Schulman gave an invocation. Mayor Edelcup announced that yesterday was the City's ih Birthday and thanked those that helped develop this City, and gave opening remarks of decorum. 3. APPROVAL OF MINUTES 3A. Regular City Commission Meeting - May 20, 2004. 3B. Regular City Commission Meeting - June 3, 2004. Action: Commissioner Iglesias moved and Commissioner Thaler seconded a motion to approve the above-mentioned Summary Minutes. The motion was approved by a voice vote of 5-0 in favor. 4. ORDER OF BUSINESS (AdditionslDeletions/Amendments) 4A. Request to Hear Items: Request to Defer 9B, and to add a committee resignation! appointment, Item lOA. ZONING: ZONING HEARINGS ARE QUASI-JUDICIAL PUBLIC HEARINGS. 6A. Request of Sunny Isles Development Company LLC, Owner of the Property Located at 16901 Collins A venue, Sunny Isles Beach, Florida, for the Following: (SEA) [Hearing #Z2003-16] 1. Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development Regulations the applicant is requesting to transfer 126,737 feet of development rights. 2. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development Regulations the applicant is requesting a site plan approval for a 45-story, 236-unit condominium. Protests 0 Waivers o Ex-Parte o Action: City Clerk Hines read a disclaimer for the Zoning hearing, and read the applicant's name, hearing number, location and then administered the oath to the witnesses for the Zoning hearing. Planning and Zoning Administrator Jorge Vera reported. Public Speakers: Isaac Kodsi, owner; Charles Sieger, Architect; Mary Ann Eicke Isaac Kodsi, owner of the property, introduced Charles Sieger, Architect, who presented a rendering of the project. Mr. Sieger said the difference between no TDRs and TDRs is nine floors, nothing else would change at the base other than the height. Vice Mayor Goodman asked how high is the garage, and Mr. Sieger said it is four floors and is completely enclosed behind the fa~ade, it is at a traffic light, and has one driveway. Vice Mayor Goodman asked if a shower would be provided and Mr. Sieger said that they would install a shower in the beach park, and Vice Mayor Goodman said it could be at the end of the Beach Access. Commissioner Thaler asked if they had all the TDRs, and Mr. Sieger said they would be placed before a permit can be issued, and that the owners are actively seeking to purchase the TDRs. Planning and Zoning Administrator Jorge Vera reported noting the traffic comments on page 30, #1, and Page 34, other conditions #4, regarding the traffic study. Commissioner Thaler asked about the traffic study, and Mr. Sieger went over the site plan. Vice Mayor Goodman asked when they anticipate starting construction on this building and Mr. Sieger said early next year. Deputy City Attorney Ottinot clarified that Condition No.6, based on the discussion at the 2 Summary Minutes: Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach, Rorida June 3, 2004 City Commission meeting, and the policy that was created, we substitute the following language: "That the applicant submit prior to the issuance of a Building Permit evidence to the City of the possession or rights to possession of the Transferred Development Rights equivalent to 50 units and 126,737 square feet". Mr. Sieger reminded the Commission about the shower. Commissioner Brezin moved and Commissioner Iglesias seconded a motion for approval as amended, subject to staff conditions. Request of Dezer Properties 108 LLC, Owner of the Property Located at 15800 Collins A venue, Sunny Isles Beach, Florida, for the Following: [Hearing #Z2003-14] 1. Pursuant to Section 265-18 of the Code of the City of Sunny Isles Beach, the applicant is requesting a site plan approval to permit a temporary trailer to be used as a sales office. 2. Pursuant to Section 265-13 of the Code of the City of Sunny Isles Beach, the applicant is requesting a conditional use to permit a temporary trailer. Protests 1 Waivers 0 Ex-Parte ~ (Deferred from June 3, 2004) Action: City Clerk Hines read a disclaimer for the Zoning hearing, and read the applicant's name, hearing number, location and then administered the oath to the witnesses for the Zoning hearing. Planning and Zoning Administrator Jorge Vera reported. Public Speakers: Peter Weiner; Gil Dezer; Richard Pacetti, Architect Peter Weiner, representing the applicant, reported that the sales trailer is for the proposed project that is going to go across the street on the property known as the Fountainhead, and the former Days Inn properties. He noted that the sales trailers have been there, originally put there under administrative approval by the City, which was rescinded and they went forward with the application. Commissioner Brezin asked for a 15-foot easement, she said we need 150-feet in order to create a bus bay because when the bus approaches from north to south, before it reaches the Arlen properties on that corner, they make a stop, several drivers go around it. She 3 Summary Minutes: Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach, Rorida said we need a free flow of traffic, and that there will be approximately 900-units added to what we already have, and so she asked if they would give