A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING AN
AMENDMENT TO THE AGREEMENT WITH HARBOUR
CONSTRUCTION, INC. TO PROVIDE ASBESTOS REMOVAL
AND DISPOSAL SERVICES FOR 151 & 215 SUNNY ISLES
BOULEVARD IN AN AMOUNT NOT TO EXCEED $34,230.00,
ATTACHED HERETO AS EXHIBIT "A"; PROVIDING THE CITY
MANAGER WITH THE AUTHORITY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by Resolution 2012-1839, adopted January 19'h, 2012, the City Commission
approved the agreement with Harbour Construction to provide demolition services for the
properties located on Sunny Isles Boulevard; and
WHEREAS, the City intends to demolish the building and use the land for public park;
and
WHEREAS, the City wishes to amend the agreement to include asbestos removal and
disposal services for 151 & 215 Sunny Isles Boulevard in an amount not to exceed Thirty Four
Thousand Two Hundred and Thirty Dollars ($34,230.00), attached hereto as Exhibit "A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Aooroval of the Amendment. The City Commission hereby approves the
Amendment to the Agreement with Harbour Construction, Inc, to provide Asbestos removal and
disposal services for 151 & 215 Sunny Isles Boulevard in an amount not to exceed Thirty Four
Thousand Two Hundred and Thirty Dollars ( $34,230.00), attached hereto as Exhibit "A" .
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.

Approving Amendment to Harbour Construction
RECOMMENDATION:
It is recommended that the attached Resolution be approved.
REASONS:
In January, the City hired Harbour Construction to provide the first phase of the
demolition services for 151 & 215 Sunny Isles Boulevard. During the demolition process,
asbestos impacted material was discovered and needs to be removed. This resolution is
approving an amendment to the contract with Harbour construction to remove and
dispose of the asbestos in compliance with all currently applicable local, state and federal
laws.
FUNDING SOURCE:
Funding is available in the Gateway Park Project account number #35-600-5688.

This First ~dment to the Agre~rnent between the City of Sunny Isles Beach and Harbour Construction,
Inc., executed this day of (J ~ ' 2012, is made a part of the original Agreement between the parties
dated January 11,2012 attached hereto as Attachment "A" and incorporated herein, between the City of Sunny Isles
Beach ("City") and Harbour Construction, Inc., ("Contractor") a business corporation licensed in the State of
Florida, whose Federal Identification # is . The City and Consultant hereby agree as follows: .
t. SERVICES TO BE PERFORMED. The scope of services, as set forth in Section 2 of the
Agreement, is hereby amended to include Asbestos Abatement, Le. the removal and disposal of asbestos
containing materials as appear on the asbestos survey performed by ATC project 31-31174-0014 as more
particularly described in Attachment "A" attached hereto and made part hereof.
2. COSTS. The payments to the Consultant, as set forth in Section 4 of the Agreement, is hereby
amended to include compensation for the asbestos removal in an amount not to exceed Thirty Four
Thousand Two Hundred and Thirty Dollars ($34,230.00) for the services to be performed, bringing the
total amount not to exceed One Hundred Twenty Nine Thousand Seven Hundred Fifty Dollars
($129,750.00). .
4. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms
and conditions of the original Agreement between the parties, dated January 11,2012, shall remain in full
force and effect.

above.

PROPOSED STATEMENT OF SERVICES: Provide materials, equipment, aDd labor to safely abate ACM
(Asbestos Containing Material) from 151 & 215 Sunny Isles Blvd. as per survey perfonned by ATe #31-
31174-0014.
SCODe of Services:
THIS PROPOSAL COVERS LABOR, MATERIALS, PERSONAL AIR MONITORING, FEES, LICENSES
AND OTHER EXPENSES REQUIRED TO PERFORM TIlE WORK IN COMPLIANCE WITH ALL
CURRENTLY APPLICABLE LOCAL, STATE AND FEDERAL REGULATIONS.
SCOPE OF PROPOSED OPERA nONS:
The safe removal and disposal of asbestos containing materials as appear on the asbestos survey performed by
ATC project # 31-31174-0014.
If additional asbestos impacted material, not included in this proposal are discovered or revealed during the
abatement the Owner will be notified prior to any additional work.
DOCUMENTATION TO BE FURNISHED TO OWNER/OWNER'S REP~ESENTATIVE:
Safe Disposal Chain of Custody Documents.
AIR MONITORING & FINAL CLEARANCES:
ANY REQUIRED AIR MONITORING, OTHER THAN OSHA PERSONAL AIR MONITORING, SHALL
BE PERFORMED BY A LICENSED, INDEPENDENT CONSULTING FIRM AND SHALL BE THE
FINANCIAL RESPONSIBILITY OF OWNER.

OtHER PROVJSIONS:
Asbestos abatement is performed under strictly contained conditions; with access restricted to all persons other
than those speolfically authorized for work or inspection purposes. Contained work areas are posted with
warning signs and monitored by Contractor's personnel to prevent unlawfuJ entry. OWner andlor his
representative or agent is enjoined with reinforcing Contractor's efforts in whatever manner circumstances
dictate.
Removal of vinyl tile and mastic usually requires tbe use f}f cleaning solutions specially formulated for this
application. Although agents utilized are considered to be low in odor, some people have sensitivity to the
fumes. It is the responsibility of the owner to Mtlty all other persons who may be on or have access to the
premises other than Harbour Construction's own employees.

The proposed fee to perfonn these services is: $34. 230.00
It should be noted that this fee is subjected to change if the scope of work is changed or modified.
