HomeMy WebLinkAboutOrdinance 2012-382 ORDINANCE NO. 2012-.36..~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 10 ENTITLED BUDGET PROCEDURES TO CREATE A NEW SECTION ENTITLED EMERGENCY FUND BALANCE RESERVE; REQUIRING BUDGET AMENDMENTS BE APPROVED BY ORDINANCE; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida law requires the City Commission to adopt a balance budget each year; and WHEREAS, the purpose of this ordinance is to implement sound fiscal practices with regard to the administration of reserve funds in the City of Sunny Isles Beach; and WHERAS, the City Commission wishes to maintain an emergency reserve fund to provide funding for emergency purposes. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 10.1 of the City of Sunny Isles Beach Code of Ordinances is hereby amended to read as follows: S 10-1 Amendments to Budget. A. Minor amendments. Transfers between line items or department accounts within departmental budget or decreases in line items or department accounts not amounting to more than 20% of the total budget of each department may be made by the City Manager by written statement describing the transfers and the reasons therefore. A copy of such statement shall be field with The City Clerk and delivered to the Mayor and each of the City Commissioners. A copy shall also be posted at a conspicuous place in City Hall. The transfers shall become effective 14 days after posting unless the Mayor or any member of the City Commission notifies the City Manager that he/she wishes the transfer to be placed upon the Agenda of the next City Commission meeting for consideration by the entire City Commission. A transfer considered by the Commission must be approved by majority. B. Other amendments. If a budget amendment is required for a purpose not specifically authorized in paragraph "A" above, the budget amendment must be adopted by ordinance. resolution of the City Commission.; provided, hov/ever, up to 1 % of the contingency reserve fund may be transferred to any departmental budget by approval of a duly enacted resolution. Prior to the execution of the TRIM notice form commonly called DR -420, the City Manager or Finance Director shall request approval by Resolution the proposed operating millage rate for the fiscal year. The City shall maintain a minimum emergency reserve fund balance in the General Fund of at least $10 Million Dollars. The "Emergency Reserve Fund" shall be limited to the following purposes: A. To provide required emergency funding as a result of a declared emergency. B. To provide required funding for an unanticipated but urgent threatening of the public health, safety, and welfare of the City of Sunny Isles Beach. C. The Emergency Reserve Fund shall only be utilized by resolution of the City Commission for the reasons stated in subparagraphs "A" and "B" by a super-maiority vote of the City Commission. For purposes of this Section, super-maiority means a 4- 1 vote of the City Commission. If the Emergency Reserve Fund is increased beyond the minimum $10 Million Dollars amount, the restrictions stated in this section shall not apply for use of reserve funds above the $10 Million Dollars minimum. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the Words added underlined, words 5tfiGkoo deleted (ed) Page 2 of3 City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. Ede1cup, Mayor DATE: 2/1612012 RE: Ordinance Establishing Emergency Reserve Funds RECOMMENDATION: The attached Ordinance is presented for your approval. REASONS: One of the major responsibilities of the City Commission is to ensure fiscal stability. For several years, the City has maintained a healthy reserve fund of $1 0 Million Dollars to be used for emergency purposes. To protect our rainy day fund and to ensure the availability of funds for man-made or natural disasters, I am proposing the attached Ordinance to codify that the City must keep a minimum of $1 0 Million Dollars as a rainy day fund. Under the proposed Ordinance, the $10 Million Dollars rainy day fund must be used for emergency purposes only. In order to use the rainy day funds, the City Commission is required to approve any use of the funds by resolution upon a super majority vote, which is 4-1.
