A RESOLUTION OF THE HISTORIC PRESERVATION
BOARD OF THE CITY OF SUNNY ISLES BEACH, FLORIDA,
APPROVING THE APPLICATION FOR CERTIFICATE OF
APPROPRIATENESS REQUESTED BY PETITIONERS
GEORGE H. SCHOLL AND DIONE DEL MONICO TO
DEMOLISH AND REMOVE THE PROPERTY DESIGNATED
AS PERGOLA ATTACHED HERETO AS EXHIBIT "A"
LOCATED AT 334 ATLANTIC AVENUE, SUNNY ISLES
BEACH, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 171 -3.D., Code of the City of Sunny Isles Beach,
Florida, the Historic Preservation Board has been empowered to approve special certificates of
appropriateness authorizing the demolition, removal, reconstruction, alteration or new
construction of an individual site or in a district which requires determination by the Historic
Preservation Board before said certificate can be issued; and
WHEREAS, Section 171 -10 of the City of Sunny Isles Beach Code provides, in relevant
part, that the Historic Preservation Board's decision on the application for a certificate of
appropriateness be based upon an evaluation of the compatibility of the physical alteration or
improvement with surrounding properties; and
WHEREAS, the property designated as Pergola, located on Atlantic Island, at 334
Atlantic Avenue, Sunny Isles Beach, Florida, folio number 01 -2214- 003 -1360, legally described
in Plat Book 34, Page 17, Tract marked Pergola Landing laying west of Lot 71, was designated
by the Miami -Dade County Historic Preservation Board as a historic site on January 19, 1984,
and re- designated by the Sunny Isles Beach Histcric Preservation Board as a historic site on June
6, 2005; and
WHEREAS, Pergola sustained major damage during Hurricane Wilma, rendering said
structure uninsurable
WHEREAS, the Building Department of the City of Sunny Isles Beach has
recommended that Pergola be demolished; and
WHEREAS, the Petitioners George 14. Scholl and Dione Del Monico, applied for a
Certificate of Appropriateness on April 30, 2007, requesting demolition of the remains of
Pergola, with removal of said property by a construction dumpster; and
NOW THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION
BOARD OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Acceptance of Petitioners' Application for Certificate of Appropriateness The
Historic Preservation Board hereby approves the Petitioners', George H. Scholl and Dione Del
Resolution No. 2007 - Pergola Page 1 of 2
Monico, Certificate of Appropriateness dated April 30, 2007, subject to the following conditions:
(1) the Petitioners must obtain a demolition permit within thirty (30) days from the adoption date
of this Resolution; and
(2) the property owner(s) of 334 Atlantic Avenue, Sunny Isles Beach, Florida, 33160, retain the
opportunity to reconstruct Pergola in a similar form or architectural style provided they are able
to obtain necessary insurance within a five -year period with an additional five -year option
period. The property owner(s) will notify the Historic Preservation Board if they are unable to
obtain insurance within the aforementioned time frame.
Section 2. Effective Date. This Resolution will become effective upon adoption.

DEFINITIONS
Maintenance or Repair: The act or process of applying measures to sustain the existing form, integrity, and
material of a building or structure and the existing form or vegetative cover of a site. It may include initial
stabilization work, where necessary, as' well as on -going maintenance and repair. Samples of material may be
requested.
Restoration: The process of accurately recovering the form and details of a property and its setting as it
appeared at a particular time by means of the removal of later work or by the replacement of missing earlier
work. All applications for restoration shall include: elevations, site and landscape plans (if necessary). A 300 -
word statement with bibliography justifying the work and any additional photographs or information to
support the proposed work.
Rehabilitation: The process of returning a property to a state of utility through repair or alteration which
makes possible an efficient contemporary use while preserving those portions or features of the property which
are significant to its historical, architectural, and cultural values. All applications for rehabilitation shall
include: elevations, site and landscape plans (if necessary), and other supplementary information that will
support the proposed project.
Excavation: The process ofperforming an archaeological dig to recover artifacts, historical material, or other
archaeological features. It is recommended that the applicant include a 300 -word statement describing the
project, its methodology, and where the recovered material will be disposed.
Demolition: The process of destroying or tearing down a building or .structure or a part thereof, or the process
of removing or destroying an archeological site or apart thereof. The Applicant(s) shall include a report
explaining why the proposed action should occur. If this action is to occur for financial hardships all pertinent
financial data should be included pertaining to the cost (if preservation, demolition and new construction.
Any other material to the application is also encouraged as supplementary information.
New Construction: The process of constructing a building or structure that has never existed at that location.
Applications shall include: a site plan, elevations, floor plan, and landscape plan.
Relocation: The process of moving a building or structure, from its current foundation to another site.
Applications shall include a report justifying the relocation and indicating that efforts to preserve the building
would not be.feasible and justifying the proposed relocation site.