to the City an easement of I5-feet so we could have that bay so that we would not be obstructing traffic in that area. She said she was told by a Commissioner that FDOT would probably never approve that type of thing, and that the extreme right-hand lane currently comes to an end, and whoever is in that lane is forced to merge into the left-hand lane, so that would mean that FDOT could not refuse it on the basis that it is difficult for the bus to exit that area because they are coming into a high traffic area and must exit that area into a merging lane. She noted that the trailer is a temporary construction, and she thinks we could live with this until the structure is removed and at that time, grant the City the 15-feet, and she would like that as a condition. Commissioner Iglesias said that FDOT owns the State right-of-way, and they will determine if the bus lane is feasible or not, and it has to be looked at to see what the demand is. Mayor Edelcup asked City Manager Russo to look at it, and provide a staff report, and City Manager Russo said that FDOT would have to study it. Mr. Dezer said that his plan is to use the site right now for the sales trailer and then he will give it to the City when the sales trailer is removed. Planning and Zoning Administrator Vera reported that they have been trying to alleviate some of the traffic issues. He noted that the site plan and conditional use will be subject to the conditions set forth on pages 48, 49, and 50 with the addition that the applicant dedicates a 15-foot easement along the right-of-way of Collins A venue, at the time that the sales trailer is removed, subject to FDOT and NDT A approval. Commissioner Iglesias asked if eventually they would be moving the sales office within the first building once it is built and remove the sales trailer, and Mr. Dezer said it is a possibility. Commissioner Thaler asked how many parking spaces there are, and Richard Pacetti, the Architect for the project, said there are 20 parking places on the north side, and he said that the landscaping will start out at 3-feet but will end up 4-5 feet tall within a growing time frame. Commissioner Brezin moved and Vice Mayor Goodman seconded a motion for approval as amended, subject to staff conditions. Resolution No. 04-Z-86 was approved by a roll call vote of 5-0 in favor. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, 4 Summary Minutes: Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach, Rorida Amending Ordinance No. 2004-203, Establishing Guidelines for the Issuance of Special Events Permits; Providing for the City Manager or Designee with the Authority to Issue, Modify, or Revoke Permits for Special Events; Providing for Enforcement; Requiring Applications for Outdoor Events that are not "Special Events" as Defined Hereunder; Providing for a Repealer; Providing for Inclusion in the Code; and Providing for an Effective Date. Action: City Clerk Hines read the title and Building and Code Enforcement & Licensing Department Assistant Administrator Robert Solera reported that events that encompass 1,000 people or more to require special approval and fees. Public Speakers: none Mayor Edelcup asked when these events occurs if staff handles the si tuation and review it for parking and traffic, as part of the application, and Mr. Solera said yes and that they contact the Police Department to ensure that all issues have been addressed prior to approval. Commissioner Thaler suggested that it should be 500 people and above, and Mr. Solera said that in their past experience that 1,000 people is an appropriate number, and City Manager Russo concurred. Police Lt. Rick Feisthammel reported on traffic and parking issues during large events. Vice Mayor Goodman moved and Commissioner Iglesias seconded a motion to approve the proposal on first reading. The motion was approved by a roll call vote of 5-0 in favor. ORDINANCES FOR SECOND READING (Public Hearings) 8A. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending Ordinance No. 2004-107 Relating to the Rules of Procedure of the City Commission; Revising Rule 5.05 (Section 74-14) to Include Section D. Entitled "Four (4) Day Rule for the Presentation of Agenda Items"; Further Amending Rule 6.03 A Relating to Speaker Registration Cards; Providing for Severability; Providing for Inclusion in the Code and an Effective Date. (First Reading 6/3/04) Action: City Clerk Hines read the title, and Deputy City Attorney Ottinot and Mayor Edelcup reported. 5 Summary Minutes: Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach, Rorida Public Speakers: none Vice Mayor Goodman moved and Commissioner Iglesias seconded a motion to adopt the ordinance. RESOLUTIONS 9A. