49) in federally forfeited funds in compliance with the aforementioned.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Rescind Resolution No. 2011-1779. Resolution No. 2011-1777 approving the
expenditure of forfeiture funds is hereby rescinded.
Section 2. Expenditure of Federally Forfeited Monies. Based on the attached Certification, the
Chief of Police is hereby authorized to spend up to One Hundred Fifteen Thousand Nine Hundred
Eighty-Four Dollars and Forty-Nine Cents ($115,984.49) from the established Department of Justice
(DOJ) Federal Forfeitures Account for the purchase of miscellaneous law enforcement equipment
and technology.

Section 3. Effective Date. This Resolution shall become effective immediately upon adoption.
