ORDINANCE NO. 2011- 3.2.!
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 26-6 OF THE
CITY CODE TO REVISE THE QUALIFYING PERIOD DATES OF THE
GENERAL ELECTION FOR THE OFFICE OF MA YOR OR CITY
COMMISSIONER; PROVIDING FOR REPEALER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 26-6 of the City Code provides that candidates for the office of
Mayor or City Commissioner shall qualify with the City Clerk no earlier than 9:00 a.m. on the
76th day and no later than 4:00 p.m. on the 73rd day prior to the date of the general election; and
WHEREAS, the Miami-Dade County Elections Department has requested that the City
modify the dates for candidate qualifying to no earlier than the 84th day and no later than the 81 st
day prior to the date of the general election; and
WHEREAS, Florida Statutes 10 1.62(4)( a), provides that absentee ballots must be mailed
to overseas voters 45 days before a general election, and this new qualifying period would
provide the Elections Department sufficient time to prepare, print, and mail absentee ballots to
overseas voters by the statutory deadlines; and
WHEREAS, this change would benefit the City and the Elections Department In
providing a more efficient and smooth election; and
WHEREAS, the City Commission wishes to change the City's dates for candidate
qualifying pursuant to the request made by the Miami-Dade County Elections Department
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Recitals adopted. That each of the recitals stated above IS hereby adopted and
confirmed.
Section 2. Amendment. Section 26-6 of the City Code of the City of Sunny Isles Beach is hereby
amended to read as follows:
Section 26-6. Qualifying as Candidate for Mayor or City Commissioner; Fee; Oath;
Single Candidate Considered Elected. Candidates for the office of Mayor or City
Commissioner shall qualify with the City Clerk no earlier than 9:00 a.m. on the 84th +6tR day and
no later than 4:00 p.m. on the 81 st +;<<1 day prior to the date of the general election.
Section 3. Repealer. All ordinances or parts of ordinances in conflict herewith be, and the
same, are hereby repealed.

Section 4. Severability. If any section, sentence, clause or phrase of this ordinance is held to
be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in
no way affect the validity of the remaining portions of this ordinance.
Section 5. Inclusion in the Code. It is the intention of the Mayor and City Commission of
the City of Sunny Isles Beach, and it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of the City of Sunny Isles Beach, Florida. The
sections of this ordinance may be renumbered or re-Iettered to accomplish such intention, and
the word "ordinance" may be changed to "section", "article", or other appropriate word.
Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

I noted on the attached Ballot Issues Deadlines for the 2012 Elections that the deadline for candidate qualifying
for the General Election is not later than Friday, August 17, 2012. As you know, our Candidate Qualifying Period
is from Tuesday, August 21 to Friday, August 24,2012 (attached). Accordingly we will need to revise our
qualifying period as: Tuesday, August 14, to Friday, August 17, 2012. We will put this item on our September 15,
2011 City Commission meeting agenda. After that meeting, I will forward you the approving legislation.

The attached document is provided for your information. Should your municipality wish to add questions to a
countywide election or call for a special election, it is important that these deadlines be adhered to in order for
us to be able to comply with statutory requirements. Questions need additional time for translations, proofing,
and ballot preparation.
As noted in the document attached, the Presidential Preference Primary Date Selection Committee will
determine the date for the Presidential Preference Primary by no later than the 1st of October. As soon as we
know the date, we will inform you and provide you with a revised schedule for that election.

2012 BALLOT ISSUES DEADLINES
Should a municipality wish to conduct their regularly scheduled or a special election along with the countywide
elections listed below, in order to allow sufficient time for ballot preparation and to meet State-mandated
deadlines to mail absentee ballots to overseas voters, the deadlines listed below must be followed.
Note that per F.S. 100.151, "...the governing authority of a municipality shall not call any svecial election until
notice is given to the supervisor of elections and his consent obtained as to a date... " Once approval is obtained
from the supervisor of elections, the resolution and/or ordinance to call a Special Election must be passed to
meet the deadlines listed below.

Commissioner
RECOMMENDA TION:
It is recommended that the Ordinance be adopted on second and final reading.
REASONS:
Currently Section 26-6 of the City Code provides that candidates for the office of Mayor
or City Commissioner shall qualify with the City Clerk no earlier than 9:00 a.m. on the
76th day and no later than 4:00 p.m. on the 73rd day prior to the date of the general
election. The Miami-Dade County Elections Department has requested that the City
modify the dates for candidate qualifying to no earlier than the 84th day and no later than
the 81 st day prior to the date of the general election to allow them sufficient time to
prepare, print, and mail absentee ballots to overseas voters by the statutory deadlines.
ADDITIONAL INFORMATION:
This change would benefit the City and the Elections Department in providing a more
efficient and smooth election. This would be effective for our next General Election
scheduled on November 6, 2012. The qualifying dates would change from August 21-24,
2012 to the new dates of Tuesday, August 14,2012 to Friday, August 17,2012.
