Outstanding Litigation
As a major international engineering and architectural firm SCI becomes involved from time to time with
litigation involving its projects. None of these are significant to the company's ongoing business operations.
In order to protect the privacy of claimants and other parties, it is our corporate policy not to release the
names of litigants or details of specific claims. You have requested information regarding claims. Claims
which we are defining as lawsuits or demand for arbitration received from clients since December 1, 2005
are as follows:
Florida. In 2005, SCI was named a defendant in a case arising from an automobile colliding with an under
construction road improvement. Following settlement by the culpable parties, that case was dismissed. A
subsequent claim for water damage from sewer work connected with the project was withdrawn.
International - Israel. In 2005 SCI was named a defendant in an arbitration action by a design builder in
connection with cost overruns on a project. SCI has denied involvement in the issues giving rise to the
action. The matter was resolved by negotiation.
Arizona. In 2005, SCI received a claim from a developer regarding survey in a flood plain. After
investigation the matter was resolved.
Arizona. In 2006 SCI was sued by a client developer in a matter that is essentially a fee dispute. The
developer subsequently went bankrupt and the various claims and cross claims were negotiated in a
bankruptcy court settlement.
Florida. In 2006, SCI was named as a defendant as a result of damage from wind damage to a sports
stadium. SCI did not design the equipment that failed and the matter has been dismissed.
} Iowa. In 2007, SCI was named in a claim by a subcontractor for extra fees on a sewer/pump station project.
After investigation the matter was resolved.
Arizona. In 2007 SCI made a claim against a land developer for fees and received a counterclaim for
damages caused by survey error. The matter has been resolved.
Kentucky. In 2008 SCI was named a third party defendant by a utility client that had been sued by a
contractor for increased costs due to its error in locating a building structure. SCI has denied responsibility
and after negotiation, the various parties resolved the matter.
California. In 2010, SCI named as a defendant by a real estate developer on a project in Nevada. SCI
denied liability. The matter has been dismissed and refilled in Arizona where it is still pending.
Jamaica. In 2010 SCI was named as a defendant in a pending case involving a hotel whose fresh water
supply was contaminated when construction allegedly broke a water main. SCI was involved in construction
administration on an adjacent road project, the damage was likely done by a contractor working on a
separate water line project. The matter is still pending.

Utah. 2011, SCI entered into a subcontract with an architecture firm for work at a small airport, designing
portions of a hanger. The contractor ran over budget, suing the owner for extras. All the design team
members have been brought into the case which is still pending. SCI's portion of the work was minimal and
it has denied any liability and the parties were able to resolve the dispute.
Illinois 2011. An SCI employee was injured when struck by a car in a highway construction zone. He sued
the contractor and owner who have brought SCI into the case to try to dispose of our medical and workers
compensation liens. The case is still pending.

Our team includes Mr. Mark Kopatz, a landscape architect and urban designer. Mr. Kopatz is our
community park designer. Mr. Kopatz has extensive professional experience in all phases of landscape
architecture and urban design, community visioning and development, parks and recreational facilities,
signage and way-finding, community workshops, commercial and retail, and downtown revitalization. His
experience includes projects spanning both coasts of the United States and overseas. He approaches
projects with a creative yet functional design that is specifically tailored to the client's goals and the project
locale. His vast experience makes him a key element for developing noise mitigation alternatives for
your project. Some of his past experience include.
Railbender Skate Park; Town of Parker CO-Mr. Kopatz worked on a 35,000 square-foot lighted skate
plaza and six tennis courts, the central feature at an 8.5-acre park. A bouldering area, natural-themed
playground and artful wall elements reflective of the skate theme create signature design features for the
park. Colored concrete and a nearly 100-foot long art wall create a strong skate park presence along the
street. The skate park is sited to create plentiful seating opportunities for spectators with the ability to host
competition skate events. The central lawn will host outdoor events and festivals. A public art display at the
center of the skate park provides a visual focal point.
Brian Aragon Park Brighton Skatepark Design; City of Brighton; Brighton, CO-Mr. Kopatz was
responsible for design and construction document review of a 1-acre park that includes the first permanent
skate park for a growing community. The 13,000 square-foot skate park has a unique layout and shape,
maximizing perimeter landscape and softening the feel of the park's concrete. Railings and fencing
enhance user safety and create opportunities for viewing and seating areas. The design is the culmination
of a series of interactive community design workshops to create a design that appeals to all ages and
abilities. The park includes a viewing area, picnic shelter, and restroom facilities.
Community Park; Confidential Client-Mr. Kopatz was responsible for project design, public
participation, contract management, overall schedule and budget control, and client service for a large
community park in Colorado. The park features an outdoor amphitheatre, multiple water features and
custom play elements themed after the "wonders of Colorado". It includes a premiere skate park that will be
a "one of a kind" and regionally significant to Rob Drydek's Street League. It is a destination recreation and
playground community park and is adjacent to the community recreation center and sports complex.