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving the Proposed Site Plan for the Casino Park Property Located at 17200 Collins Avenue, as Prepared by O'Leary Design Associates, P.A. Attached as Exhibit "A"; Authorizing the City Manager to Do All Things Necessary to Effectuate the Site Plan; and Providing for an Effective Date. Action: City Clerk Hines read the title and City Manager Russo presented the proposed Site Plan, and reported noting that the existing fence on the north side of the property is to be replaced although it showed on the plan that the fence would remain. He said the actual type of lighting of the park and parking lot will be determined on the detailed plans by O'Leary. City Manager Russo noted that there is approximately 100' by 100' unused piece of land targeted for the Miami-Dade Fire Service for an expansion and complete rebuild of the Fire Station on 172nd Street. Public Speakers: Arnold Taft; Gloria Taft Mayor Edelcup said that the Fire Station building will be the responsibility of the County and City Manager Russo said that is correct and that the City would be providing the land. Vice Mayor Goodman asked who would be paying for the services provided by O'Leary and City Manager Russo said that the developer agreed to pay for O'Leary's time and work on this. Commissioner Thaler asked about benches in the park, and City Manager Russo noted that there are about seven benches on the plan but they can place in more benches. Gloria Taft asked if a higher fence can be placed between the park and their complex, and City Manager Russo said that the existing fence is a 5-foot chain length fence with a flat top on it, and that it would be replaced with a picket fence and could possibly go 6 to 8 feet high. Vice Mayor Goodman moved and Commissioner Brezin seconded a motion to approve the resolution. Resolution No. 2004-683 was adopted by a voice vote of 5-0 in favor. 6 Summary Minutes; Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach, Rorida 9B. PUBLIC HEARING A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Accepting the Conveyance of Approximately 0.897 Acres of Property (The "Benhamou Property"), Legally Described as Tract "A" of Golden View, According to the Plat Thereof, Recorded in Plat Book 154, Page 68, of the Public Records of Miami- Dade County, Florida, alkla the Northeast Corner of 183RD Street at North Bay Road, Sunny Isles Beach, Florida and Owned by L.M.D. Associates, Ltd., a Florida Limited Partnership ("Applicant"), in Accordance with and Subject to all of the Applicable Provisions of the City Code and Section 265-23 of the City's Land Development Regulations ("LDRs") Relating to Transfers of Development Rights (''TDRs'') Except as may be Waived by the City Commission; Scheduling a Closing Date and Providing for Required Documents to Effectuate the City's Acceptance of the Benhamou Property and Severence of the TDRs; Further Authorizing the Mayor to Execute Such Other Documents and Agreements as may be Determined by the City Attorney to be Necessary to Consummate the Conveyance of the Benhamou Property to the City, Sever Development Rights from the Benhamou Property and Deposit Same to the Credit of the Applicant in the TDR Bank, Subsequent Withdrawal of Said Development Rights at the Request of, and for the Benefit of, the Applicant as may be Approved by the City Commission During the Five Year Period Commencing with the Passage of this Resolution, and Recordation of Documentation; and Providing for an Effective Date. Action: Mayor Edelcup announced that Stanley Price, Esq., requested additional time to negotiate some of the terms of the transfer with City Manager Russo, and asked for a deferral. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Authorizing a Special Event Permit to Trump Grande Ocean Resort & Residences to Host "X-Channel Launches Live on the Beach with "No Limits" the Ultimate Ramp Jam" and "Alex Morgan Race of the Stars" on Saturday July 24, August 28,2004 and Sunday, July 25, August 29,2004; Providing the City Manager the Authority to Do All Things Necessary to Effectuate this Resolution; Providing for an Effective Date. Action: City Clerk Hines read the title and Cultural and Human Services Director Susan Simpson reported that there have been changes including the dates that have changed to Saturday, August 28, 2004 and Sunday, August 29, 2004, and the VIP event will take place on Friday, August 27, 2004 including fireworks. 7 Summary Minutes: Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach. Rorida Public Speakers: William Lone; Alex Morgan; Juan Urbano of X Channel Mayor Ede1cup asked if this event is taking place on the Trump property and Ms. Simpson said on the beach behind the Trump construction site. Vice Mayor Goodman said he would like to delete the jet skis in the future for anyone using them on the beach because they become dangerous for people in the water, and Ms. Simpson said that this would require another permit from Miami-Dade County which the promoters will be applying for. She said what we are doing tonight is agreeing that it can be held in the City but they still have to go through all the Miami-Dade County permits. William Lone of the Sunny Isles Beach Resort Association, distributed a schedule of events and noted that this event will have 62 million exposures internationally. He reported on traffic and parking issues for this event, and that there would be parking at Haulover, Thunderbird, and under the William Lehman Causeway. He said the Association is incurring a number of costs including: 1) cost for all transportation requirements for all the buses to run people from lot to lot and to the site; 2) electronic signage that the Police require to direct those people in a orderly fashion; and 3) to provide for the procreation of the turtles and have made arrangements to have a turtle sentry. He said that the event is free to the public. He said that the Producer will have to bear the cost of cleanup after the event. Ms. Simpson said that all pre-event advertising will have the City of Sunny Isles Beach logo on it, and during the show there will be banners with the City logo. Lt. Feisthammel reported that the Police Department is involved in the planning of this event. Commissioner Iglesias moved and Commissioner Brezin seconded a motion to approve the resolution, as amended. Resolution No. 2004-684 was adopted by a voice vote of 5-0 in favor. 