AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265 -25 OF
THE LAND DEVELOPMENT REGULATIONS TO REQUIRE A
NONREFUNDBALE DEPOSIT OF TEN PERCENT (10 %) FOR THE
PURCHASE OF BONUS UNITS WITHIN CERTAIN ZONING
DISTRICTS; PROVIDING FOR ZONING IN PROGRESS; PROVIDING
FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING
FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE
DATE AND APPLICABILITY.
WHEREAS, the City of Sunny Isles Beach (the "City ") desires to facilitate and expedite
the development of real estate projects throughout the City; and
WHEREAS, in order to accomplish this goal, the City desires to require that applicants
shall be required to pay a nonrefundable deposit of ten percent (10 %) for the purchase of bonus
units, which shall be paid within three working days of the date of City Commission approval of
the site plan application; and
WHEREAS, the City Commission desires to expedite and ensure the proposed
development is constructed within the time frame permitted by the Land Development
Regulations.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part by this Ordinance
upon adoption hereof.
Section 2. Amendment. Section 265 -25 of the City Code is amended to read as follows:
§ 265 -25. Zoning districts and boundaries.
G. Bonus Unit Deposit Required An applicant shall be required to pay a ten percent (10 %)
nonrefundable deposit for any bonus units purchased at the time of approval of site plan
The deposit shall be paid within three working days of the date of City Commission
approval of the site plan application Failure to make such deposit within the prescribed
time frame shall result in an automatic voiding of the City Commission approval The
requirements of this section shall apply to any zoning district in the City that provides
monetary bonuses to increase the floor area ratio of a development project

Section 3. Zoning in Proeress. The City hereby declares zoning in progress. All applications
for development approval filed prior to the date of adoption of this Ordinance and not yet acted
upon by the Commission shall be reviewed and approved pursuant to the provisions of this
Ordinance.
Section 4. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 5. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 6. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 7. Effective Date and Applicability. This Ordinance shall be effective upon adoption
on second reading.

Ordinance amending Section 265 -25 of the Land Development
Regulations
RECOMMENDATION:
It is recommended that the City of Sunny Isles Beach (the "City ") adopt the proposed
Ordinance amending Section 265 -25 of the Land Development Regulations.
REASONS:
The City desires to facilitate and expedite the development of real estate development
throughout the City. More precisely, the City desires to ensure the proposed development
is constructed within the time frame permitted by the Land Development Regulations.
Additionally, the City wants to stop the practice of "flipping" development approvals by
speculators. In order to accomplish these goals, the City desires to require a
nonrefundable deposit of 10% for the purchase of bonus units which shall be paid within
three working days of the date of City Commision approval of the site plan application.
The failure to make such deposit within the prescribed time frame shall result in an
automatic voiding of the City Commission approval. Lastly, the requirements of this
amendment shall apply to any zoning district in the City that provides monetary bonuses
to increase the floor area ratio of a development project.
