A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING
THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO
EXPEND UP TO SEVEN HUNDRED SEVENTY-FOUR
THOUSAND NINE HUNDRED EIGHTY-SIX DOLLARS
($774,986.00) FROM THE FEDERAL FORFEITURE (DOJ)
FUNDS FOR THE ADDITION OF SIX (6) NEW, NON
BUDGETED POLICE OFFICER POSITIONS, PURCHASE OF
SIX (6) ADDITIONAL POLICE VEHICLES, START-UP
COSTS FOR UNIFORMS AND EQUIPMENT FOR NEW
POSITIONS AND MISCELLANEOUS INVESTIGATIVE
ELECTRONICS AND TACTICAL EQUIPMENT; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the
request of the Chief of Police to the governing body ofa municipality, federally forfeited funds may
be expended if accompanied by written certification by the Chief of Police that the request complies
with the provisions of the Comprehensive Crime Control Act of 1984; and
WHEREAS, the Chief of Police has submitted a request for the expenditure of up to Seven
Hundred Seventy-Four Thousand Nine Hundred Eighty-Six Dollars ($774,986.00) in federally
forfeited funds in compliance with the aforementioned.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section I. Expenditure of Partial Federallv Forfeited Monies. Based on the attached certification,
the ChiefofPolice is hereby authorized to spend up to Seven Hundred Seventy-Four Thousand Nine
Hundred Eighty-Six Dollars ($774,986.00) from the established Department of Justice (DOJ) federal
forfeitures account for the addition of six (6) new, non budgeted police officer positions, purchase of
six (6) additional police vehicles, start-up costs for uniforms and equipment for new positions and
miscellaneous investigative electronics and tactical equipment.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

prevention, community policing projects.

Approval to Expend Partial Forfeiture (DOJ) Funds for the addition
of six (6) new, non budgeted police officer positions, purchase of
six (6) additional police vehicles, Start-Up Costs for Uniforms and
equipment for new positions and miscellaneous investigative
electronics and tactical equipment, in an amount not to exceed
$774,986.00
RECOMMENDATION:
It is recommended that the City Commission approve the expenditure of partial
Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as
the results of investigative participation in forfeiture and seizure cases. These
funds are permissible by law to be spent for the purchases of police equipment
and other law enforcement activities. It is requested that we be permitted to
utilize up to $774,986.00 of said funds on deposit for such purpose.
REASONS:
The Sunny Isles Beach Police Department actively participates in a DEA 1 HIDTA
(High Intensity Drug Trafficking Area) Initiative Group that conducts numerous
ongoing proactive investigations and has a need for the attached listed
equipment and purchases.
ADDITIONAL INFORMATION:
As part of the City Managers Reorganizational Plan, DOJ Forfeiture Funds will
be used to support the costs of Six New Police Officers, Community Policing

Unit, Vehicles and Associated Equipment for the first year of service. After the
first year of service, all salaries and associated costs will be absorbed in the
Police Departments Budget.
FUNDING SOURCE:
All costs will be paid from the Federal Forfeiture (DOJ) Fund for the first year of
service.