RFQ No. 12.04.03 Acoustic Engineering Consulting Services for Town Center Skate Park
4. Approach / Methodology
Project Approach
The City of Sunny Isles Beach Town Center Skate Park is situated next to two of Winston Tower's two
residential buildings and in the vicinity of several other multi-level and high-rise residential buildings. The
adjacent residential towers contain residential units with exterior balconies situated at finished floor
elevations that are equal to or greater than the existing Skate Park. A swimming pool and other outdoor
recreational facilities for the Winston Towers Community are also adjacent to the Skate Park.
j
It is clear from the photos above, that the existing town center skate (in red) is immediately adjacent
to condominium residences, swimming pool, and recreational facilities.
Noise complaints from the Skate Park's operations have been previously documented by the adjacent
residences of Winston Towers and the Salem House. The City of Sunny Isles Beach retained a consulting
firm (KHA) in 2011 to assess the noise situation relative to the City's Code of Ordinances and the
complaints of from the nearby residents. Based upon the contents of the report, it appears that there are
documented noise levels that exceeded the current code criteria for noise (Sunny Isles Beach Code of
Ordinances) .
The proposed Methodology to address the noise concerns and provide reasonable noise reduction
measures is described below. The objective of the Acoustical Assessment is to define the ambient
background sound levels from the Skate Park and the residential locations while the Skate Park is closed.
Additionally, the same type of ambient conditions will be defined during the Skate Park's operational
conditions which will include peak usage times. The defined ambient conditions during this period will
provide the worst-case noise impacts which are most likely being experienced by the adjacent residents.
Finally, three (3) noise abatement plans will be proposed and computer modeled for noise reduction to
provide solutions to the existing noise levels associated with the Skate Park. Design and probable
construction cost estimates for each of the abatement options presented will be provided as part of the
assessment.

Methodology
~ Perform a desktop technical review of the Noise Assessment performed by KHA. The contents of
the report may be used for field verification purposes.
~ Perform a review of all local Noise Ordinances which have jurisdiction in the subject location.
Municode (www.municode.com) and/or other types of searches will be used to accomplish this task
at the City and County levels.
~ Existing ambient sound levels will be established at the Skate Park and will include background
ambient sound levels, normal operational sound levels, and peak hour condition sound levels
(including weekend periods). The parks hours of operation and number of skater's present will be
documented. Additionally, other types of sound sources such as vehicular traffic and aircraft noise
will be documented. All applicable sound levels will be measured with Type 1 or Class 1 Acoustical
Instrumentation. All relevant noise metrics including octave band spectra will be measured for the
purposes of the acoustical assessment.
~ Existing ambient sound levels will be established at each of the residential towers at site specific
locations where noise impacts have previously been documented and / or at locations of specific
interest including the swimming pool area. The types of sound impacts measured and the
acoustical instrumentation used will be the same as specified above.
~ CadnaA software will be used to develop computer predicted sound level impacts at all relevant
locations of interest associated with the residential towers, the swimming pool area, and the Skate
Park. CadnaA will be utilized for the purpose of providing acoustical mapping with contours of the
subject area under evaluation. Sound attenuation measures will be developed based upon the
acoustical mapping results.
~ Potential site modifications to the existing Skate Park will be evaluated for the purposes of reducing
the existing noise levels during operation events and time periods. Potential site modifications will
be evaluated in CadnaA.
~ The results of the CadnaA modeling will be used for the purposes of establishing noise levels at
receptor points and determining acoustical materials, treatment selection, and placement.
Coordination with the appropriate acoustical materials vendor will ensure the proper application of
the expected acoustical materials content.
~ The results of the CadnaA modeling will be used for the purpose of developing the applicable cost
estimates for acoustical materials, treatments, installation, and permitting. All materials and
construction methods will meet South Florida Building Codes including Wind Loading. A variety of
materials may be available and could offer different colors and textures to ensure that the final
product is aesthetically pleasing.
~ Oversight and preparation of all shop drawings, applicable material costs, labor, and permitting, will
be provided to ensure that all time constraints and budgets are properly achieved.

