A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST
AMENDMENT TO AGREEMENT WITH STEIGERBUlL T, LLC. FOR
INSTALLATION OF LANDSCAPING AND IRRIGATION OF THE
LOT LOCATED AT 16100 COLLINS AVENUE, AND REMOVAL AND
DISPOSAL OF THE CONCRETE WALL DIVIDING 16100 AND 16200
COLLINS AVENUE, FOR THE INTRACOASTAL PARKS PROJECT,
IN AN AMOUNT NOT TO EXCEED THIRTY-SEVEN THOUSAND
EIGHT HUNDRED FIFTY DOLLARS ($37,850.00), ATTACHED
HERETO AS EXHIBIT "An; AUTHORIZING THE MAYOR TO
EXECUTE SAID FIRST AMENDMENT TO AGREEMENT;
AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, on January 19,2012 via Ordinance No. 2012-378, the City Commission
authorized an amendment to the City's Budget for the 2011/2012 Fiscal Year Capital Projects
Funds to increase the Intracoastal Parks account to complete the landscaping project at the
Intracoastal Parks at 16700 Collins A venue; and
WHEREAS, due to the current deteriorating condition of the Intracoastal Parks the City
Manager determined that there was a need to retain a contractor for the installation of
landscaping and irrigation of vacant lots located at 16050 and 16000 Collins A venue; and
WHEREAS, on March 15,2012 via Resolution No. 2012-1882 the City Commission
entered into an Agreement with Steigerbuilt, LLC waiving the formal competitive bidding
procedures pursuant to Section 62-12 of the City Code, in an amount not to exceed Fifty-Three
Thousand Five Hundred Dollars ($53,500.00), for the installation of landscaping and irrigation
of vacant lots located at 16050 and 16000 Collins Avenue; and

WHEREAS, the City now wishes to approve the First Amendment to Agreement with
Steigerbuilt, LLC. to include the installation of landscaping and irrigation of the lot located at
16100 Collins Avenue, as well as the removal and disposal of the concrete wall dividing 16100
and 16200 Collins Avenue, in an amount not to exceed Thirty-Seven Thousand Eight Hundred
Fifty Dollars ($37,850.00), bringing the total amount not to exceed to Ninety-One Thousand
Three Hundred Fifty Dollars ($91,350.00) for the Intracoastal Parks Project, attached hereto as
Exhibit "An.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section I. Aooroval of First Amendment to Agreement. The City Commission hereby
approves the First Amendment to Agreement with Steigerbuilt, LLC. for the installation
of landscaping and irrigation of the lot located at 16100 Collins Avenue, and removal and
disposal of the concrete wall dividing 16100 and 16200 Collins A venue, for the Intracoastal

Parks Project, in an amount not to exceed Thirty-Seven Thousand Eight Hundred Fifty Dollars
($37,850.00), attached hereto as Exhibit "A".
Section 2. Authorization of Mavor. The Mayor is hereby authorized to execute said First
Amendment to Agreement.
Section 3. Authorization of Citv Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 4.
Effective Date. This Resolution will become effective upon adoption.

FIRST AMENDMENT TO THE AGREEMENT BETWEEN
THE CITY OF SUNNY ISLES BEACH AND STEIGERBUILT, LLC.
" CONTRACT NO. C1112 -031
This First Amendment to the Agreement between the City of Sunny Isles Beach and Steigerbuilt, LLC,
executed this 'go day of �R 2 , 2012, is made a part of the original Agreement between the parties dated
March 20, 2012, ( "Agreement "), attached hereto as Attachment `B" and incorporated herein by reference, between
the City of Sunny Isles Beach ( "City ") and Steigerbuilt, LLC ( "Contractor ") a business corporation licensed in the
State of Florida, whose Federal Identification # is 264344330. The City and Contractor hereby agree as follows:
1. ADDITIONAL SERVICES TO BE PERFORMED. The scope of services, as set forth in Section 2 of
the original Agreement, is hereby amended to include the installation of landscaping and irrigation of the vacant lot
located at 16100 Collins Avenue, as well as the removal and disposal of the concrete wall dividing 16100 and
16200 Collins Avenue (east to west), as more particularly described in Attachment "A ", which is attached hereto
and incorporated herein by reference.
2. COST. The payments to the Contractor, as set forth in Section 4 of the original Agreement, is hereby
amended to include additional compensation for the additional services to be performed, in an amount not to exceed
Thirty Seven Thousand Eight Hundred Fifty Dollars ($37,850.00), bringing the total amount not to exceed Ninety
One Thousand Three Hundred Fifty Dollars ($91,350.00),
3. TIME FOR COMPLETION AND LIQUIDATED DAMAGES. Contractor shall be required to
complete the additional services described herein no later than sixty (60) days from the issuance of a Notice to
Proceed from the City Manager or his designee. In the event the additional services are not completed within this
sixty (60) day deadline, and in the absence of any extension granted by the City, then the Contractor shall be
required to pay a liquidated damage penalty of $500.00 (five hundred dollar) for each calendar day the additional
services remain incomplete, continuing to the time at which the additional services are complete. The additional
provisions of Section 5 of the original Agreement ( "Liquidated Damages ") shall be applicable hereto.
4. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and
conditions of the original Agreement between the parties, dated March 20, 2012, shall remain in full force and
effect.

RE: Resolution Approving the First Amendment to Agreement with Steigerbuilt,
LLC for Installation of Landscaping and Irrigation of the Lot Located at 16100
Collins Avenue, and Removal and Disposal of Wall Dividing 16100 and 16200
Collins Avenue, for the Intracoastal Parks Project
RECOMMENDATION:
Attached for your consideration is a Resolution approving the First Amendment to Agreement
with Steigerbuilt, LLC for landscaping and irrigation for the Intracoastal Parks Project.
REASONS:
Due to the current deteriorating condition of the Intracoastal Parks there was a need to retain a
contractor for the installation of landscaping and irrigation of vacant lots located at 16050 and
16000 Collins Avenue for the Intracoastal Parks Project. Pursuant to Section 62 -12 of the City's
Procurement Code, the City Manager determined that it was in the best interest of the City to
waive its formal competitive bidding procedures due to time constraints and the urgent nature of
the Intracoastal Parks project.
On March 15, 2012 via Resolution No. 2012 -1882 the City Commission entered into an
Agreement with Steigerbuilt, LLC. to complete the removal of the existing asphalt, provide plans
and permit for irrigation, install new irrigation, grade the site and spread to grade new top soil,
and install new Augustine grass, located at 16050 and 16000 Collins Avenue, in an amount not
to exceed $53,500.00.
The City is now in need of installation of landscaping and irrigation of the lot located at 16100
Collins Avenue, as well as the removal and disposal of the concrete wall dividing 16100 and
16200 Collins Avenue, in an amount not to exceed $37,850.00, bringing the total amount not to
exceed to $91,350.00.
Funding is available in Account No. 35- 600 -5687.
