HomeMy WebLinkAboutOrdinance 2011-372 ORDINANCE 2011-3J~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 14-16 OF THE CITY CODE TO AUTHORIZE CODE ENFORCEMENT LIEN SEARCH FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CITY CODE; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on May 28, 1998, the City Commission of the City of Sunny Isles Beach passed and adopted Resolution No. 98-51, authorizing code enforcement lien search fees; and WHEREAS, Resolution No. 98-51 provided authority for the City's Community Development Department to assess fees ranging from $25.00 to $50.00 when verifying the existence of code enforcement liens; and WHEREAS, on October 16, 2001, the City Commission passed and adopted Ordinance No. 2001-141 establishing Chapter 14 of the City Code pertaining to code enforcement; and WHEREAS, Chapter 14 of the City Code contains a schedule of civil penalties and miscellaneous fee schedule at the end of the chapter, but does not specifically address the issue of code enforcement lien search fees; and WHEREAS, the City Commission desires to amend Chapter 14 of the City Code to specifically authorize the City to impose code enforcement lien search fees. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Ordinance. Section 2. Amendment. Chapter 14 of the City Code is hereby amended as shown, with additions shown in underline and deletions shown in strikethrough. ~ 14-16. Schedule of civil penalties..- and miscellaneous fees schedule. C. The City is authorized to impose the following fees when verifying the existence of code enforcement liens on property located in the City. A company or individual seeking to verify the existence of code enforcement liens shall pay a fee of $100.00 when a turnaround time of less than 24 hours is requested. When the requesting party seeks a turnaround time within 7 days, the requesting party shall pay a fee of $75.00. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the section of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading. Cohen, City Manager DATE: 1012012011 RE: Amendment to Chapter 14 of the City Code to include fees for lien letter. RECOMMENDATION: Staff recommends that the City Commission approve the proposed ordinance. REASONS: Under Resolution 98-51, the City Commission established fees for research of pending code enforcement cases or liens on a particular property. These fees were never established under Chapter 14 which deals with Code Enforcement procedures and fines. This ordinance will incorporate the fee schedule in Chapter 14 and increase the cost for research from $50 to $75 for regular searches and from $75 to $100 for expedited, 24- hour searches. The fee increase will be equivalent to the current fees that the Building Department is charging for open permit search. The difference in cost depends on the requests. ADDITIONAL INFORMATION: The majority of the requests for code enforcement and lien searches are submitted to the Community Development Department by mortgage companies that are in the process of selling a property.