Punta Gorda Hendrickson Dam Inspections & Due Di/iqence Report
I am writing to express our appreciation for the work provided by Stanley Consultants for the
Hendrickson Dam Spillway Replacement Project. The spillway serves as the main discharge
structure for a 273-square mile drainage basin. The spillway replacement required careful planning
and project management to insure work completion during the hydrologic low-flow season of the
watershed. The value of establishing a critical time schedule and completing the project within the
schedule can not be overstated. Stanley recognized this as a primary matter and continually
coordinated work to conform to the project schedule.
The Stanley team consisted of professionals with specialized skills required to design, permit and
manage construction of our project. We would like to particularly recognize the attention to detail
and management of activities from the planning stage through construction stage. It was
instrumental in the success of our project. Our project was completed on schedule within the
project budget, and required no significant plan changes and no contract change orders. We hope
to have an opportunity to work together on future projects.
Steve Adams, Utility Engineering Manager, City of Punta Garda

services for the Town Center Skate Park.

Dear Sir/Madam:
I am providing the following information in response to your request for references for the firm named above.

several projects. I was generally satisfied with their performance under the referenced contracts listed below.
1. Project # 62081, Contract # SCI-FT-3969-08-02, Project Title: Santa Barbara Blvd. Noise Study
Evaluation for Birkshire Lakes
2. Project # 62081, Contract # SC-ST -3969-08-05, Project Title: ESA- Noise Study Report- QA/QC

To whom it may concern:
Please accept this letter of recommendation acknowledging Cominey Arena and Stanley
Consultants, Inc. for their work on the traffic noise study of the US 41 at CR 951 intersection
improvements for Collier County. As a consultant for the Florida Depatiment of TranspOliation
(FOOT), I was asked to review the analysis and documentation prepared by Ms. Arena for the
project. I found her work to be complete and accurate. She demonstrated a thorough
understanding and COlTect application of FOOT and Federal Highway Administration noise
study guidelines and procedures. The Noise Study RepOli Addendum, which she prepared, was
clear and well written. She was very responsive to requests for additional information and
worked hard to meet an aggressive project schedule. I enjoyed working with Ms. Arena on this
project and look forward to working with her again in the future.

DISPUTE DISCLOSURE FORM
ITEM #19.2 CONTINUED
As a major international engineering and architectural firm Stanley Consultants Inc. (SCI) becomes
involved from time to time with litigation involving its projects. None of these are significant to the
company's ongoing business operations. In order to protect the privacy of claimants and other parties, it is
our corporate policy not to release the names of litigants or details of specific claims. You have requested
information regarding claims. Claims which we are defining as lawsuits or demand for arbitration received
from clients in the last five years are as follows~
1. Iowa. In 2007, SCI was named in a claim by a subcontractor for extra fees on a sewer/pump station
project. After investigation the matter was resolved.
2. Arizona. In 2007 SCI made a claim against a land developer for fees and received a counterclaim for
damages caused by survey error. The matter has been resolved.
3. Kentucky. In 2008 SCI was named a third party defendant by a utility client that had been sued by a
contractor for increased costs due to its error in locating a building structure. SCI has denied
responsibility and after negotiation, the various parties resolved the matter.
9. California. In 2010, SCI named as a defendant by a real estate developer on a project in Nevada. SCI
denied liability. The matter has been dismissed and refilled in Arizona where it is still pending.
10 Jamaica. In 2010 SCI was named as a defendant in a pending case involving a hotel whose fresh water
supply was contaminated when construction allegedly broke a water main. SCI was involved in
construction administration on an adjacent road project, the damage was likely done by a contractor
working on a separate water line project. The matter is still pending.
11. Utah. 2011, SCI entered into a subcontract with an architecture firm for work at a small airport,
designing portions of a hanger. The contractor ran over budget, suing the owner for extras. All the
design team members have been brought into the case which is still pending. SCI's portion of the work
was minimal and it has denied any liability and the parties were able to resolve the dispute.
12. Illinois 2011. An SCI employee was injured when struck by a car in a highway construction zone. He
sued the contractor and owner who have brought SCI into the case to try to dispose of our medical and
workers compensation liens. The case is still pending.