10. MOTIONS lOA. Call for a Motion to accept the resignations and confirmation of the following appointments to the Mayor's Advisory Council (MAC): · Commissioner Iglesias' Appointment to the Health & Welfare Committee: Accept the resignation of Herbert Abramson and confirm the appointment of Alina Sosa-Perez; and · Vice Mayor Goodman's Appointment to the Education/Schools Committee: Accept the resignation of Phillip Chernoff and confirm the appointment of Laura Arzumanova; and · Commissioner Thaler's Appointment to the Health & Welfare Committee: Accept the resignation of Trina Duluc and confirm the appointment of Mitchell Reich. 8 Summary Minutes: Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach, Rorida Action: City Clerk Hines read the title, and Mayor Edelcup reported. Public Speakers: Phillip Chernoff; Mary Ann Eicke Phillip Chernoff said for the record that he did not resign, that he was removed, and that he recei ved a call from Vice Mayor Goodman and was told that he has been removed from the Committee. Mayor Edelcup said that the City's procedures as such that if he did not resign, he cannot be removed unless the Commission were to act in total. Mr. Chernoff said that under the circumstances he wouldn't want to serve on this Committee, and that he will resign. Vice Mayor Goodman said he did call him and it was done verbally. Mayor Edelcup said we will defer this until we receive a written resignation from Mr. Chernoff. Commissioner Iglesias noted that Herb Abramson did not accept the appointment and therefore he appointed Alina Sosa-Perez to the Health and Welfare Committee, which was just a correction. Commissioner Thaler noted that the resignation of Trina Duluc was verbal. Deputy City Attorney Ottinot said for the record we should have a written resignation. Mayor Edelcup noted that the appointments by Vice Mayor Goodman and Commissioner Thaler will be deferred until written resignations have been received by the City Clerk. Commissioner Brezin moved and Commissioner Iglesias seconded a motion to approve the appointment of Alina Sosa-Perez to the Health and Welfare Committee. The motion was approved by a voice vote of 5-0 in favor. 11. DISCUSSION ITEMS 11A. Discussion regarding Jet Ski Wave Runners. Action: City Manager Russo reported that two complaints were received concerning the operation of jet skis, one was a letter from the Sands Point Association, and the issue was generally the pollution, the gas power, the smell that comes out of the jet skis going in and out, traveling too close to shore, and just getting from the shore, if they are going out to the location that they are allowed to use them. He said that looking into this, the beach is operated by the County, the permitting for jet skis on our beach which is typically the hotels, one is the Newport, and the other is the Sonesta Hotel, there may be another, but those are the two that he knows of. He said that the County has laws on this, there is a channel that they have to mark off to go from the location, what he thinks is a 300-foot mark which is the swim line, and they can go beyond that line. City Manager Russo noted that the two fundamental issues are the pollution that these jet skis give off being gas-powered, getting out to that point because, whether they are in the channel or not, it is the same water that is going to where people are swimming, and then staying beyond that 300-foot area. He said in checking this out, it was found that the County would very 9 Summary Minutes: Regular City Commission Meeting June 17, 2004 City of Sunny Isles Beach, Rorida much love, by an agreement, to hand over this huge headache and a money loser for the County to permit things like this on their property, so they are trying to get this burden out of their hands. He said that the only two communities that we found, one in Miami- Dade, was Surfside, and the reason they did this was to pass an ordinance and ban it all together, and there are ramifications to this. There are a couple of operators in the City there is apparently a desire a need a demand on the part of some of our residents to do this but that is one option. Boca Raton did the same thing, but they took it over to ban it. However, in having a staff meeting on this about a week ago, and the City Attorney is still doing research on this, but came up with a couple of things: 1) they are running under a County ordinance so we can instruct our lifeguards to