I q L( A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST AMENDMENT TO AGREEMENT WITH BEISWENGER, HOCH AND ASSOCIATES, INC. (BH &A), TO PROVIDE POST DESIGN SERVICES FOR THE SUNNY ISLES BEACH/NEWPORT FISHING PIER, IN AN AMOUNT NOT TO EXCEED ELEVEN THOUSAND THREE HUNDRED THIRTY -SEVEN DOLLARS AND FIFTY CENTS ($11,337.50), ATTACHED HERETO AS EXHIBIT "A "; AUTHORIZING THE PAYMENT OF TEN THOUSAND DOLLARS ($10,000.00) AS THE CITY'S CONTRIBUTION FOR REVISION TO PLANS FOR RESTAURANT AREA; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission had long desired to reconstruct the historic Fishing Pier at Pier Park for the health, welfare, safety and enjoyment of our residents and tourists alike; and WHEREAS, on March 17, 2011 via Resolution No. 2011 -1693, the City Commission ratified an Agreement with Beiswenger, Hoch and Associates to provide post design services for the Sunny Isles Beach Pier a/k/a Newport Fishing Pier located at 16701 Collins Avenue, in a total amount not to exceed Forty -One Thousand Dollars ($41,000.00); and WHEREAS, since the original design for the Newport Pier Reconstruction was completed, several changes have been made to the design which were required by the permitting agencies as a condition of their approval; and WHEREAS, the City in coordination with Dr. Cornfeld requested modifications to the current design of the restaurant at the Sunny Isles Beach/Newport Fishing Pier; and WHEREAS, Beiswenger, Hoch and Associates has expressed their ability and desire to provide these services subject to the terms and conditions contained within the First Amendment to Agreement, and submitted a proposal to provide these services for the Sunny Isles Beach/Newport Pier Project; and WHEREAS, the City wishes to approve the First Amendment to Agreement with Beiswenger, Hoch and Associates to provide these services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not to exceed Eleven Thousand Three Hundred Thirty -Seven Dollars and Fifty Cents ($11,337.50), attached hereto as Exhibit "A ", bringing the total amount not to exceed to Fifty -Two Thousand Three Hundred Thirty -Seven Dollars and Fifty Cents ($52,337.50); and WHEREAS, those design changes were made under a separate contract between BHA and Dr. Cornfeld in an amount of Forty Thousand Three Hundred Forty -Eight Dollars and Eighty Three Cents ($40,348.83), of which the City is Committed to 25% of the cost or in an amount not to exceed Ten Thousand Dollars ($10,000.00), with Dr. Cornfeld contributing 75% of the cost of 82012- BHA I" Amendment to Agmt Pier Page 1 of 3 the requested modifications to the current design of the restaurant at the Sunny Isles Beach/Newport Fishing Pier. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approving the First Amendment to Agreement. The First Amendment to Agreement with Beiswenger, Hoch and Associates, Inc., to provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not to exceed Eleven Thousand Three Hundred Thirty -Seven Dollars and Fifty Cents ($11,337.50), attached hereto as Exhibit "A ", be and the same, is hereby approved. Section 2. Authorization for Contribution. Authorizing a contribution of Ten Thousand Dollars ($10,000.00) as the City's commitment of 25% of the cost for revision to plans for restaurant area. Section 3. Authorization of Mayor. The Mayor is hereby authorized to execute said Agreement. Section 4. Authorization of City Mana ear. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 5. Effective Date. This Resolution will become effective upon adoption. CONTRACT NO. C1112-037 This First Amendment to the Agreement between the City of Sunny Isles Beach and Beiswenger. Hoch and Associates, Inc., executed this I n°t day of M , 2012, is made a part of the original Agreement, C1011-031 ("Agreement"), approved by Resolu ion No. 2011-1693 on March 17, 2011 and incorporated herein by reference, between the City of Sunny Isles Beach ("City") and Beiswenger, Hoch and Associates, Inc. ("Consultant") a business corporation licensed in the State of Florida, whose Federal Identification# is S`I. 01 S I(.10 . The City and Consultant hereby agree as follows: 1. ADDITIONAL SERVICES TO BE PERFORMED. The scope of services, as set forth in Section 2 of the original Agreement, is hereby amended to include the Second Revision to Sunny Isles Beach Pier&Restaurant as more particularly described in Attachment"A",which is attached hereto and incorporated herein by reference. 2. COST. The payments to the Consultant, as set forth in Section 4 of the original Agreement, is hereby amended to include additional compensation for the additional services to be performed,in an amount not to exceed Eleven Thousand Three Hundred Thirty Seven Dollars And Fifty Cents ($11,337.50), bringing the total contaff amount not to exceed Fifty Two Thousand Three Hundred Thirty Seven Dollars And Fifty Cents($52,337.50).' 2. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and conditions of the original Agreement between the parties, dated March 17, 2011, shall remain in full force and effect. These changes have been largely made at the behest of the permitting agencies as a condition of their approval. Additional changes have also been made at the behest of Dr. Cornfeld, primarily related to the build out of the building interior. Those design changes were made under a separate contract between BHA and Dr. Cornfeld. The City contributed 25% of the cost ($10,000) and Dr. Cornfeld contributed 75% of the cost ($30,000). FUNDING SOURCE: Funding is from account number 20- 600 -5670.
