RESOLUTION NO. 2012-~Z.
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, TERMINATING THE
DECLARATION OF RESTRICTIONS ISSUED PURSUANT TO
RESOLUTION NO. 05-Z-99; AUTHORIZING THE CITY
ATTORNEY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, by Resolution No. 05-Z-99, adopted on December 8, 2005 the City
Commission approved a development project known as the Da Vinci condominiums; and
WHEREAS, a Declaration of Restrictions was filed in the property records of Miami-
Dade County pursuant to Resolution No. 05-Z-99; and
WHEREAS, the City Commission wishes to terminate the Declaration of Restrictions
due to the fact that the zoning approval has expired.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Termination of Declaration of Restrictions. The City Commission hereby
terminates the Declaration of Restrictions issued pursuant to Resolution No. 05-Z-99 for the
Da Vinci project.
Section 2. Authorization of the City Attorney. The City Attorney is hereby authorized to do
all things necessary to effectuate the terms of this resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.

Termination of Declaration of Restrictions
RECOMMENDATION:
It is recommended that the attached Resolution be approved.
REASONS:
On or about December 8, 2005, the City Commission approved Resolution No. 05-Z-99
for the development of the Da Vinci condominium project. Pursuant to the
aforementioned Resolution, the developer was required to file a Declaration of
Restrictions in the public records of Miami-Dade County. The Declaration of Restrictions
is no longer valid due to the zoning approval's expiration. The termination of the
Declarations of Restrictions will facilitate the sale of the Da Vinci property.
