A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING
THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO
EXPEND UP TO SIXTY-ONE THOUSAND THREE
HUNDRED FIFTY-THREE DOLLARS AND FORTY-FIVE
CENTS ($61,353.45) FROM THE FEDERAL FORFEITURE
(DOJ) FUNDS FOR THE PURCHASE OF ONE
UNDERCOVER VEHICLE, LASER SPEED DETECTORS,
TACTICAL POLICE RADIOS AND MISCELLANEOUS
INVESTIGATIVE EQUIPMENT FOR THE POLICE
DEP ARTMENT; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the
request of the Chief of Police to the governing body of a municipality, federally forfeited funds may
be expended if accompanied by written certification by the Chief of Police that the request complies
with the provisions of the Comprehensive Crime Control Act of 1984; and
WHEREAS, the Chief of Police has submitted a request for the expenditure of up to Sixty-
One Thousand Three Hundred Fifty-Three Dollars and Forty-Five Cents ($61,353.45) in federally
forfeited funds in compliance with the aforementioned.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification,
the Chief of Police is hereby authorized to spend up to $61,353.45 from the established Department
of Justice (DOJ) federal forfeitures account for the purchase of one Police vehicle and other
requested equipment.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.
PASSED AND ADOPTED this 16th day of February 2012.

Sunny Isles Beach Police Department:
As per my conversations with Captain Michael Grandinetti of the Sunny Isles
Beach Police Department, I am writing this letter to validate the sole s9urce
status of Quote # 092311JB, dtd Advanced Covert Technologies and Tactical
Technologies Inc., as the sole manufacturer, distributor and trainer of the item
listed below in this correspondence. The Tactical Technologies Inc.
manufactured item listed is only available from Tactical Technologies Inc., and
the functions and features that make this unique frequency agile RF audio
recovery product qualify as a Sole Source item are as follows:
1. Transmitter (ACT 703-INT Synthesized Tiny Tot "2"): This disguised
rechargeable device housed inside a solid metal housing is an officer safety
transmitter, fully synthesized and programmable in frequency and voice
scrambling with or without a computer.
Transmitter radio frequency power output (500mW or % Watt RF) exceeds
that of all other manufacturers in a device this size (1.35" X 2.5" X .445")
with internal rechargeable Lithium Polymer battery. It is compatible with all
Windows 9X or better OS, and no dedicated computer or computer cards are
required. No other manufacturer is known to provide voice scrambling or
unlimited user frequency programming in a system such as the ACT 703-INT
programmable transmitter, or user computer less programming with companion
receivers manufactured by Tactical Technologies Inc.
Operating frequency may be set in any channels available for surveillance (150
to 174 MHz) with provided JOEY software and or without any computer or
software when using the Tactical Technologies Inc. companion receiver. In order
to change the ACT 703-INT operating frequency, it is not necessary to send back
to the manufacturer. Channels MAY be set with any Windows 9X or better OS,
with or without the furnished software. No dedicated computer is necessary for
all operations, but ANY Windows 9X or better-based PC MAY be used. This
allows field personnel to reduce interference and minimize interception by
changing frequencies often. It also allows for cooperative use with other law
enforcement agencies, and eliminates any requirement for returning equipment
to the manufacturer to change frequencies.
The ACT 703-INT Tiny Tot 2 transmitter is Type Certified by the Federal
Communications Commission, and meets the new EIA 102 "Analog" Narrow
Band compliant standards established by the FCC. The ACT 703-INT Tiny Tot 2
synthesized transmitter will also seamlessly integrate into existing inventories of
Tactical Technologies Inc. and other state and local agencies in their area of
operations. Therefore, reducing coordination required to conduct inter-agency

surveillance operations and most importantly, increase Officer Safety and quality
evidence collection.
2. ACT-24 Companion ReceiverJ Recorder Kit (Citation 24): This is the only
manufactured intelligence receiver that can program frequency (read/write)
to and from the transmitters or transcorders listed above, and does NOT
ever require a computer. It also, unlike others, covers the entire frequency
spectrum from 150-174 MHz with no special segments planned when ordering. It
contains an on-board Olympus DS-50 Digital Voice Recorder with 1 GB of audio
storage that allows the end user to transfer digitally recorded RF Audio from a
transmitter direct to a CD or PC for evidence collection. The CT-24 is "Field
Programmable" by the end user direct from the panel and the receiver is housed
inside a Pelican 1120 series case.
Tactical Technologies Inc. guarantees the ACT-24 Receiver/Recorder Kit
(Intelligence Kit) for 3 Years following delivery and on-site training at no cost. It
is Type Certified by the Federal Communications Commission, and meets the
new EIA 102 "Analog" Narrow Band compliant standards established by the
FCC. It is currently in use by Federal, State, and local law enforcement agencies
through out the United States.
In conclusion, Tactical Technologies Inc. and the above mentioned RF
synthesized transmitter device is guaranteed for 3 Years following delivery. This

SOLE SOURCE JUSTIFICATION & WARRANTY INFORMATION
Adaptive Digital Systems, Inc. is the sole source and the only manufacturer. direct distributor of
the MICRO-EAGLE, MICRO-FINCH, NANO-FLEX, RAVEN, family of covert recorders.
In addition, the optional Officer Safety Transmitter (OSRFT), and TX-500 high power
transmitter, support microphones, HCAM, and VERSA-CAM cameras, complementing Digital
Recorder Support Units (DRSU), RF-SW, the Portable Digital Recorder Support Unit
(PDRSU), and the SCRIBER system, are also manufactured and distributed by ADS. The listed
products are exclusive designs and are only manufactured, advertised and distributed by ADS.
The hardware and software is proprietary to ADS.
Commercially available recorders are not applicable for surveillance operations for a
number of reasons. The key ones are:
. There is no nrotection built in for the digital data, hence in court the evidence can
be questioned as to having been altered
. Commercial units would tend to be larger in size, typically 2X, making their use in
undercovef operations inherently unsafe
. The ADS cameras and lenses are custom made for low light applications and yield
much bettef video.
Our recorder technology has been around for over 22 years. We have over 30,000 video / audio
recorders in the field. Federal, State, Local and even courts overseas have examined and have
had no problems with our recorders because of the evidence protection we put into it and becaust:

ADS manufactured equipment carries a "Standard Warranty" for 7 years from the date of
shipment. The warranty covers all electrical, mechanical failures of the recorder unit, the
cameras and microphones. The only instance the warranty is void is if the unit has obvious
ohysical damae:e that also damaged the circuit cards. In this instance the customer would
be liable only for the actual repair cost. All software updates inside the recorders and for
tbe PC are always free.

Approval to Expend Partial Forfeiture (DOJ) Funds for the
purchase of an Undercover Vehicle, Laser Speed Detectors,
Tactical Police Radios and Miscellaneous Investigative Equipment
to be used by our Detectives, in an amount not to exceed
$61,353.45
RECOMMENDATION:
It is recommended that the City Commission approve the expenditure of partial
Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as
the results of investigative participation in forfeiture and seizure cases. These
funds are permissible by law to be spent for the purchases of police equipment
and other law enforcement activities. It is requested that we be permitted to
utilize up to $61,353.45 of said funds on deposit for such purpose.
REASONS:
The Sunny Isles Beach Police Department actively participates in a DEA I HIDTA
(High Intensity Drug Trafficking Area) Initiative Group that conducts numerous
ongoing proactive investigations and has a need for the attached listed
equipment.

One of the benefits of participating in and providing personnel into high intensity
