ORDINANCE NO. 2012-.380
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING THE
OFFICIAL ZONING MAP OF THE CITY OF SUNNY ISLES
BEACH PURSUANT TO SECTION 265-4 OF THE CITY CODE
TO MAKE IT CONSISTENT WITH THE LAND USE MAP;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
INCLUSION IN THE CODE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City approved a "Small Scale Amendment to the Future Land Use Map"
of the City of Sunny Isles Beach in September 2011 ;
WHEREAS, the City is in need of amending its Official Zoning Map to be consistent
with its Future Land Use Map.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Amendment. Pursuant to Section 265-4 of the City Code, the official zoning map
of the City of Sunny Isles Beach is hereby amended as described in Exhibit "A".
Section 2. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 3. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 5. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

Amendment to the Official Zoning Map
RECOMMENDATION:
Staff recommends approval of this Ordinance
REASONS:
The City is in need of amending its Official Zoning Map to be consistent with its Future
Land Use Map.
ADDITIONAL INFORMATION:
On September 2011, the City Commission adopted a "Small Scale Amendment to the
Future Land Use Map" of the City. This amendment was determined to reflect on the
Future Land Use Map the new City's properties as recreational open space. Based on this
amendment, it is necessary to update the City's Official Zoning Map to be consistent
with its Future Land Use Map.