call our Police who can issue tickets; and 2) we issue occupational licenses to the businesses that are operating these jet skis. He said we feel that we have jurisdiction to possibly revoke those occupational licenses for any unlawful action under the requirements. He said that we may have to pass an ordinance or strengthen our Code Enforcement Ordinance on that to take that approach if we want to, for example, if we do that there is some things that we found that we could possibly address some of the concerns, if we require in an ordinance that they use oxygenated fuels this would remove the vapor, the pollution that comes out of it, and we can encourage or actually eliminate the use of two-stroke engines, four- stroke engines now have to meet EP A standards which would not have that release of the fuels that comes out of these now with the fumes. Public Speakers: Mary Ann Eicke; Babu Y. Rao Mayor Edelcup said that we are talking about the health, welfare and safety of the people and that the easiest choice would be to ban them altogether but that interferes with hotel operations that want to offer amenities. He said if we are going to allow them, maybe there should only be a few designated areas on the beach that this kind of water sports would be permitted. He said there is a water hazard, safety hazard, noise hazard and also the gasoline hazard involved in this. Commissioner Brezin agreed however, we are drawing a fine line, and need to conduct a study on this before we make a concrete decision. Commissioner Thaler said he feels that it should be banned because they are very dangerous. Vice Mayor Goodman they run to close to the beach, and there is a boat rental at 163rd Street and they have jet skis, and they run the intercoastal. Commissioner Iglesias agrees and said that enforcement is very important, and if no one else has them now to ban them except who already has them, and those that have them have to be regulated and if they break the rule, they lose their license. City Manager Russo concluded that we should look at our ability through Code Enforcement and Occupational License Ordinance and see how we can go that route of strengthening that Ordinance to accomplish this. Mayor Edelcup added that we would like to ban future ones but to grandfather in the current ones as long as they obey strict enforcement as yet to be determined by the City. City Manager Russo said that we will look into that because he is not sure that we can deny an occupational license to something that the County allows. He said we will have to get the County to limit how 10 Summary Minutes: Regular City Commission Meeting June 17,2004 City of Sunny Isles Beach, Rorida many permits they will issue and we would then have the corresponding issue of occupational license permit. He said that there is one more that is being approved which is the Tumberry Beach property at the north end, and those are the only three that he knows of. llB. Discussion regarding the City's Color Pallet for Building Exteriors. Action: Robert Solera, Assistant Administrator for the Building Department, reported that they have been dealing with the issue at Winston Towers 600, they had an application for the color pallet, and they are negotiating and seeing what they can do, and they have a meeting with City Manager Russo on Monday regarding this and he would like to wait until that meeting takes place so they have an idea of which direction they will be taking. Mayor Edelcup asked if at the present time the painting of that building has ceased until we get a resolution on this, and Mr. Solera said that the painting on the building continues on the areas which are correct in the terms of the paint that is being used which is part of the pallet that the City has. Public Speakers: Phillip Chernoff; Mr. Nunez, Winston Towers Association Mayor Edelcup said we need to get the final report from the City Manager, but if the City erroneously gave approval of an incorrect color, then the City would be liable, and we will take it from there. City Manager Russo said that may not be an accurate statement but that we will get the right information, the color is not in the pallet, and Mayor Edelcup said that the City should not have approved it if it was not in the pallet. Planning and Zoning Administrator Vera said that the main painted area was the color for the trim, they should have painted the ban portion at the top of the wall, not the entire wall. Mayor Edelcup said that Mr. Nunez of the Winston Towers Association, will have to change the color of the wall at his expense. Commissioner Iglesias said in the future that a picture of the building should be brought in to show exactly where the colors will be so we don't have this confusion again. Mayor EdeIcup said no matter what it appears that we are going to have to change the color on the wall of that building so it conforms to something that is on the pallet. 12. CITIZENS' FORUM: REQUESTS, PETITIONS & OTHER COMMUNICA TIONS 12A. Request of Mercedes Cantrell and Isaac Aelion to discuss the Beachwalk. Action: Isaac Aelion requested that the City stop the beachwalk project before it even gets tabled, because it has safety issues.
