AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING
SECTIONS 265-5 AND 265-46 OF THE ZONING CODE TO
REVISE OFF-STREET PARKING STANDARDS; PROVIDING
FOR A REPEALER; PROVIDING FOR SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, it has been determined that the off-street parking standards should be
amended to provide flexibility for off-street parking spaces; and
WHEREAS, it has also been determined that the minimum parking spaces required for
multifamily dwellings should be amended to require units greater than 1800 square feet to
provide for two parking spaces per unit.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1.

Amendment to Section 265-5. Section 265-5 of the City Code is amended to read
Parking Space, Tandem - A parking space within a group of two or more parking spaces
arranged one behind the other. An arrangement of parking spaces such that one or more spaces
must be driven across in order to access another space or spaces irrespective of how configured,
that involves (a) moving at least one vehicle parked in a space in order to reach and move other
vehicles out of another parking space, or (b) the parking of two or more vehicles that are parked
adiacent to one another, either end to end or above the other.
Section 2. Amendment to Section 265-46. Section 265-46 of the City Code is amended to
read as follows:
A. General. Every building, use or structure, constructed or altered after the effective date
of LDRs shall be provided with off-street parking facilities in accordance with the
provisions of this article for the use of occupants, employees, visitors or patrons. Such
off-street parking facilities shall be maintained and continued as long as the main use is
continued.
(4) Tandem parking. Tandem parking shall abide by the definition under Article II of
this chapter. Twenty percent of the required off-street parking spaces, other than
handicapped parking, may be permitted as tandem parking. If twenty four (24)
hour valet service is provided in perpetuity, one hundred percent (100%) of the
required parking may be permitted as tandem. Tandem parking spaces shall meet
the dimensional requirements of the chapter for standard parking spaces; the drive

aisle may be reduced to 18 feet. All applications for the use of tandem parking
must be approved by the City Commission, and the applicant must enter into an
agreement, recorded in the public records at the expense of the owner, and shall
run with the land and shall bind the heirs, successors, and assigns of said owner,
which requires all developments having any tandem parking spaces to provide
twenty-four-hour valet parking service. For the purpose of this Chapter, only one
of the tandem spaces shall be considered as fulfilling part of the required parking.
Notwithstanding any provision in this Chapter, self-parking by unit owners is
permitted within non-mechanical parking spaces. Self-parking is prohibited when
mechanical parking lifts or any other type of mechanical parking devices are used.
B. Amount of off-street parking. The minimum number of off-street parking spaces to be
provided and maintained for each use or occupancy shall be as follows:

parking .
Section 3. Zoning in Progress. The City hereby declares zoning in progress. All applications
for development approval filed prior to the date of adoption of this Ordinance and not yet acted
upon by the Commission shall be reviewed and approved pursuant to the provisions of this
Ordinance.
Section 4. Repealer. All ordinances, or parts of ordinances in conflict herewith be, and the
same, are hereby repealed
Section 5. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.

Section 6. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may
be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required.
Section 7. Effective Date. This Ordinance shall be become effective ten (10) days after
adoption at second reading.

Amendment to Sections 265-5 and 265-46 of the City Code
RECOMMENDATION:
This Ordinance is presented for your consideration.
REASONS:
It has been determined that the off-street parking standards should be amended to provide
flexibility for off-street parking spaces. More precisely, the rules should be amended to
state that if twenty four (24) hour valet service is provided in perpetuity, then one
hundred percent (100%) of the required parking may be permitted as tandem parking.
Additionally, the off-street parking rules should be amended to permit self-parking by
unit owners within non-mechanical parking spaces, while prohibiting self-parking in
mechanical parking lifts or any other type of mechanical parking device.
Finally, the amount of off-street parking for mulitfamily dwelling should be amended to
require Developers to provide for two parking spaces per unit for condominium units
with the size of 1,800 square feet or greater. Please note that 1.5 parking spaces per unit
is required for smaller units.
By adopting this Ordinance, the City Commission will help provide for more available
and efficient off-street parking in the City.
